I received a letter today (7/13/05) from MCGC. They have stated they are representing LVNV FUNDING LLC who has purchased my default account from AT&T Broadband LLC. The letter further explains:

I have been offered a settlement of 50% paid in full; or
3 equal payments totaling 70% of the balance; or
Monthly payments in amounts I "can afford".

I called the toll free number provided on the letter and reached a representative who claimed this "Oh, this is a simple one". He read off to me the (correct) last 4 digit of my SSN and advised me this was a bill from AT&T Broadband, a cable provider, from 1994! He gave me a street address of a previous residence but had no actual apt. number. AND I didn't live there in 1994. It was, in fact, a couple years later.

I am going to write to MCGC, with return receipt, and deny this debt. I will also send a copy of all of the above to each of the 3 credit reporting agencies. Unless MCGC can provide proof that such a debt exists I hope this will prevent it from ruining my hard earned good credit.

Statute of Limitations Surely Applies

If you incurred the debt in 1994, and there has been attempt to recover the debt since that time, then it appears that the Statute of Limitations applies. It looks like a collection agency purchased the debt and is attempting to collect the expired debt.

I would ignore the debt as aged and no longer applicable, never agree that you owed the debt and noever agree to make payment, or you will restart the Statute of Limitations over.

You are under no obligation to pay a debt that old, expecially if you are unaware of the product or service provided.

Make sure that the next time they contact you that you tell that you will not accept that you owe a debt that old, and also tell them not to call you again on this matter. Document the time and date when you tell them that.
