This collection agency called to collect on a debt that was not mine, charged to a credit card that was stolen in 1989, from the post office, before it ever reached my possession. I was contacted by the bank at that time, California Federal, who told me of the theft and said they were investigating the theft of several credit cards mailed at the same time. They furnished me with an affidavit and asked that I return it if I should get a statement with any charges that were not mine. That happened and I followed their instructions. Charges were eliminated from my account and I was told that everything was resolved. Cal Fed subsequently sold the stolen account in a block of "uncollectable" accounts to Household Bank and several collection agencies kept purchasing the same stolen account. , Those stolen credit card accounts, one of which was mine, have been bounced from bank to bank and collection agency to collection agency and every time I think it's resolved, I discover that it's not and now it has adversely affected my credit rating. How can they report a "bad" debt on your credit that is not your debt and that is over 18 years old?? I am getting tired of having collection agencies 'resolve' the matter, only to keep making it worse. This assanine, ongoing battle is causing me extreme stress and financial problems!

However, one day you are asking for advice, which you take, then...............

4 days later, you are an expert in the field, giving "advice". BUT, the advice you give like to contact the original creditor on a debt that has been sold, or to give your SS#, etc..is just foolishness. It is dangerous.

My advice is strictly in line with the advice given by the FTC and the laws that attempt to protect us [FCRA & FDCPA]. My advice is also directly in line with the #1 consumer advocate of collections and credit in the United States.
[I hope the editor lets this in as I feel it is REALLY nessessary here to make this point]. His name is Bud Hibbs who has a national radio show and has 30 years of experience in this field, all documented.

My advice is exactly in line with the advice he gives.

And the states of experience mean nothing as the majority of collections laws are Federal. With the exception of SOL and garnishments.

Recently, I got a lawsuit against me dismissed that was filed by Love, Beal & Nixon. I stopped Fred Hanna & Associates in only 9 days from the time they got my file until it was closed, and have file a BAR ASSOC complaint on him. I shut down NCO, LVNV, CACH, West Asset, and several others on FIRST contact. I got a letter from AMEX stating that they have ceased all collections efforts.

And I walked away from 170k in debt 3.5 years ago, and no one has been able to collect a penny. And the only reason I even came out in the open at this point is because they were harrassing my elderly mother and grandmother and I had to step up to stop it. That is the only reason they ever got a chance to get near me.

My facts speak for themselves, and I am LITERATE.
I can spell, punctuate and form a sentence, and can get my point heard without using all CAPS.

I spent several years in the financial industry as a mortgage broker and a financial planner. I fully recovered from a bankruptcy in 1986 in less than 3 years and had new credit, and even got it off 2 credit bureaus after 4 years.

I have assets and plenty of cash, and these fools have not been able to get a penny of it. Why is that?

Think about it.

Okay, so you have gotten alot of law suits against you dismissed, in what court and state. What is the name of the companies you fought in court? and can I validate that I just need to know........ since you have so much to contibute
being that you have had 20 years experience.

Words are but common falor, what is to be true is verified...... and what is in statement& bost only can only be valued by the measure of what is written in the script of all that is seen and said....

I am not forcing my opinion on anyone. I am sharing what works, and what is practiced by dozens of consumer advocates, and hundreds of lawyers. It is NOT my opinion. It is just the way it is, and the way it needs to be done.

I have been at this for over 20 years, and have successfully gotten lawsuits against me dismissed, and have gotten the phone to stop ringing and have virtually stopped all collections activities against both myself and my Mother almost immediately.

So, these methods work, and I did not make them up. I am just passing them along. But I am passing them along CORRECTLY.

Also, spelling and grammar go a long way in credibility.

Karen! You have it all wrong! FTC violations are worth $1000 each, NOT $1500.

First of all, the FTC violations are worth $1000 each, NOT $1500. [Even in CA]!

Second, You NEVER contact the original creditor, and you NEVER supply personal info like SS#. This is a scavenger debt buyer. They may not have some of the info they need to act on this old debt, so WHY give it to them? Directly or indirectly.

You obviously need to actually read the FDCPA and the FCRA.

The first letter you send to one of these 3rd party "collectors" is a debt validation request. Simply dispute the debt and ask for something you allegedly signed.

The second letter is the Cease Communication request.

I can relate to your situation , because the very same company tried to collect money on an 20 year old bankruptcy debt, reported the debt to on my credit file and made themselves a nusance. I then had to show them how far I was willing togo to vindicate myself. So I have some information for your!!!!!!!!!!

Frist you must Contact The Original Creditor (s)and request information on the said debt in question, contact the original creditor (via) certified mail and ask quested information as to:
( Do not contact the Collection Company, but the company they have stated to be collecting on behalf of)>>>>>> ASK IN WRITING ....
NOTE:(PLEASE REQUEST ALL CORRESPONDANCE TO BE ON LETTERHEAD!!!!)

1. What is the current status of this debt as listed? ( Use the debt account number as reference listed in correspondance from the debt collector Merchants Credit Guide Co.).

2. Request information as to their records (original) the last activity of the account ( when it was opened,

3.when it was closed and if possiable when and how was the account as to their knowledge the account was placed for collection.

4. Ask for conformation as to what is the over all complete status of the account as to date.

Reference when writing the original creditor your previous address at that time , as well as your SSN#.

The company should validate your position that is is an deed an time barred debt ( 18 years) old. The statue of limitations on a open debt collection is 5 years, so the collection company is in violation.After receiving response from the orginal creditor, send that letter to the credit breau's requesting to have the accounts deleted.

Also you might consider after receiving information from the original creditor , filling a law suite for violation of the fair credit reporting act ,you can receive $ 1500.00 for each fraudulent entry on your credit by this company. Also you might consider reveiwing the FDCPA Laws, the company is in direct violation of those laws.

Send the letter from the original creditor if it answers all , to the credit breau's requesting to have the accounts deleted, Also put a fraud alert on your credit file.

Also report the fraud to the State of Illions Attroney General's Office,and a copy to the State your reside in Attorney Genrals Office, send a copy of the letter from the original creditor to validate your fraud(certified mail).
Send all correspondance from the collection company as well as letters received from the original creditor, this will help you prove resonable doubt of consumer fraud.

Also, contact CBS 2 News in Chicago Illions,via email: and inform them of the fraud that this company is doing in their fair city ( email their invesigators and news persons (Elein Barry), I e - mailed her and she will respond to you. Also Contact the Chicago Sun Times, EDITOR AND INVESTIGATORS TO INFORM OF FRAUD.

Also contact the news in your area and ask for an consumer advocator and or investigator ....
contact the news stations and papers in your area.

You are entitled to damages!

This is obviously a time barred debt even if you did owe it! The FTC needs to get a complaint on each violation of your rights under federal law.

The FDCPA and the FCRA can be read at the FTC website and on budhibbs.com .

You are entitled to damages. Sue them in Federal Court.
