Mallory T&K Contracting Tom Mallory; Krystal Mallory; Marjorie Krystal Mallory Dishonest Company Had Neglegent Driver Destroy my Property and Is trying to Dodge responsability Griffin Georgia

When we purchased our home in July of 2013 the Home inspector advised us of a void in the yard where the dirt had washed away from the yard and began to work its way under the Driveway.  Since it was not to deep under the driveway, his suggestion, and that the best thing to do, is to wait till  the early spring before the Grass begins to grow, to Get some Dirt to fill in the hole, and to create a mound there, for the dirt to work its way under the driveway.

Since July of 2013 we have driven up and down the Driveway on a daily basis with no issues. As well as  our family had been able to SAFELY enjoy our new home as seen in the photos.

In the Beginning of March I began shopping around getting estimates and contacting different contractors in the area to see how much dirt I would need, and what would be the best and most cost effective way to get the void filled. After getting a few estimates, we came to the conclusion we needed to have a Truck load of dirt (18 cubic yards) to be delivered. And that would give us enough dirt to not only fill the void and create the mound as the home inspector had suggested, but also allow us to  fill in some areas in the yard that we noticed would puddle when it rains.  One of those Contracting Companies I had spoken with was Mr Tom Mallory of Mallory T&K Contracting.

On  March 24, 2014 I contracted Mr. Tom Mallory  of Mallory T&K Contracting Inc. to have a load of fill dirt to fill a void in the yard. I reminded him of our concerns once again that the void is dipping under the driveway and the reason for the need of the fill dirt was to avoid future concerns and issues of the driveway breaking. A verbal agreement was made to have a driver do the delivery at 8:00am on March 25^th 2014. He asked me to send him my Address over text message which I did.

On March 25^th 2014 I missed Toms call and returned his call a few minutes later. It was a quick conversation as he advised me the Driver is on his way.  I have attached photos are of the Phone Number I called which is listed on the “Contact us” page of Mallory T&K Contracting Website as Mr Tom Mallorys Cell phone number.  ­

As a reference, Tom Mallory is listed on the Georgia Secretary of state as the CFO for Mallory T&K Contracting Inc, As well as the Email for Tom  on Mallory T&K Contracting website is also the same email as listed on the Georgia Secretary of state website as the Company Email. These Photos of the Driveway  where taken on March 6^th 2014  when  I started shopping Contractors to do the job, and prior to contracting Tom Mallory of Mallory T&K Contracting Inc. when I was shopping around for contractors to show where the void in the yard is, and where I needed the dirt delivered (notice Driveway is not broken.)

On March 25^th the Driver who was to deliver the dirt  was advised of the same concerns I told Mr Tom Mallory,  and told we must avoid the driveway. I showed him where the dirt had washed away from under the driveway  I advised him the best thing to do is to bring the truck up on onto the grass from the street to dump the dirt.  I asked him to give me a minute to run upstairs and get a sweater as it was cold. As I went upstairs the Driver of Mallory T&K Contracting Inc had started to reverse over the Driveway and Broke the Driveway.  I witnessed the Driver commit the error  and watched him  as he came out and assess the damage. I ran to get my phone and start documenting the incident as he was walking back to the truck.

I advised the driver to call his boss (Mr. Tom Mallory  of Mallory T&K Contracting Inc.) to see what we can do to correct the issue. The driver called Tom (registered on the drivers phone as Tom Mallory) At that Point they exchanged a few words and the Driver handed me the phone.  When the driver handed me the phone  Tom apparently thought the situation was extremely funny and began to laugh. I advised him it was not  funny. His concern was  to ask if the Dirt had been dumped. I advised the dirt had not been dumped at that point. Tom asked me to pass the phone back to the Driver. At that Point the Driver told me he was advised by . Tom Mallory  of Mallory T&K Contracting Inc  to leave the scene.  the Driver proceeded to Take off. Knowing well they are in the wrong. They did not deliver the dirt  as was contracted to be delivered, and left leaving damage to the property.

I immediately filed a Police report  with officer B. Hergesell Case # 14-03-000489 with Palmetto Police. The officer called the office of Mallory T&K Contracting, and spoke with Krystal Mallory who said she will come out and assess the damage to take care of it.  I tried to call Krystal Mallory later on in the afternoon to find out when they will be coming out to assess the damage. Krystal said she is investigating and that Tom Mallory is a “Contractor” and I have to deal with him, (and Tom Mallory at this point had stopped answering my calls) Then  I called Krystal Mallory  again who at this point began to denied having  any order for anybody to be at my home.

I proceeded to call Tom, as well as contacted the Office number for Mallory T&K Contracting Inc. and spoke with Krystal Mallory, to give them the opportunity to correct  the issue without having to go through a civil court process. Tom tried to claim at that point that the driveway was already broken. After all the times I told him the entire reason we were buying the dirt was to avoid the driveway from breaking.

I Included very detailed Photos and Description of everything above because at this point I was getting nothing but lies from Both Tom Mallory, and Krystal Mallory. Everything from “it was already broken” to “we didn’t even have anybody there”

For example: Krystal Mallory told me that Tom Mallory has nothing to do with  the company. And he is  a “contractor” not involved with the company. I found this to be a dishonest and an extremely deceptive tactic to get out of the responsibility caused by Company Negligence. Through some very simple research I found that  Mr. Tom Mallory  is not only  listed as a Company Contact on the company website but he is also listed as the CFO of Mallory T&K Contracting in the Georgia Secretary of state website. Further more;  Mr. Tom Mallory’s Email address (as Listed on their Company Website) is the Contact Email listed on the Georgia Secretary of State Website for the corporation.

Krystal also told me that there was no record of there even being an order to have a delivery done to my home, which is also a Fallacy (as you can see in the photos and evidence presented.) As with Many more False statements made by both Tom and Krystal Mallory

 At that point I no longer wish to give Mallory T&K Contracting the opportunity to do any further damage to my property or wish to hear any more of their dishonest  fabrications. I decided the only way to have this issue resolved was through the Civil process. 

 I will be contracting a different company to Repair the damages they have already caused.

I would hate to think this is how the CFO handles the financial obligations of a business for 10 years.

My concern now is for many other folks who have potentially fallen victim to their deceptive practices, as well as any future clients who are not aware of their lack of concern, Lack of professionalism, and lack of ethical character.
