I was told by the owner of this particular Liberty Tax franchise, Annie Fuller, that it would cost me $98 if I wanted to file the RAL. I didn't want to pay that, yet I needed the money to get into a new rental house, so I did.

Three days later, still no check (they told me 24-48 hours) I called (and this would be the last time I'd reach them by phone, though I called scores of times after that!) and spoke to a girl who looked up my record and said I did not get approved for the RAL, that my return would come in about 2-3 weeks.

My return did come on May 2 as the IRS website had stated, yet it was short $500!!! I called this Annie, and of course she never returned my call, the office was not once open at the times posted.

I went to the IRS today and they showed that my money was actually deposited into some "mystery account", then into mine, minus the $500. I quickly called the police and filed a police report in front of the closed Liberty office.

People started coming out of their shops wondering what was going on, and more people filed police reports against them saying they too had been ripped off by them. One saw the owner in the casino last week plunk down $10,000 on a table--mine and other innocent client's money!

They are going down! I filed the police report, called the main company number, am talking to a fraud detective and am sending off my fraud papers to the IRS tomorrow. I just hope to get my money back!

I had my taxes done on highway 58 in chattanooga and have about 8 friends that had their taxes done there. We all have in explained charges on our paper work. Hey Dan, Is anybody doing anything about Annie Fuller? If she's kin to max fuller she knows nothing but lying, cheating, scams, etc. Any way I've been cheated two years in a row. You did my taxes last year and I never got my state returns last year or this year. Is there anything we can do or is it in fine print where she can screw us?

It is so very possible that your $500 was taken not by the owner of the company. In the bank disclosure you may read that there are other agencies that can take from you check. Most common are----child support owed to a state agency, state taxes owed to a state agency, court order against your refund filed by whomever but usually a state tax that placed a lein. The bank refund hotline from Santa Barbara Bank and Trust or Republic Bank depending on which RAL was offered can really help you find whose account the money was placed in and give you contact info for that particular agent of the account it was dropped to. There is a department for debt ceased by third parties and I am almost sure this will resolve your problem. If you call corporate again, ask them for this number to see if your $500 may have been taken by a third party by law. The only one who can tell you that is the BANK. Go straight to SBBT first. Secondly, she could not have charged you $500 extra as a tax prep fee because it would be on your invoice clearly as those reports are generated before going through to the bank and CANNOT be changed after sent....so this is why I truly believe that the money is somewhere in an old school loan repayment lein or state agency took it and gave the rest back to you. State agencies and college is the ones that confuse the refund loans. They can take it in the blind without notifying you NOR the business. The business may even be mislead by the Bank not having the proper info for the depositor agency. I would investigate if you remember any college tuition unpaid in prior years, child support action taken against you, state taxes owed from any state. I can also tell you that when the bank denies you for the 24-48hr loan, they do not charge the RAL fee....they knock it down to the refund transfer only which is a mere $29.95 to wait until the IRS deposits to the RAL Bank (which is the ghost account), then that money gets intercepted by the state actions against you first, then they get the $29.95 transfer fee for writing the check and processing it for you, then VERY LAST, the owner of the franchise gets her $98 tax prep fee. The remainder is what your check prints for. I am sure Annie is just as baffled as you are about the $500 cease knowing she did not get that money either. But I am sure this will explain alot. I have been a franchisee just as long as Annie has. She has given her all to gain respect and helped alot of people all over the country in many charitable ways that did not make her a dime. That does not excuse your unresolved problem, but please understand she may not have the answer either as YOU are the only one who can call the Bank to get that personal information about who you owe prior debt to. I really hope this helps. I hate to hear you have been discouraged for all this time.

For those interested, No, nothing has been resolved!  Annie's responses on this forum when this happened almost 2 years ago are BOGUS!!!  She never ONCE tried to contact me, NEVER tried to resolve anything, never tried to pay me the $500 she stole from me.  She never even was woman enough to return my 10 or so phone calls to her office!  (And no, I never got the RAL loan she charged me for.)  And yes, she does (or did, at least) own stores in both SC and TN. 

