I am a retired Reserve California Peace Officer with 13 years of service and the victim of a fraudulent LAPVB citation to the tune of $333. OUCH! Details below.

So, I am making a documentary film about the situation (thanks Michael Moore for showing us how it's done.)

Here is a copy of the complaint I filed with LAPVB and a copy of my affidavit statement of facts.

I also sent a letter with copies of these documents to my elected representatives : the President (as in W), CA Governor, CA Senators, Congressman Waxman, LA Mayor Hahn and LA Councilmember Weiss.

I'll let you know if Hear anything from them, AKA, their aides who actually read the letters.

Letter to LAPVB Supervisors:
RE: Immediate disciplinary action against City of Los Angeles LAPVB employee Alice Prier Ser#002613 for Intentional, Punitive and Fraudulent issuance of parking citation #94319728 and criminal destruction of evidence.


Dear LAPVB Supervisor,

I am addressing this letter to your office for immediate attention, investigation and disciplinary action against LAPVB employee Alice Prier. Given the gravity of her criminal offenses, a simple letter in her personnel file will not suffice. I am a retired California Peace Officer and state emphatically that the unethical use of Police Power is not only a despicable assault on the honor and integrity behind the badge but also an inexcusable violation of our sworn oath to uphold the laws and constitution of the State of California.

CASE HISTORY

1) On April 28, 2004 I received a delinquent notice from your office for citation #94319728 dated 4/14/04. The administrative review period expired the day I received it.

2) On April 28, 2004 I sent a letter USPS certified return receipt requesting a copy of the
original citation pursuant to CVC 40206.5 (a).

3) Instead of a copy of the citation as required by law, I received a computer generated response dated 5/4/04 stating that the period to contest the citation had past and payment was due in full.

4) I paid this citation in full including late fees and penalties totaling $333 under threat of collection action by your office.

CASE INVESTIGATION SUMMARY

I was born and raised in Los Angeles and served more than 13 years as a Reserve Sheriff Deputy the majority of which was with the Special Enforcement Detail. My investigation was thorough, professional and complete.

After I obtained a copy of citation #94319728, I then conducted an investigation of the citation location and my business log, credit card transactions and other sources for that day. I was shocked and dismayed by what I discovered.

A summary of my findings, as outlined in my affidavit statement of facts, are that LAPVB Employee Alice Prier issued this fraudulent citation as a personal and punitive measure against me and that I was in fact not then and never have parked in violation of section VC 22500I Bus Zone at 5429 Pico Blvd.

Furthermore, it is evident that Prier not only issued the fraudulent citation but that she then was forced to cover up the fraudulent citation by either disposing of or destroying the original citation - since it is rather difficult to place a fraudulent parking citation on a moving vehicle.

As outlined in my affidavit statement of facts I was not and never have parked this vehicle as cited and therefore never received parking citation #943197286 from LAPVB employee Alice Prier. The citation date is March 17th, 2004 1:39 PM location 5429 Pico Blvd. The amount of the citation, late fees and penalties totaled $333.

CONCLUSION

While serving as a Deputy Sheriff, I would have been immediately terminated for issuing a fraudulent citation for personal and punitive reasons.

I hereby formally request a copy be mailed to me for review of all proceedings, investigations and findings conducted by LAPVB against their employee Alice Prier based on my charges of her criminal activities while on duty.

Also, since LAPVB does not possess the legal or economic authority to remedy all the financial damages I incurred as a result of your employee's criminal activities I have submitted an administrative claim for damages with the City Clerk of Los Angeles.

Affidavit Statement Of Facts

I, (my name), am a retired Reserve Deputy Sheriff with 13 years of service and I am the registered owner of a 1987 white Ford F-250 California Lic# (######).

I never received citation #943197286 issued by LAPVB employee Alice Prier Ser#002613 Beat 201 Agency 51 dated March 17th, 2004 1:39 PM in violation of section VC 22500I Bus Zone located at 5429 Pico Blvd because I was not nor have I ever parked this vehicle at that location.

On March 17th at approximately 1:39 PM, I was Westbound on Pico Blvd at or near the 5400 block of Pico Blvd in the #2 lane at or under the speed limit in my F-250. Traffic conditions were light to moderate and driving conditions were sunny and dry.

As I entered a curve to the right in the road, I observed a white compact vehicle parked at an oblique angle on the curve. At that instant, an Adult Black Female stepped out into the narrowing #2 Westbound lane near the abnormally parked white compact right in front of my vehicle apparently with out looking for oncoming traffic.

There were no noticeable flashing lights or other caution indicators on the irregularly parked vehicle. My immediate reaction was to brake and I did so. Although a pedestrian vs. auto near miss, my vehicle did not strike the pedestrian.

During the near miss incident I observed the compact white vehicle as a LAPVB official vehicle and the uninjured Adult Black Female as a LAPVB uniformed employee. She then immediately stood in oncoming traffic in the #2 Westbound lane and was staring at my braking/slowed vehicle and clearly writing down my license plate number.

During my post-incident investigation I determined that the location of the incident was not an intersection and there is no cross walk or other pedestrian crossing. It was further determined that her official LAPVB vehicle was not just parked in a red zone but dangerously parked at the apex of a curve in the portion of a narrowing curve in the road.

