I had a n experience similar to that of Stephanie, I had a wreck in January and found a car that I liked on the internet at a dealership when I contacted the dealership they informed me that they had a credit union to do their financing for them they faxed me a credit app and I filled it out and faxed it back. Shortly thereafter I received a call from a lady by the name of Tracy she was calling me with the good news that I had been approved for this car loan and that we needed to talk about payments I told her where I wanted my payments and she told me that I was approved for 1000.00 down but that would have made my payments higher than I wanted so I offered 3000.00 to have lower payments, she told me to go make sure I want the car and call her and we would set up an appointment to go over all the paper work and sign the contracts. I went and looked at the car and loved it I had not received my insurance check yet so they told me if I gave them 500.00 cash I could write a check for the other 2500.00 but they would not run the check because they only accepted cash for down payments but that I could go ahead and leave with the car. So I did.

The first sign there was something wrong is 3 days later they ran the check, I did not have the money in that account. I called very upset they swore it was an accident and that they would take care of it. blah blah blah...

next thing I still have not received the promised contract or metal tags... call the dealer, dealer says can not give me metal tags because my car has not been funded yet says metro told him there was a problem with my down payment check... they had picked the rest of the down payment cash up weeks prior so I call the finance people who tell me that they apologize I am getting the run around from Lucky Star Autos and that Lucky Star will be getting their funds within the day, and that they will fax me a temporary tag I get the temp tag it has a different VIN number and a different dealers name on the bottom. Strange right?????

a few days later I get a call from the dealer we need to borrow your car since we haven't been funded for it yet our bank wants to see it I will come get it and bring it back to you in a few hours. UHHHH NO you cant leave in my car.

few hours later I get a call from the business partner ok here's the deal these people are crooks they dont exist they are giving false information and we have 7 cars out and have not been funded for any of them, our lawyers told us to say whatever to get our cars back and if you don't give it back we will repossess it. Your car was never white-slipped your deal never funded so it is legally our car, ok.... called AG who says that is correct but they have to return your down payment...called Lucky Star I gave my down payment to Metro so Lucky Star owes me nothing... they tell me they have the police involved and attorneys blah blah blah

I call Metro what are you going to do they tell me that the Lucky Star people bought their cars on a floor plan loan and that it only gives them 90 days to sell them or they start getting charged interest on a daily basis and that my car was part of the collateral for a group of 10 cars on one loan and that their bank called the loan due so they do not possess a clear title so therefore metro can not fund my loan they asked me if I wanted my down payment back which would take 3 weeks or if I wanted to just find a new car and change the contract. I asked for a chance to check some stuff out first he offered me the name of a few dealerships they did business with and stated that he would provide letters of credit to whoever I chose to buy a car from.

I contacted a dealership I was familiar with asked them to check them out and asked if what he said about Lucky Star could be true. They said yes and they contacted Metro and got letters of credit from their bank Metro sent over a letter of draft and I left with car number 2.

about a month into this car I still have no tags call the dealer and they tell me they are having second thoughts about metro and ask if I can find a new lender...apparently there is a company based out of Michigan named Metropolitan Finance it just isn't this one...call metro they promise funding tomorrow for about 2 weeks finally go to local credit union and get funding for vehicle...metro promises down payment everyday for 2 weeks getting kind of old right... it gets worse

I am a manger at my place of employment get a call from a lady asking to verify employment tell her I am the manager would love to verify employment who is it for...she says it is for Michelle Terrell....that is me why are you verifying my employment? For your new car????? What new car? The Passat you are interested in at Heman Motor in Gatesville...never wanted a passat bought an expedition total different ends of the spectrum funny thing though Heman motors is the name of the dealer on the tag I received. Weird huh????

So is my info floating around around out there are people driving cars in my name was it my SSN on Stephanie's paperwork??????

Now no one returns my phone calls I would love to get a group together I have spoke with the OCCC who says they are aware of what is happening but I am the only one who has filled out a complaint form I know that I can not leave personal info on this site but there is a dealership in Weatherford called D and D motors they are trying to get these guys put away contact them if you are a victim and we can all get together and maybe get our monies back.

I just wanted to make sure that nothing was misunderstood in my former post My dealings with Lucky Star were not bad Lucky star sold me a beautiful low mileage vehicle for a very fair price. The men who own Lucky Star met me on a day they were closed, to work with my schedule, they provided me with a car fax report as well as service history. I enjoyed doing business with them as a dealership. They encouraged me to take it to a mechanic of my choice as well as offered me an extended warranty. They provided a full detail including touch up paint on a few rock chips. When originally I began contacting attorneys to get my money back I did not know the laws I was looking to file a suit against Metropolitan Finance which I still am. I am pursuing both criminal and civil cases against Metropolitan Finance but each attorney and state office I speak too says that the dealership is responsible for getting that down payment to me when they get their vehicle back. I did not know the laws at the time. The laws are written for the consumer. After learning where responsibility lies I contacted Lucky Star and Steve one of the owners immediately contacted me back and he seems to be working with me to get my down payment back. He is a victim here also. Lucky Star has found other lenders for their company and they sell a quality car at a good price. I would definitely buy a car from them again and recommend people to them. My experience with the vehicle and the customer service was wonderful. I have also been in contact with a few other dealers who have been conned by these guys D and D as well D and D motors have also had to return down payments they never received from metro to some of their customers. After speaking with Steve at Lucky Star I believe that they are going do the right thing.