Furthermore, she sold her Liberty Tax offices she snatched up for one tax season in Chattanooga and skipped town after she'd ripped off everyone she could here!  I happen to have met a relative of the person who bought the franchise that I was ripped off at.  Apparently this is what Annie does, moves around, rips people off for one tax season then skips town before she can get thrown in jail!

Dan, if you're still interested in a class action law suit, leave your contact information, I'm in!  This woman needs to finally pay for the crimes she is involved in.  While I was filing my police report against Annie Fuller, there were two other poor souls she robbed who also got courage to file a police report against her also.  One she robbed for more than she robbed me!

Don't worry, Annie, you're going down.  You may run from the law, but you can't hide forever.  Crime doesn't pay!!!!

There are a few things that need to be paid attention to in the consumer rebuttals that remark that this particular franchise is actually a decent place to get your taxes done.  Please note that Bianca is one of her managers and that many of the rebuttals are from geturgun or however its phrased and are from the same person.  I know for a fact that she almost never disclosed full fees to clients and even went so far as to only issue the check and not the stub that went with it on numerous occasions to keep the client from actually seeing the final fee.  She was also notorious for not returning client phone calls that were upset.  As far as the whole showdown about Chattanooga and South Carolina, this owner actually owns stores in both states.  I feel terrible for Robin and her situation and hope that it was resolved, however if she wishes to contact me in some form I would be more than happy to give any police officer my information and how I know what actually happened there.  Its not just you Robin and thats the truly sad part.

I am a Liberty Tax franchise owner and would like to offer some advice.

The RAL is a loan from the bank, not a faster refund from the IRS. RAL approval is not guaranteed and is based on criteria set by the bank. Liberty Tax and its franchisee's have no control over the loan approval. This information should be explained to the customer when the RAL is submitted. If the loan is denied it automatically gets processed just like a normal refund, which takes 2-3 weeks. Customers are provided with the RAL agreement when they file their return, which includes all this information. A customer is not due a refund for their tax preparation fees just because their loan is denied however, the customer will not be charged the additional interested related to the loan if it is denied.

Daddyzaring, there is no excuse for errors on your return that resulted in a 5 month wait however, the person who prepared your taxes should have advised you that filing an injured spouse form does delay your return. Filing time for this form is about 14 weeks if you e-file, per the IRS. This form is filled out by the preparer, but the actual refund amount is calculated by the IRS.

Liberty Tax franchises are individually owned. As a consumer, do not be afraid to ask about tax preparer qualifications. I can not speak for other offices, but I am a CPA and no tax return in my office is filed until I have reviewed it for accuracy. If you do not feel comfortable with your preparer (at Liberty or other tax services), ask for qualifications or shop around for another preparer.

We needed my taxes back ASAP, so I decided to try Liberty Tax. After explaining my tax situation, and that I had to file an Injured spouse form with my taxes because of my husband's student loans, I was told I could still get an intant refund, and if not we wouldn't have to pay the extra charges. Well it took 3 months to get part of my money, and 5 months to get the rest because of mistakes they made and the IRS had to redo my taxes. I have tried contacting them through their store, their main office, on the phone, by email, and through the BBB. Finally today we went in and were able to talk to the manager. He didn't care what we had to say, or that we were unhappy with their service, and he only quoted us what all the charges were for. I knew what they were for, that's why I wanted them refunded, because what they were for I did not get! I will never go there again, and hope others beware of this company as not to get ripped off as well.

I dont know how many franchisees i saw this year floating around with anne fuller but i can tell you this we had rules to follow when the franchisee's were there like we didnt talk about how we were filing tax returns without w-2's and how anne showed us how to look up the ein and use the last pay stub also anne coached us on how to add a scedule c a business return to help people commit fraud and make her bottom line better also anne fuller told me when i asked why she did all the gorilla marketing classes she said it didnt matter if they learned anything she got free labor out of it to promote her business . you all dont need to worrie too much about anne fuller and the liberty tax offices in chattanooga tn I have complete backups of their tax programs and I have in just one office found over 150 cases of coaching fraud I am making it my business to put anne fuller in a fedrial prison were she belongs and the over 500 people that were coached and commited fraud get audited by the irs word will get around about liberty tax I am sure that the news media will pick it all up at some point and you will see the results on cnn

To Bob Smith whom I do not know and has listed my name on this site accusing me "not filing thousands of returns and disappearing to avoid warrants". Sir I suggest you get your facts straight prior to making ridiculous accusations as you have.