Although I am not familiar with LAPVB standards and procedures I do know from my law enforcement training and experience that one does not have the authority to violate the vehicle code with impunity or in a negligent manner while performing police duties.

I wrote to LAPVB requesting a copy of the original citation and instead received a form letter stating my time to contest the citation had expired. I then received an additional collection action notice. I paid the amount in full and then began my investigation into this citation resulting in this affidavit statement of facts.

Hi Ken! Oh boy... sounds like you got one hell of a mess on your hands. Fact is, the PVB believes it is above the law, when in fact as we all know, THEY ARE NOT! The PVB is an operation riddled with FRAUD and SCANDALS. Of course you will never get them to admit this. Since you are a resident of the county as i am, i encourage you NOT to vote for James Hahn, as his letters will go unanswered, as they have to me in my case, and he is a strong supporter of this scheme (it's all about the money and not the citizens). Deaf ears you can call them all. Listen carefully to what Marylinn has to say. She helped me get out of my rut. Read my case, number 106786. You think you've got problems? Sit back, relax and take it easy. It took me 4 months to get my (actually the DMV)screw up taken care of. Again READ MY REPORT! It has good contact phone numbers in it. Dont let your blood pressure get up. These DONKEYS, as i call them, are not worth it. I strongly encourage you to skip the letter writing where not needed as i did, cause i will be in the state of shock if you get an answer... and immediately read my report 106786, call "Pat Cunningham" and she will help you. YOU ARE WASTING YOUR TIME WITH EVERYTHING AND EVERYONE ELSE for the most part. She can give you an extension etc etc etc. She can even drop your ticket right there. She is some power behind the window that most of the public will never see or knows about. YOU WILL NOT GET ANYTHING MORE THAN A SMILE FROM THE BLONDS BEHIND THE GLASS WINDOWS! Remember, you ARE NOT dealing with the PVB. You are dealing with a compnay that collects for the Scandal City of Los Angeles. on the other hand, since you have fallen victim to their scam (paid already), it may be much more harder to get your money back. STAY ON TOP OF THE DATES. To get to court is alot of work, but it may be worth it. If you are in the right... GO FIGHT WIN!
It is my belief that in order to get to court, you have to keep up with those dates. DONT FALL BEHIND! READ MY REPORT! It is lenghty, but full of good phone numbers and stuff. I had no intentions to give this monstorus city a dime of my hard earned money from their threats above and beyond the law when it was not my fault. I had more than enough evidence to prove it, and they still demanded me to pay. WHAT A JOKE IT WAS! I was fighting, Marylinn came in, i fought more, and won.... It was a nightmare for me to get the to admit their (the DMV) mistake. But i finally did. As you can see, i have not a dam good thing to say about this city. I have lived here all my life (39yrs+), pay my taxes, get invloved with my community, have volunteered for them for over 10 years, donated to them... and this is how they treated me. Like a dog on the street no one wanted. GO! FIGHT! WIN! READ MY REPORT! CALL PAT AND/OR MAX! Good luck.

Kenneth, by placing the word "parking" or the words "City of Los Angeles" in the SEARCH box above the scrolling reports, you can see that you're not alone with regard to fraudulent parking "tickets" claimed to have been issued to an owner's vehicle. There are countless unjust experiences reported by others involving City of Los Angeles parking enforcement and collections.

There is alos much information about actual California Vehicle Code laws pertaining to parking tickets in those other reports.

Besides the fraudulent "tickets" that are turned in to the PVB (which in fact is a private, for-profit company contracted for a price with the City of Los Angeles), a vehicle owners' problem is compounded by the fraudulent, threatening and unlawful letters mailed out by that private company, under "color of law" to vehicle owners. It's a gigantic racket that's been going on in LA for over 10 years.

The parking ticket "issuers" -- such as Alice Prier -- are employed and trained by the LA Dept. of Transportation (city employees), whereas the PVB, who composes and mails the fraudulent threatening letters to vehicle owners, is Affiliated Computer Services, Inc. d.b.a. L.D.C. Collection Systems. Contrary to what a person is led to believe, all those people who man PVB phones, operate computers, record actual or non-existent parking tickets, mail those demanding, outrageous and untimely letters, and man all of those LA parking ticket payment centers as the LA Parking Violations Bureau are employees of a private company....interested solely in profit for itself.

You might try a shortcut to get your money back. The City of Los Angeles Dept. of Transportation has employed at least 3 conscientious individuals to act as trouble-shooters and problem solvers to help people who've been screwed over by the system over fraudulent, bogus or unjust parking tickets. And when presented with the documented evidence of the problem(s), they have authorized abatements for those vehicle owners. Three of those trouble-shooters are Judith O'Connor at (212) 487-0281, Patricia Cunningham at (213) 485-4783 and Max Reyes at (213) 847-0522.

Other people, frustrated and angry over false parking ticket claims, did get their problems solved to their satisfaction by those 3 people. And because of your own detailed investigative work, I think there's a strong likelihood that any on of them will work on a solution to the injustice you related about (1) Alice Prier's dangerous and vindictive actions and (2) the untimely and/or unlawful letter(s) you rec'd demanding inflated payment.

I hope something works out for you.

No matter how it is done and by whom, an injustice is still an injustice. Kind of ironic that a black woman is screwing over a male. Kind of makes you think about how many black kids and others, LAPD screwed over, over the years. Just a thought. Tell it to the judge.
