This is my formal notice that I am disputing this debt, and requesting immediate validation under Section 809 of the Fair Debt Collection Practices Act, 15 U.S.C. § 1692g, of the debt from your office.  I am requesting that your office immediately send me a copy of the following documents: (a) the name, address, and phone number of an employee of the original creditor that can validate the debt, (b) proof of who is the current legal owner of the debt, and that you represent the original creditor or debt buyer, and (c) the original signed note, contract, credit agreement, or instrument creating the debt.

I am disputing this debt for the following reasons:  this debt has not been validated.  I do not know whether your debt collection company is the legal owner of this debt or not, or if the amounts charged are valid.

This is also my formal notice under 15 U.S.C. § 1692c, to you to cease all further communications with me, my family members, and my associates and all third parties, unless I give you express permission to do so.  You have my express permission to mail me the requested validation documents to the address listed below, but I do not give you permission to contact me over the phone, or in any other way except as specifically addressed in this letter.

The Georgia Supreme Court says Hanna is a "law firm," so you have to submit a bar complaint vs. them (and not a consumer complaint with the state OCA or federal FCC -- but fine if you do that too anyway).  You may submit a bar complaint vs. Fred Hanna (the owner of the "firm") and any atty. that may have contacted you that also violated bar rules for atty.s: (Call and ask for a bar complaint, and if they have them online):

When we named Fred Hanna, a Toxic Waste Debt Collector, we had no idea we would be foretelling the future. We are starting to hear stories from all over Georgia about the operations there and it appears the lawsuits and government sanctions may be on the way. We could use some true insider information:

Here's our understanding at this point: There is a health danger at several of the Hanna operations so bad that the government's OSHA has come in on at least two occasions. There is talk of someone - perhaps Fred or Dennis - signing off on OSHA documents and falsifying government paperwork. More to come as we sort through all the material.

It seems that Hanna will lie on court affidavits about his position and most affidavits attached are bogus in the information stated. Fred J. Hanna is NEVER to be trusted, his court filings should ALWAYS be challenged. Fred is concerned about one thing; separating you and your money.

Georgia Collection Law Firm Facing Lawsuit from Governors' Office of Consumer Affairs

Today's AJC reports that Marietta collection law firm Frederick Hanna & Associates has been sued by the Governors' Office of Consumer Affairs following multiple complaints about collection tactics used by the firm. In November, the state consumer office served an investigative demand notice (i.e. a subpoena) on Mr. Hanna's law firm asking for documents about the firm's collection practices. Hanna contends that because his office is a law firm the state agency has no right to this information.

Among the complaints leveled against Hanna along with other high volume collection firms (Hanna opens 50,000 new files a month!) is that they engage in collection of s0-called "zombie debt," accounts purchased by collectors for pennies on the dollar because it is old - so old that the statute of limitations has run and the debt buyer has no legal right to sue.
Other complaints filed by consumers often arise from identity theft cases in which a claim arising from fraudulent charges is sold and resold, eventually ending up in the hands of a debt buyer who files a lawsuit. Often the cost and complexity of defending the lawsuit can exceed the amount claimed, or the consumer fails to respond, resulting in a default judgment.

A hearing on the consumer affairs agency's demand is scheduled for March 30, 2009 in Cobb County Superior Court. If the Governors' Office is successful, collection firms will find it more difficult to avoid disclosure about collection tactics and processes - we will report back on the results of this hearing.

Send these Attorney's a certified letter containg the following two items:

1. a Demand (which is your right) that they VERIFY the debt (i.e.-producing a copy of the origianal credit instument WITH YOUR SIGNATURE on it).


2. Also point out to them that calling you about said debt is a PREVELAGE, NOT A RIGHT. Simply tell them that all future communication with you either by them or one of their authorized agents will be by MAIL ONLY.

It works, they will very quickly lose interest in you and go on to the next potential account.