I am a former Liberty Tax Service franchisee in NC and I provided service to thousands of satisfied clients. As with any business you will have clients that are unhappy, particularly in this industry where we try to offer clients a means to get access to their IRS refund thru a loan product. This is a loan that we do not directly provide and we have no control over the approval criteria. Thanks to some of our competitor"s advertising strategies every client that applies for a RAL thinks that they are entitled to receive their money in "24-48" hours. It is a "LOAN!" Many of the clients that apply for this loan have already spent the money prior to walking into the office and when they are declined or when their IRS refund is garnished to pay other obligations they blame us. We are a facilitator only. And lets go ahead and tell the full truth: most of the time when this happens we the business don't get paid a penny for our services and we don't pursue collection for it.

As to the comments about me disappearing, since selling my franchises I have worked for a number of other Liberty franchisees and have been in constant contact with Liberty corporate offices. I never diappeared and certainly never left "thousands of returns unfiled" Liberty came in and took over my offices as I was in the midst of a nasty divorce process. So my guess is that any "warrants" had to do with papers being served for my divorce. Careful spreading rumors about things that you think you know bub!

Because I was not present durning Robin's visit to Liberty I can not say what did or did not happen.

I do know that each person in our office allows the customer to make the choice of what banking product they wish to use.

The faster the customer wishes to receive his or her refund will change the cost along with the number of forms that preparer has to use. This is the same for the other Tax companies .

Yes I have met Annie , and Liberty is life. She would not have stolen your money ( with out knowing what actually happened ) I just believe the is some kind mis-understanding and it will all be taken care of .

People please remember , filing taxes is not like it use to be.

I went into liberty tax on 1/27/09 was told i would get my ral in 24-48 and before anyone says anything in reputtal. i have the paperwork that i signed and the person who did my taxes stating that i would receive my money exactly 24-48 hours after tax preparer filed the taxes in the office. meaning when she finished my taxes at 230 pm they had 24-48 to have my money on the card. i did them the night before online and it would had cost me 20 to have them e-filed but it would take 8 days and I needed it sooner so i went in adn was charged 488. to have them do a simple 1040 and it took 25 minutes. 300 to do the taxes and the rest for the ral that i have not gotten and still no calls back nothing. i have been int here 3 times today and will be back in the morning. i have filed with the bbb and consumer affairs. And if tomorrow when i go in there and not told that they are going to credit every penny i was charged including what they think they are going to charge me for them doing them i am going to file a class action suit on them adn if anyone of you out there are reading type onlin about jackson hewitt and see what your rights are this year california has banned them from doing ral due to misleading lies from them and the bank and million of dollars they ripped off from people and liberty is next. you liberty people outside your places walking are going to be filled with angry people you rip off. ever heard of 6 degrees of seperation? well i can see and make sure online with myspace and facebook, which are 95% of your clientel cause they want it early to boycott going to liberty tax this season and put you out of business. i have been treated like I am the idiot and i will not allow that so i am going to make sure that liberty tax pays so many fines this year with there lies that they never can rip another hard working very limited income mom or family again. so anne before you rebut back think before you speak and do not talk all like you will get more customers so what is a couple cause that is all it startes with and for people to hear and see how cocky you are being will destroy the name of the business and yours so have some compassion when you come on here and be careful. call her and give her her money back and if she does not get it back i hope she comes after you personnally..

It's Easy To See What Is Going On

The positive and defensive responses offered here are probably bogus.

The first clue was when one of them claimed to patronize the Chattanooga location, while claiming to live in Columbia, South Carolina. I don't think that I have ever found the need to drive 350 miles to have my tax returns filled out. I doubt that many other people have either.

