Luis Carlos Skinfill Moran and wife Gabriela Moreno DeLara of Exodus Cymbals are involved in fraudulent behavior.  Carlos is in the United States from Mexico on a work visa as a pastor.  He does not have a church but uses God and religion thru the internet TV Worship Channel to prove to people he is a Christian and gain trust and receive donations.  The Skinfills have lived in Cancun, Mexico, then Florida, then up to Canada, then Phillips Ranch, California, and now Big Bear, California since late 2011.  

Carlos (and one time along with Ruben Silva) first befriend people to gain trust, then ask for a small loan for a short time at high interest to help with his and Gabi's new company, Exodus Cymbals.  They pay back the first small loans, then keep asking for larger amounts of money for "Big Cymbal Deals/Contracts", to be paid back after the cymbals are made in Turkey and shipped to America - between three to six months. 

The promissary note payments are never made and the excuses start. Customs is holding the shipment to examine it because Turkey is a communist country.  The bank is holding the check.  The IRS has put a freeze on his bank account until he gets a TIN. Meanwhile, Carlos drives a Mercedes, and Gabriela drives a Lexus.  Recently a Hummer was added.

After his taxes were done, Carlos boasted to me that he made "more than Obama -$700,000." He said that soon the IRS would release his bank account, and everyone would be paid.  NOT....

There are four of us in Big Bear that know each other and are owed over $300,000 total.  None of us has received a payment for over 6 months and for one of us, it has been a full year.  Together, we have gotten a lawyer because we do not want to see these people con any more people.  It is upsetting psychologically, financially, and like the report on 2-5-13 said, very time consuming.

 Notice the broken English in the post in any of his reports. Carlos Skinfill, a Mexican national has done much damage drummers and investors. He  has recently been outted on Facebook and Ripoff Report by numerous victims internationally and domestically. Just do a google and/or Facebook search of Carlos Skinfill and Exodus Cymbals.

How dare you try to make people think other than what was brought to light. You are a lying scum bag. You owe me money. Money I saved up and use to buy Exodus Cymbals. You ripped me off. And for that, I hope you get everything you deserve!

The Ripoff report above is filled with a series of falsities. 

 The Ripoff report appears to be a clear attempt to: 

 (1) Unlawfully harass Exodus Cymbals and its principals;

 (2) Ultimately destroy Exodus Cymbal's business and its reputation, as well as the reputations of Luis Carlos Skinfill Moran, Gabriela Moreno  and/or Ruben Silva based on a series of false statements; and therefore,

 (3) Engage in actionable libel.  See, e.g., Cal. Civ. Code § 45 ("Libel is a false and unprivileged publication by writing, printing, picture, effigy, or other fixed representation to the eye, which exposes any person to hatred, contempt, ridicule, or obloquy, or which causes him to be shunned or avoided, or which has a tendency to injure him in his occupation.").

The First Major Falsity:  The report attempts to characterize Exodus Cymbals and its principals as taking advantage of four unnamed people in Big Bear who loaned Exodus Cymbals money.  The truth is that the opposite circumstance has occurred.  Exodus and its principals are confident the four unnamed creditors who filed this report are the same individuals who are attempting to abuse Exodus Cymbals by coercing Exodus Cymbals, a startup company, into taking out loans with illegal (a.k.a. usurious) interest rates. 

In California, the legal rate of interest for a loan is statutorily mandated at 7% or 12% depending on the circumstances.  See, e.g., Cal. Civ. Code § 1916-1.  Yet these same individuals that have posted this Ripoff report are attempting to charge Exodus Cymbals rates such as a 240% annual rate on certain loans made to Exodus Cymbals.  In that regard, the $300,000 total quoted in the Ripoff report is totally false, and based on an illegal rate of interest. 

Because of this apparently illegal transaction, Exodus Cymbals has hired an attorney and is attempting to negotiate a good faith resolution to pay back the loans at a legal rate.  Thus far, the creditors have refused to negotiate and instead are using bad faith tactics – such as this false Ripoff report and gossip with personal friends and people in town – in an attempt to force Exodus Cymbals to pay an illegal (and clearly unconscionable) rate of interest.  Although Exodus Cymbals is and has been paying off its loans in good faith, it is not willing to pay an illegal rate of interest.

Other Major Falsities:  The Ripoff report is also false in the following respects, among others:

1.     The report is posted by "Guadalupe."  This appears to be a fake person.  Neither Exodus Cymbals, Luis Carlos       Skinfill Moran nor Gabriela Moreno have any dealings or business transactions with anyone named "Guadalupe." 

2.     The report states, "Carlos is in the United States from Mexico on a work visa as a pastor." 
        This is false. Carlos has no Visa  to work as a pastor.  

3.     The suggestion that Luis Carlos Skinfill Moran and/or Gabriela Moreno  seek donations through an internet ministry     is also false.

 4.     The suggestion that Exodus Cymbals, Luis Carlos Skinfill Moran and/or Gabriela Moreno  own or drive a Hummer is    also false.

 5.     Gabriela Moreno is Carlos' wife.  Ruben Silva is their friend.  Other than that, Gabriela and Ruben are not involved in the business transactions of Exodus Cymbals.  Hence, any statement or suggestion to the contrary is false.

 Bottom Line:  Exodus Cymbals is a reputable company, and its principals are good, well-educated people. 
Exodus should not have to have its business destroyed simply because it refuses to be bullied into paying an illegal rate of interest.  If you have also been (or suspect that you have been) the victim of these same creditors, please post a similar rebuttal to this report. 

Please support Exodus Cymbals and its principals.  In doing so, you will help to prevent four unnamed creditors from using bad faith tactics to accomplish unlawful goals.
