I bought a Multi-Function printer/fax from Mr Kerans on Ebay. The item was described in one place as "New, Never Opened", and, in another place as "New: Opened Box".

I paid $150 for the unit including shipping. I could have bought the same unit on Amazon for $187 including shipping at the time. Amazon's price is now $199 including shipping. The delivery of the printer was delayed by UPS error through no fault of Mr. Kerans, but, at this point, I was badly in need of the printer and attempted to set it up.

When I received the printer and opened the container, I first noticed that the printer cartridge had been used and resealed in the plastic bag. The usual pull-strips were absent and there was toner all over the cartridge. I also noticed that some of the parts had apparently been opened and resealed in the plastic envelopes. Additionally, the advertised CD software and manual were absent.

I printed out a test report and discovered that the printer/fax had been used as early as October, 2008, or, approximately ten months prior to my purchase. There were several personal and business-related faxes that were either sent by or received by Mr. Kerans' still stored in the printer's memory and a page count of over 150.

Since I was unsuccessful in installing the printer, I contacted Hewlett-Packard for assistance and was informed that the printer's USB port was defective.

When I informed Mr Kerans of my findings, I received rude, unprofessional, and accusatory insults too numerous and ridiculous to mention. Ultimately, he admitted that the printer had been USED as a demo/floor model but continues to assert that the printer is "new" despite clear evidence to the contrary.

I offered to accept a partial refund from Mr Kerans, but retracted it following his repeated insults and accusations as well as my discovery that the printer is defective according to the manufacturer.

I have filed a complaint with Ebay and PayPal and am awaiting resolution. Regardless of their decisions, however, I would avoid doing business with Mr Kerans and Wholesale Server Components or any other entity with which he is affiliated.

Mr Kerans has offered to accept the return of the printer, but refuses to reimburse me for shipping ($70) despite his fraudulent advertising and attempted deception.

In the face of overwhelming evidence to the contrary, Kerans still maintains his delusions. 

All the more reason not to do business with him.

Sir, please feel free to spend 2K on arbitration if you foolishly believe your own BS.

Better yet - join a 12-step program that deals with your maladies or see a shrink.

If you honestly believe your own BS, either sue me or take advantage of Ripoff Report's arbitration service.

Of course, I rather doubt that even you believe your own BS to the extent that you're willing to gamble $2K for the process.  If you dont, however, it will be abundantly clear who the scoundrel is.

A simple "I'm sorry. I was wrong. Please forgive me." would be adequate.

I've been expecting you to follow through with your adolescent-bully threats to sue me for 3.5 years.  I dont know what the statute of limitations is, but go ahead and do it if you can afford to lose the counter suit.  I've used the same words because neither the facts, nor you apparently, have matured.

"Anonymous", I have fully explained the transaction and the real issue behind your absurd claims. Haven't you over used the word "adolescent". On your reply tonday, I noticed all of the other comments you made four years ago and I was in disbelief.

My legal position to you was made clear at the time as you made numerous false claims using my company name and reputation that were in fact grounds for a legal claim. In fact, here is a screen shot of the auction:

So let me get this straight Ernest E****, you bought my new open box AIO for less than half the price of a new AIO ($113.00) since new they were between $199 and $249 and when you received the unit you claimed there were multiple numbers on the fax list and as a result you sent me an email demand that you pay only $50 for this printer? This about right Ernest E****? You also claimed an inoperable USB port and we assured you that when it left here, everything worked. Could it be that you knew HP would replace the unit under warranty and that you would get a factory new AIO for $113? It's really hard to cause a USB port to fail. It is amazing how everything fell in to place for you on this AIO (except of course the $50 buy demand you made). And if it didn't, rest assured that with a 100% customer satisfaction rating at eBay, we would have gladly taken the unit back.

It's both sad and amazing that this guy, three-and-a-half years later, still cant accept the fact that he was wrong, as decided by Ebay, PayPal, and HP.  Oh well - hope he doesnt have a dog to kick.

Buyer Wanted My AIO for Half The reduced Selling Price!

Our HP Multifunction printer was a floor model that was never sold and only on display. eBay didn't have an option that described my item accurately and therefore, I selected the new option. However, In bold letters I added the title as New Open Box as that was exactly what it was. When this lunatic received the unit, he said he saw a phone number in the printers memory and therefore it was used and demanded a 50% refunded (from our reduced selling price!). We refused and instead gave him an RMA to return the product and he would be refunded in full excluding shipping. Instead he filed a claim with eBay and then called HP. Since the unit was still under warranty, he further claimed to HP that the unit didn't work and he received a brand new unit from HP directly. We made every attempt to fully describe the condition throughout the listing but we believe this buyer had an agenda to scam us. The buyer had no answer to the question "did you read the auction description and did you see a descrepency that warranted at least one question BEFORE your bid?". This buyer didn't want to return the unit to us once HP decided they would ship a new printer and, because we weren't willing to sell our new open box printer for half the selling price, he chose to portray our business and transaction in a slanderous way. Our attorney recommended we file a lawsuit against the buyer and I chose not to waste anymore time or money on this issue. If you buy or sell products from this person, expect problems.

Mark Kerans Found Wrong by PayPal & Hewlett-Packard

Since Mr Kerans was unwilling to compromise and continued with adolescent threats and insults, I filed a dispute with PayPal regarding the transaction.

PayPal agreed with my position and granted my request for a full refund including return shipping charges.

Once again, however, Mr Kerans resumed his insane rant, insisting that the product is "New" despite the fact that the printer's memory contains personal and business records that were sent or received to/by him as early as October of '08.

Fortunately, Hewlett-Packard was willing to replace the printer under warranty for a nominal shipping fee after determining that the USB port was indeed non-functional.

Because I was able to reach a resolution through HP, I canceled the dispute I filed with PayPal and Mr Kerans will nevertheless receive all of his ill-gotten money.

Mr. Kerans has continued to insult me with adolescent language and promises that he is going to sue me for libel and slander even though he doesnt understand the difference.

Even though PayPal agreed that Mr Kerans misrepresented the printer and has granted me a full refund including return shipping charges, Mr Kerans continues to send insults and threats to me via email.

Hewlett-Packard Tech Support also agreed that the unit was defective.

A search of his name on this site will reveal that he has been associated with computer related ventures of dubious integrity as far back as 2002.

Mr Kerans behaviour is like that of an adolescent, but since he is presumably an adult, it is my opinion that he is not only dishonest, but may also be dangerous.
