Midland Credit Management, Inc, MCM Violation of FTCA, reporting open date and last activity date as current when 6 years old San Diego California

Midland Credit has obviously purchased alot of really old debt and is reporting as open collection on credit reports.

They have reported "account open date" as the date they purchased the debt when in fact the account was charged off in March 2003. They reported to two credit bureuas that the open date was in 2007. That is not true and against the FTCA. I saw an attorney and he told me that they cannot sue for collection if it has been six years since last activity, but using the date 2007 it appears to be a recent account.

Due to their false reporting, I had to pay additional points on a refinance and paid an attorney. I am interested in a class action suit. In any case by 3-7-09 there can be no dispute that six years have passed, which means that they cannot sue me for collection and I will be sueing them for false reporting.

I do not want to trigger any action from them altho I have already reported them to the better business bureau and the attorney generals office. They are nasty as heck on the phone.

I nicely asked for their names and physical address as they obviously don't want to be found! They are in San diego and the person I spoke with was Larry Kelman and then they assigned my account to Malcolm.

They told me "we have a slew of attorneys". Don't believe it, if they followed the law, they wouldn't be listed here. Know your rights and protest. Another friend got his really old debt purchased by Midland as well and it is interfering with his purchase of a home because they date the debt as CURRENT. They hate it when you report them to the BBB and attorney general's office, but you need to do it.