It's probably safe to assume that for the most part, those Liberty Tax franchises that are still in business in the Chattanooga area are okay to do business with, but there is a way to verify them as legitimate and without complaint.

The Chattanooga Better Business Bureau does a great job of keeping updated records on file for businesses in the local area. It's always a good idea to visit their website and do an inquiry into any business before patronizing it for the first time.

Liberty Tax Service, in general and on a national level, has a decent reputation. I found no unresolved complaints on file. Their corporate offices are in Virginia Beach, Virginia, and if anyone has an issue with a franchise that cannot be resolved locally, I wouldn't hesitate for one minute to get them involved.

They apparently work very hard to resolve consumer issues satisfactorily when they occur.

Always keep in mind that one instance of a valid complaint, shouldn't necessarily rub off on the company's reputation, when evidence exists that it is isolated in nature.

After all, even someone with the initial cash to buy into a franchise can wind up mismanaging the business. That appears to be the case with this complaint.

Please identify this bank and explain how any lender charges a consumer $500 for DISAPPROVING a loan.

I worked in the corporate office of Liberty for four years. I have listened to hundreds and even thousands of customers complain about being ripped off by Liberty offices. I can cite specific names of franchisees who have gone out of business and taken the customer's money with them. There have been quite a few scandals. They are quickly covered up by Liberty. In fact, here is the latest from this month, Liberty owner arrested and charged with not filing taxes for thousands of clients. Federal marshalls have secured the records and now he has been evicted after writing a bad check.

Natasha Randall in Louisana, another federal indictment by the IRS. She took monies from customers and never filed thousands of returns. There are more examples that I have space to name.

Liberty Tax has helped me in more ways then just with my taxes...

I have a very different story about liberty tax than the one written here.

when I went in to see how much my refund was I had n w2 yet but wanted to see what I was going to be getting as my refund.
I had several bills due and my lights were close to being cut off.

Although this is embarrassing I am sharing this to show that this office really cares about their customers.

the office had nothing to gain by estimating what my refund would be, I could not pay them or the estimate (hand r block wanted $50 "sit down fee") and they said it was simply a free service they provided.

when they had done the estimate not only did they treat me like I was part of their extended family but gave me a t-shirt, a donut, and told me all I had to do was bring in my w2 and I was finished.

in passing I had told the preparer about my situation.
as I was leaving the owner walked over to me and handed me an envelope and said hopefully this will help, please tell others to come see us too!

the envelope had $100 in it and that was enough to pay my electric bill.

as you can imagine I was almost in tears and was so greatful for the compassion.
I just cannot believe that this same office hasn't gone above and beyond to help their customers.

Also, with the RAL loan there are fees that the lending bank gets..not liberty tax.
when I need my refund fast I know its a loan, and the bank that provides the loan charges a fee to do so. I THINK my bank charges were about $100 so this customer may be confused thinking that Liberty took the money when actually the bank took it as their payment.

I hope this customer will rethink what they are saying as it just sounds nothing like what I AND all the people I reffered there have seen.

I have been going to liberty tax for a while and havenever heard of anything like this.
I have had nothing but great experiences and have never been treated so well.
When I walk in the door hey know my name, have coffe ready and I always leave with a well done tax return and some sort of gift.

I have reffered everyone I know to Liberty tax and wil continue to do so every year.

Once, I had an error that was MY fault, but because it took a while to fix the problem the owner gave me my money back anyway...THIS NEVER happens at most other businesses in this country.

I would reccomend going to a liberty tax and seeing for yourself how great they are and not trusting this one persons word.

I looked and found nothing else about this but DID do a google search on the owner and she seems to have many accomplishments to her name for outstanding work.I think the slanderous way this person wrote about her is aweful.

I have nothing but Wonderful Experiences with This office and the owner

I have been going to Liberty tax there in chattanooga for a few years now and have had nothing but a wonderful experience every single time.

In addition to this I have also seen the new owner Annie Fuller take care of issues that have come up with the utmost care and consideration for the clients interest.

