I tried to buy a home from Luv Homes in 1991 to put on my own property. I gave L.H. the deposit and they called and said that they could not deliver the mobile home to my property, so the whole thing was backed out...so I thought. It took months to get my deposit back and in the meantime, Vanderbuilt kept sending me late payment notices. I always responded with a phone call telling them that I did not get the home. It was never delivered. Yet, they kept arguing that the home was mine weather it was delivered or not. They were extremely rude.

Eventually I quit getting the late notices but found in 1994, when I tried to buy a car, that Vanderbuilt was still on my credit report, but the payments were being paid on time. I called again and thought it was taken care of. Now, in 2006, I decided to get a home equity loan. Well, there it was again, nearly paid off, luckily all payments were made on time but still in my name. Now, some poor person has one more payment to make and it is not even in their name. It is still in my name and I got the credit for all their payments. My guess is that the person that ended up buying the mobile home did not have good enough credit to qualify, so they just kept it in my name. I would like to sue Vanderbuilt or Luv Homes for this and find the rightful owner of the home. My next step now is to the Lawyers office.

vanderbilt victim

we also fell victim to vanderbilt they had luv homes make up info so they could sell us a home.

we bought our home through LH but started noticing a problem when the sales person changed 3 times
first we started with brenda then brenda had to go so we then got ginger well ginger had things to do as well so for the closing we delt with gary

well we were under the agreement that our closing would be recorded cool we had no problem with that

well were shown a peice of property out in westmoreland tenn

we liked the country setting so we ask about the schools and crime we were told by gary smith that our kids would go to westmoreland schools.
and there was no crime hardly at all

we agreed to move in and go for it
well needless to say we started having problems the first day LH was supposed to put in new kitchen flooring but they sent some used flooring so my wife called and stated that it wasnt acceptable and she was told thats what we get nothing can be done. so we bought flooring and put it down ourselves. about 3 weeks after move in we fuond out the roof leaked so again we called LH and was told we will send someone out asap so we waited and waited and waited a week later someone showed up to fix our roof,
well they proceeded to put black stuff around the sun roof but the guy that did it weighed about the same as me 260 to 290 so he made the roof leak in other places by getting up on our roof.

then we found out that our due date was changed so now every payment we had made was marked as late and yes there was a late charge added

we tried to contact VM(vanderbilt mortage)
but was told that the day is the same for all there accounts and it would continue.
so we ask for the recording that was made during closing and it has magically dissappeared
and vanderbilt says that they never heard of recording a closing to make this shorter we ended up filing chapter 13 so now we were forced into chapter 13 because of vanderbilt and luv homes we were charged extra money for things that we have no clue about so PLEASE if you can get any infomation about a class action suit ill be happy to join that band wagon because i agree that these companies should be held accountable for there actions

theres alot more to my story but i figured i would spare all you good people from the time consumtion lol

I did hear from the lawyer and he said I have to hire a civil lawyer in TN. Lawyers cannot practice out of state. I have e-mailed 3 in Sevier CO. so far and I have had no response. LOL! I may have to take a trip up there and just make an appointment with a lawyer in Sevier county. I have just had two shoulder surgeries and now I have broken my foot. This may take a while. I am hoping that once I get the cast on my foot, within the next week or so, I will be leaving for TN. I need to check on my property anyway. I want to make sure there are no squatters on my land. I mean, if someone can steal a persons idenity for a loan, who knows what else might be going on. Yikes!

I have contacted the BBB and the FTC. I have also called the Sheriff in Maryville and I am waiting for a call back to file a report against Vanderbilt. I have also called my cousin, a criminal lawyer in Orlando and he referred me to a civil lawyer. I am waiting for a call back from him now. It seems I have a civil suit against Vanderbilt. When I get the appointment, I will mention a class action suit and I will let you know about that. In the meantime, did you know that it will only cost you about $200 to file a suit? I don't think you have to pay it up front. If you win, Vanderbilt will have to pay all court costs and lawyers fees. I have been nice to these people for 14 years. They have no right to use my good name and social to get someone else a loan. I am finally going to fight back. I wish there was some way I could get you people my e-mail address so we can fight this together, privately.
