My loan was sold to Litton Loan Company. They have managed over the past 6 years to raise my house payment from $294.99 to $424.00. Then I made the grave mistake of having surgery, and not being able to make my payments for two months. They then send a foreclosure notice, which they send or threaten anytime you miss a payment. They then refused to accept payments of any amount unless I could send the whole amount, including all of their "fees" "late charges" etc. So this time after refusing payments from Oct. to present they filed a Foreclosure Complaint. They now say I owe attorney's fees.. when I asked how much, they said they didn't know. They offered a Forebearance Note to be signed wherein I have to agree to pay $700.00 per month, which is over half of my monthly income! This would go for two years to include all of their and the attorney's fees.. again no amount for the "fees". So let's see... lose my $70,000 home or sign the Note.. decisions, decisions. So my plan.. pay a house payment and try to sell it as quickly as possible to get away from LITTON.

CONSURMERS SHOULD HAVE A RIGHT NOT TO HAVE THEIR MORTGAGE SOLD TO WHOMEVER. Our contract with with a certain loan company and that is where it should stay instead of being put in the hands of cold, calculating money gouchers like Litton Loan Services.
We should write to our Senators, attempt to get the mortgage laws changed and put Litton Loan Services out of business.

How exactly did Litton raise your payment? Was your mortgage an ARM?

It's not uncommon for a mortgage company to demand a full payment of the amount due to avoid foreclosure proceedings. Most mortgage notes have a provision that if you default they can demand the note due. Is it the right way to treat customers who have fallen on hard times? No, but that's how the business works.

As for mortgages being sold, that's common practice. I'd love to get into an in depth explanation of how the secondary market works but I don't think I can type that much :) I don't know what the rules were when you signed your mortgage but now lender's must disclose the percentage of loans they sell so you can make an informed choice.

If you are willing to send this exact complaint, as you have it here, to the Federal Trade Commission then you will help yourself and others who are dealing with these PIRATES. All you have to do is go to www.ftc.gov, click on "FILE A COMPLAINT" in the blue bar just under the picture of the FTC building and fill out the complaint form.

The FTC will only start an investigation against Litton Loan Servicing if they are able to establish a trend of Litton's negligent and fraudulent acts. If no one files a report, then they don't have any information to go on or know that there is a problem. This is a great site for complaining or venting, but if you want to DO SOMETHING, then you certainly have those avenues open to you.

Also, you should contact the Office of the Inspector General with HUD. They are also willing to help, but they need to hear from you first.
