Mesa Distibutors, Inc. d/b/a Ramann Enterprises, Inc.; sold my company a Used Direct to Garment Printer that was supposed to be new at the time of purchase by Koutoure. The Printer was Refurbished and Repurposed but, Mesa did not disclose these facts before my purchase in the contract.The Printer came with Used Software, a Used Platern, missing and mismatched nuts and screws and scrathes on the chasis.

I made many documented attempts to Mesa to get them to replace the Used Printer they sold Koutoure with a New Printer. Mesa did not replace the Printer because, they hid behind the Arbitration Clause in the contract that required me to leave Nashville,TN to attend an Arbitration Hearing in Fort Worth, TX that was held on May 6, 2015 at Mesa's Attorney's office. Needless to say Mesa was Awarded and I was not compensated for Koutoure's Losses. Out of 18,075 Arbitrations handled by the National Arbitration Forum (NAF), consumers only won 30 (0.2%). 

Koutoure submitted evidence of Machine Breakdowns and Requests for a New Printer in tape recorded conversations with Mesa's service technicians, service department and General Manager that were not allowed at the Arbitration Hearing.        

Koutoure also submitted over 150 emails of evidence that support Koutoure's claim that the Printer was used including emails from the Manufacturer of the Printer stating that the Printer was over 7 to 8 years old at the time Koutoure purchased it. These researched and documented facts prove that Mesa sold Koutoure a Used Printer knowingly and did not disclose it.

The only evidence that Mesa submitted at the May 6, 2015 Hearing was that Koutoure signed a contract with an Arbitrtion Clause.

 Mesa's resonsibilties that they did not meet: 

(A) Sell Koutoure a New Printer.

(B) Disclose the Arbitration Clause

(C) Disclose that the Printer was Refurbished and Rerpurposed.

(D) Properly Train the Consumer

(E) Provide the Customer with a Maintenance Manual.

Because, Mesa chose not to do the above things the Printer was non-functionalble for 2 1/2 years. This eventually caused my store to close and pushed me into Bankruptcy. 

Mesa sold me a Used Printer for over $17,000.00, when in fact they sell my model Used for less than $9,000.00.
