Meritahe Home Complaint Against Meritage Homes Raleigh North Carolina

My house located Lot 4 in Braxton Raleigh NC , it was custom made the house. I signed the contact with standard driveway without driveway design diagram and the sale - told me that the driveway is exactly same as the model room they showed to me, ( model room address: 5512 Overdale Lane )and no option to upgrade. The house closed on Dec 2014, however the driveway was built totally different from the model room, The builder, in order to cut cost, made the driveway very narrow and easily fall into the ditch when back up the car.

We are no issues If the driveway is safety, even it is totally different from the model room which promised by the sales. Before I move into this house, I didn’t realized how dangerous at my driveway with a ditch until we live here, the builder manager- Dan. Peebles, knew the issue’s serous, he examined the driveway and helped to fix my left side drive way by added brick to block car fallen in the ditch,  however the right side my drive way was still open in danger,   we had three serious car accident at my driveway, one time the car was fallen in the ditch,  two times  the car stuck between the ditch and driveway , it took the wrecker company 2 hours to bring it back, right now . The common law states that the building work had to be carried out safety using reasonable skill and care. Further, the Supply of Goods and Services Act 1982 states that any goods supplied as part of the contract and any materials used must be of satisfactory quality and safety.

We opened the warranty request 7/31, and asked the builder – Meritage Home  to fix   it to add some block , like they did in the left side of driveway . Their customer care manager – Wilson stopped by, but he refused to fix this issue, he stated that the house has been closed, and the driveway passed the building code. Nothing he can do it.

I consulted the building cod information from the Department of Insurance NC– Building and code department by phone and  email described  my situation to them, I was told , no building code for the driveway , if the accident happened due to design by builder, the builder has full  responsibility to fix it.

I tried to escalate the issue to Meritage director via email a few times, no response back, We everyday suffered  fear  to scare to fall in the ditch every day. I request to fix this dangerous drive way ASAP to prevent any accident happened to my family.
