I currently have 3 accounts with M & T Bank. Until now, I haven't had any problems with them, however; this problem has ticked me off to no point.

My account had $25.34 in the account I made an $0.86 transaction to a local store which brought the account to $24.48. From there, I made a $4 deposit to cover a few incoming transactions. This brought my account up to $28.48. Today I woke up and checked my account to see that they charged me a $32 overdraft fee on the $0.86 transaction which brought my account to -$3.52. Thats when a transaction for $17.61 and $7.91 came through. Those were both given a $32 overdraft fee as well bringing my checking account to -$93.04.

I attempted to talk to the bank about this and they made up this whole story trying to take the blame off themselves when I have physical proof that this entire thing was and is a bank error. They refused to return the $96 they owe me.

Due to this, I am now forced to cancel my Labor Day BBQ as I won't have enough funds anymore to cover it all. Needless to say, I am very very upset over this and very embarrassed as I was forced to call everyone whom was coming and tell them of the change in plans.

Also, I now plan to leave the bank for another, file criminal charges, and start legal proceedings within small claims court of erie county.

You have THREE accounts and you made an EIGHTY SIX CENT transaction and you made a FOUR DOLLAR deposit to cover SEVERAL INCOMING TRANSACTIONS? WOW, we're talking major finance here. And you're worried about your Labor Day BBQ? What are you gonna do? Make another TWO DOLLAR deposit to cover your Labor Day BBQ? As for criminal charges, legal proceedings and small claims court, I'd be careful.

M & T Bank committed very much fraud on my accounts, so I agree 100% with you, and the rebuttals saying "are you kidding" are fraudulent people protecting fraudulent activity.

The balance in your checkbook was not $25.34 rom what you said - the balance in reality was -$0.18. So when you made an $0.86 withdrawl, you were already in the hole and incurred the NSF. Since the NSF issuance is based on what's in your account at end of day, 3 NSF's is correct and I checked the bank's math and it is correct with your balance at -$93.04. In reality, you didn't have the money for a Labor Day BBQ anyway - just have yourself a good time and remember checkbooks don't balance themselves.

The other thing I would keep in mind is that all banks essentially operate the same way and the policies that caused your overdraft are identical to just about every bank out there. Your problem isn't the bank - it's writing checks for money you do not have and what happened to you would repeat itself everywhere, in every bank, in every way. If you're planning to file small claims for this, save your money and time. What they did was legal and per the account agreement you signed.

Too many ROR's on this subject. (sigh)

is that when you initiated the $.86 transaction you were already overdrawn in your account (25.34 - 17.61 - 7.91 = -.18). You need to make the deposit before spending it.

And the bank is at fault because?????
