On Feruary 11,12 and 13, 2014 I was staying at Microtel Inn with my wife because of the storm conditions in the area while on a business trip. I booked the room through Orbitz at the last minute because of availability.

We were housed on the second floor (Room 225), which also happened to be directlly over the rear entrance of the hotel. This area was used by the hotel employees as a smoking area, which is also in violation of their no smoking policy within 100 feet of the building. This same policy was violated at the front entrance of the building also.

On Thursday, Feb 13 we were approached in our room by Nancy Rodriquez, the Assy Manager, and another individual and told that they had complaints from another guest that they smelled cigarette smoke coming from our room. I informed Ms. Rodriquez that neither my wife or I are smokers and that was very unlikely that smoke smell was coming from our room. We did inform her that we keep the window open at all times but we did not smell smoke. However, because our room was located next to the stairwell where the employees go out to smoke there was always a heavy smell of smoke. She said that she did not believe us and that the head maid had also entered our room and smeeled smoke.

We continued to deny that it was our room the smoke was coming from and she said that we were to be evicted immediately. I protested the eviction and she left the room for a short time only to return and say we could stay but that our stay would not be extended beyond that night. She also informed that I was to charged $200/night for smoking in our room. She gave me the name and phone number of her manager, Jim Abercrombie, and told me call him the following day to try and resolve the issue.

I tried calling him five times the next day but did not hear from until Feb 18 after I contacted Wyndham Hotel group. He appologized for the way the situation was handled and said the $200 charge would be removed and that my next stay would be complimentary. He also informed me that it was more than cigarette smoke that the complaint was about. He said we were smoking pot. I told him I would be glad to be tested anytime. To date the $200 charge has not been removed.