When I used to file my taxes a HR Block they were rude, did not take the time to make me feel like they wanted my business and I felt more like a number in a cattle call and a dollar sign, then a paying customer.

At this office I was made to feel like I mattered and since Ms Fuller took over it was even more outstanding than I remembered

my taxes were filed accurately, and I TOO opted fr the RAL loan. Although it took longer than it normally does (a few hours normally) we found that it was the IRS who was at fault and not Liberty, so I still received the RAL loan instead ofhaving to wait another 2 or 3 weeks for my refund to come fromthe IRS.

I had friends of mine who also had similar situations this year and their preparers did not help them the way Liberty did. Ms Fuller personally got involved with my return and told me everything that was happeneing until it was resolved.

I feel completely comfortable with this office and the company and will be referring my friends who have been going elsewhere to this office this year.

Annie stated in her response that she tried to contact the customer (me) about returning my money, and this is a LIE! I have tried to call them, tried to go there, I have left messages on their office voicemail telling her my return was $500 short and I HAVE NEVER HEARD BACK FROM HER OR ANY EMPLOYEES AT LIBERTY TAX! My pleas have been completely ignored.

And DON'T try to berate me by saying, "Sometimes people just don't understand. This is the case here". I DO understand how the RAL works, I've gotten them the past 3 years, and before that the "Rapid Refund" with H.R. Block. I've gotten them either that day or the next day. I have never paid more than $200 for getting my money that day or the next.

I DID NOT RECIEVE MY MONEY FOR TWO AND A HALF WEEKS, yet was charged the $500!!! And this AFTER you told me I DID NOT GET APPROVED FOR THE RAL!

I would go in there to pick up my supposed refund on the money she stole, IF THEY WERE EVER OPEN! She's not even there on the one day a week the sign on their door says they will be there!

Annie, I know you'll read this, you have two phone numbers for which you can contact me, so if you're not just full of OONGAWA, CALL ME (LIKE YOU ALREADY LIED THAT YOU DID) AND GIVE ME MY MONEY BACK!!!

The reporting person said that she was DENYED a RAL., and got her regular refund weeks later. THatis NOT rapid. So give themback teh money already, right a check, send it to them by certified mail. I think, in this case, you ripped off their money.

Although I am not allowed to discuss the details of this persons return I will attempt to provide a peace of mind for all who read and encourage you to visit ANY Liberty tax near you to decide for yourself why we are the number one growing tax company ever.

the way a bank loan works when applying for a loan against a tax refund can be confusing to some. We make every effort to provide detailed information, give several options and above all clearly state both verbally and in writing what our fees would be for preparing the return and what fees the bank will collect for providing the loan (RAL that was mentioned is a Refund Anticipation Loan).

This Loan is usually selceted by individuals who require or simply want to receive their money in a 24-48 period of time and forego waiting the 2-3 weeks for the IRS to disperse the refund.

a tax office such as ours can prepare the taxes, send the return to the IRS and once "accepted" by the IRS provide the bank with the anticipated amount of their refund. Once the bank receives notice as to whether this person has any outstanding debt visible to the IRS they make a determination on approving the loan or declining. Also, they will not make a decision on the loan until the IRS accepts the return. The reasons a person has to wait are usually out of the tax preparers control due to many reasons that must be addressed prior to the bank receiving the application. it still takes up to 24-48 hours (for a RAL) once the IRS accepts the return.

However even with the extensive training, above the rest customer service, and a guarantee that we will be friendly professional and accurate there are still some consumers who remain confused about how these loans work.
this is the case here.

Bottom line is that we offer a 100% guarantee if not completely satisfied and this means that although there was no fault on our side, all papers signed all discolsures explained and all fees fully detailed, I have still offered this customer a complete refund which to date they have not come to collect. the customer appears not to understand that the bank collected their fees and that we did not receive the amount that was deducted from their refund check prior to dispersment.
I wish I could make every customer as thrilled with us as those who have written rave reviews. It is unfortune that I cannot please less than a handful out of my thousands of customers I had this year.
