Sherin Thawer is one of the most incompetent and unprofessional attorneys in DFW. She advised my wife to file her paperwork even though her priority date was not current for her existing Green Card application.

We paid $2200 in her fees, and $1350 in INS fees. The INS ended up rejecting the application, and not cashing the check for the INS fees of over $1300, which was payable to the Department of Homeland Security.

We had to hire another attorney to clean up the mess, and get my wife's legal status in order because her I-94 had expired due to Sherin Thawer's incompetence and her lack any understanding of immigration law. She should be banned from practicing immigration law due to her incompetence, and lack of ethical values.

Anytime my wife tried to follow up on her case, Sherin refuse to respond and told my wife that my wife had nothing better to do.

We paid the INS fees to Sherin Thawer's office by credit card, and Sherin submitted a separate check payable to the Department of Homeland Security. These fees were on top of the $2200.00 we had already paid for her services. Sherin Thawer is still holding our money which the INS never cashed and returned.  Her show should be banned because her show is NOT a community service, it is advertising to get more customers in. She never answers any legal questions on the show, and instead requests listeners to bring their paperwork to her office. Once they are in the office, she charges consultation fees, and will take any case by misleading her new clients.

THIS DOES NOT SEEM LIKE SOUND LEGAL WORK TO ME

AUTHOR: Joe - (U.S.A.)

You have a lot of  ways to go with this.

For one thing, you DID check with the Texas State Bar Association to see if this woman is even licensed to practice law in the state of Texas and if she claims to be certified in the   legal specialization area of Immigration law and she is NOT, the Bar can file criminal charges if she is practicing any law without a license. They have a web page with a search engine and instructions on how you can check her out.

There are a lot of fakers, foreign attorneys, disbarred attorneys from other states, paralegals who think they can practice law and others who learned about law in prison law libraries so you can't be too sure who your legal representation is these days.

I AM NOT ACCUSING THIS WOMAN OF ANY OF THOSE THINGS BUT YOU NEED TO BE AWARE THEY ARE HAPPENING AND YOU NEED TO BE AN INFORMED CONSUMER OF  TEXAS LEGAL REPRESENTATION!

For one thing, you need to report her to the Criminal Investigation Division of IRS and tell them how much money she took from you and you think she has taken more money from other clients instead and not reported it to IRS or paid taxes on it and she needs to have an audit to make sure.

IRS loves to do audits especially now when the government needs the tax revenue.

Make sure your own financial matters are in order before you call.

There are other lawyers who sue other lawyers for legal malpractice and that is what you should consider doing to this person.

You should have disputed the charge on your credit card as a scam because that is what it MAY have turned out to be. You apparently did not get the services that you paid for so you should have disputed it ASAP!

Now comes the matter of the $2200. Did she say this was her retainer to take your case and did you sign a contract with her stating that it was to be paid to her as a retainer. If you did, then you lost it because those are generally non-refundable. (There ARE exceptions but you need to talk with an attorney about that.)

You need to look over the contract you signed with her when she agreed to take your case and you need to do it calmly and rationally and see just what fees you agreed to pay. Make sure you take all paperwork to the legal malpractice attorney when you go in for the initial consultation.

I would also report this woman to the Texas Bar Association which is located in Austin,Texas.

Based on what you  have said here, this attorney does NOT seem to have done good legal work. But I only have your side of the story.

You really do need to consult with a legal malpractice counsel and see if you do have a case.
