The information provided in this report below is based on comments made by Michael Kergosien during an onsite inspection held by a third party verification company with no biases towards Michael Kergosien / American Home Free Mortgage.

Michael Kerogosien is a loan officer dedicated to providing interested consumers with the loans they need to obtain their dream homes. He offers a variety of services including financing homes, obtaining loans, refinancing, and purchasing of homes. Mr. Kergosien stated the following about his business model, "we try to stay local. Most of our business is in the local community...we want to grow and we continually want to progress in the area of growth. Our goal is to have as many realtor relationships as we can, reach out to consumers, and serve consumers in the area." Michael Kerogosien obtains leads through several different avenues including referrals from real estate agents, title companies, and consumers. He went on to state, "I would say most of the business we get are from consumers we've helped in the past."

Mr. Kergosien then explained the typical sales process for a consumer working directly with him. The consumer would first need to fill out an application, and they would need to have their credit qualified. Once they have gone through the pre-qualification process the consumer will receive a loan package that describes their particular loan in detail. From that point, "borrower would receive updates on a weekly basis until the load is closed out."

CUSTOMER CARE & COMPLAINT RESOLUTION – MICHAEL KERGOSIEN / AMERICAN HOME FREE MORTGAGE

During the onsite interview Mr. Kergosien was asked to describe a situation where a client was not satisfied with the level of service they received. Mr. Kergosien expressed that sometimes during the midway process of obtaining a loan they may encounter elements that would affect their loan status. These situations would include losing a job or purchasing a car. Additionally, borrowers sometimes feel the process of obtaining a loan is taking too long. In order to combat this Mr. Kergosien makes sure to effectively communicate with his clients, "when given the opportunity...I would explain to the consumer the reasoning behind the extra time it's taking...9 times out of 10 if I explain the situation a little better they have a better understanding."

When asked to comment on complaints posted on Ripoff Report's website Mr. Kergosien stated that all comments placed on the website are false, and potentially filed by an ex-employee. In order to further assure future and current clients Mr. Kergosien is licensed through the state of Texas, and is audited every year. If a consumer files a complaint with his services it is handled through the state. Additionally he stated, "I've always had a good rating with the Better Business Bureau, and I'm approved with HUD."

When asked what type of changes he has made to honor his commitment to make things right with the consumer per the request of Ripoff Report, Mr. Kerogosien stated, "I now try to emphasize the closing costs. We got taken by this company for over $25000.00, i think they work in cunjunction with mobile home dealers. We have a mortgage with this company, we hold a mortgage on one house, but own another one. We were told we stilll had to pay even though this house is not ours. They frauded our papers for the above stated amount as far as my attorney can tell. We have an escrow, and they don't even pay taxes as promised in the papers. We have called them on several occasions to get our house we are paying for, or a refund of the money they overcharges us--they finally blocked my home phone number as well as my cell number. We goth through on the neighbors phone,and they hung up on us. Six months have gone by and we have no payment book, the paperwork was all whited out, not even as good as a 1st grader could do. Our home is falling apart,we have called them,sent them letters,told them the contract is fraudulent-nobody has called back. I wonder what would happen if we stopped paying? We don't even own this house--how could they foreclose on a fraudulent mortgage? Eric Hazen, Arkansas

Inaccurate information

We originated and funded an FHA loan for Eric and his spouse.  The home is insured by FHA.  I am now attempting to contact these people, but am unable to reach them.  I am not aware of this incident and have never been contacted on this matter; however, this sounds like paperwork and conditions involving the builder (mobile home dealer) since all we did was provide a mortgage as an FHA lender.  Our mortgage was signed for in the presence of a title attorney.  The final inspection of the property was done by an FHA inspector.

I'm sorry for the issue involving this borrower, and agree that if what he says is true, there needs to be further investigation, but as I said, I know nothing about this and we provide home loans only.  We are not involved or responsible in any way in matters relating to a home's condition or contractual disputes between a builder and their buyers.

You will not be foreclosed on if you don't own a home. I'm surprised to hear that you were hung-up on when making a payment inquiry. In some cases, customers may have trouble making their payments and claim a booklet wasn't sent in, or the home they purchased isn't what they expected (buyer's remorse), so they justify not making a payment that way. Also, in some cases the builder doesn't perform, so the mortgage company is to blame... I don't know the situation here, but I'm eager to learn exactly what happened. The majority of these claims do make themselves to me... This one must have gotten past me, and I'm sorry for that. Please call me directly. I will take care of any problem you have w/ in my ability.

If you even mentioned you had another home and gave them address of it, they may have snuck in papers at closing or just made one up. You better check. Also, dont keep feeding your attorney money. Some are not as loyal as you would like. Its best to have proof of everything and make it easy on your attorney to eat their lunch. Get an attorney on contingency if possible. They go for the whole enchalada. Its not easy but sometimes, to get the mortgage companys respect, you have to get it the old fashion way...earn it.

Follow "qualified written request letter" directions now. Document everything and Tape all phone calls. Their arrogance can be frustrating but if you do your homework, find the best predatory lending attorney in the state and prepare, you can take them to the bank. They are charging you for a mortgage on a house you do not own, or are not buying? How can they do that? As to whether pay or not, I would say I wouldn't. If you don't own the house on that mortgage, and the house you DO own isn't tied into it, what are they gonna take??? They can sue you of course, but if you have a lawyer who is willing to take it to court and prove you don't have a "real" mortgage with them, there's not a whole lot to lose.
