Merits Health Products, Inc Elderly man's Lemon Scooter on 4th failing motor trans-axle assembly under warranty. Company will not refund or replace. Cape Coral Florida
I am a durable medical equipment provider. My client, an 81 year old man, purchased a scooter from Merits Health products through me, a dealer for that company. He got the scooter in Nov. of 2011. 10 mos later, the motor trans-axle assembly failed. It was replaced under warranty.
6 weeks later, that part failed, and another one was sent out under warranty. Within 6 weeks, the 3rd assembly failed, and a 4th was sent out. I was informed by my client 2 weeks ago (approx 4 weeks after the last installation) that the part is failing again.
We have also had to replace the batteries 3 times, as the faulty part drained them. We have received no compensation for the batteries from Merits.
My client and I both feel strongly that the scooter is an obvious lemon, and we want either a refund or a new scooter. Merits is refusing to do either, and wants to send out a 5th moter trans-axle assembly. My client lives 2 hrs away; every time there is a failure, he loses weeks at a time in use of his scooter.
The company's lack of care or concern about the faultiness of the product and how this has negativly impacted and elderly client and their dealer is reprehensable.
