As a home buyer, you should be able to have an agent you can trust. Someone who does not become impatient with you because they have shown you 10-15 homes (most of which they chose, that don't meet your needs). You should be able to go in a home and view it, without them harassing you about putting in an offer. Most of all, you should be entitled to a Final Walk Through and requesting the seller to fix major issues in the home you choose. These issues are not even half of what I experienced with Miracle Holt. I truly thought she had my best interest, until I began to see her urge to get me in any home because she was ready to be paid. She complained to me as a client about showing me multiple homes and requesting that I just choose one.

During my buying process I requested a longer contingency period, as I was only given 7 days. My agent denied this request and 10 days later I found out the home had termites. Prior to submitting my contract I had requested to have a Termite Clause and for the Seller to provide me with a Termite Inspection. My agent told me that I had to get this inspected on my own, and that the seller was not required to do so. I learned down the line that the Agent was just afraid or just did not want to contact the seller to make any requests. She was never good at negotiating any of the deals on offers I put in on homes. She spent more time negotiating with me rather than the seller of the property. Then there was her telling me what was expensive and what was not. Like the Termite Treatment costing nearly $1000.00, she tells me that this is easy to earn over time since it’s not needed immediately. As an Agent you should know your clients financial situation and respect it, not neglect it, because you are ready to close on a deal. And since it’s not a big deal, pay for it, since you neglected to put in my Termite Clause.

After closing on my home I went to visit my new place, only to find that it was not the same as when I saw it 1 month and a ½ earlier. The carpet had holes from burnt cigarettes, the roof was leaking, there were holes in the walls, broken columns and missing fixtures. I call to complain but nothing can be done because this is all my responsibility now. The agent never offered or even mentioned a “Final Walk Through.” As a first time buyer I had no knowledge of this. I contacted her broker at Metro Brokers and he was no help at all, just another person telling me that I was responsible. I attempted to complain about the Agent and he took her defense. Now I have to deal with going to court to get reimbursed for the issues in my home.

This made my experience a horrible one. And after doing research I have found that my experience could have been a lot better had I had a better Agent. I attempted to change agents while I was working with Miracle, but I was told that from the prospective agents, that Miracle would get the commission because she had already showed me my home. All in all I am writing this to warn other buyers of this Agent. Save yourself the trouble and headache and find a better Agent. Find someone who is truly caring and not just pretending to care so that they can get paid. Even if you’re in the middle of your deal and another Agent cannot work with you, it is worth loosing that home and letting another person find you something better. Sure it will take more time, but trust me, in the end it will be well worth it.

First I would like to apologize that Mrs. ZaQuayla Johnson felt as though her time with me was such a disaster. It is surprising to me to find this post, 2 years after the sale. I was not aware that this post was online otherwise I would have gladly acknowledged it as there was absolutely no foul play in my intentions in assisting Ms. Johnson with her first home purchase. 

In my defense, I wanted to share with the public exactly how the transaction with my previous client was held. Luckily, Ms. Johnson and I had a conference call with Better Homes and Garden Metro Brokers on July 22nd, 2014 in reference to her complaints. The conference call covered a few bogus accusations Ms. Johnson had and was led by the Metro Brokers notable Broker Support team as they are all staffed, knowledgeable agents who give counsel to newer agents such as myself at the time. 

 

7/22/14

"Today, I had a conference call with Ms. ZaQuayla Johnson with Will McGowan of Broker Support to address her concerns about the property she closed on at 1157 Cayman Ln SW Marietta, Ga. Ms. Johnson’s concerns were in reference to possible latent defects with the property that she felt were not fully disclosed to her prior to closing.


After her closing on July 7th 2014 Ms. Johnson sent me a text message a few days later on July 14th 2014 about the post that is in front of her home. She stated that the post was shifted and that it was not anchored to its correct position. Her exact question to me was “What can be done about this? Would it fall back on the seller or the inspection?” After looking at the photo she sent me (below), I called Broker Support just to confirm that this issue could not be deemed a structural defect at this point and that it’s something that she would have to repair on her own more than likely. Broker Support confirmed my thoughts and I gave Ms. Johnson a call to let her know. She did not answer so I left a voicemail. I told her that if she felt that it was indeed a STRUCTURAL issue that would cause the home to be inhabitable, then she would need to consult a licensed contractor to come take a look to ensure her suspicions of the property being faulty. At that point, she would have to seek Legal Counsel and address the SELLER with this issue in an effort to come to some type of agreement or resolution. She never replied to my messages sent on July 15th so I assumed that the issue was resolved.


I later received a phone call from Will McGowan on July 21st. Ms. Johnson had reached out to Broker Support to address a question about another issue with the home, a leak in the ceiling that caused her to fall and hurt her back “really bad”. I was unaware of this as Ms. Johnson had not spoken to me since I told her that there was nothing I could really do about the post issue. After speaking to Will, it was clear that the concerns Ms. Johnson was reporting were odd and the cause a little unclear. There were no major issues with the property addressed in the Inspection, or the Sellers Disclosure, or the FHA Appraisal. Not to say that her issues are not valid, but we reviewed all documentation to ensure that as an Agent I did not overlook anything in the file. After our review, we had a conference call with Ms. Johnson to try and give her direction as to how to move forward with her complaint and concerns.


Much to our surprise, it seemed as though Ms. Johnson wanted Metro Brokers to compensate her or to negotiate with the seller a remedy for her problems. She even went on to say she felt “rushed” throughout the process even though she had to move out of her apartment by July 1st and did not close until July 7th. She felt as though I did not disclose to her key facts that were indeed explained to her. A few of her complaints are listed below:


No Termite Inspection was added to the contract for the Seller to pay. The reason a Termite Inspection was not added to the contract is because it was not a necessity but a personal desire of the client. At Inspection, the gentleman asked if there was a termite bond present on the home. Since there was not one, he suggested that she get an inspection for termites seeing that the home was backed to a wooded area. It was her decision to move forward with an inspection and it was not a mandatory issue with FHA or per the Sales Contract. After the Termite Inspection, the Termite Professional stated that there was slight termite damage but nothing more than the practical home. He stated that a bond would be wise but it was not mandatory. However, due to the clients complaints and persistence, the seller and BOTH agents agreed to give a portion of funds to help her pay for the treatment ($200 from seller, $100 from each agent’s commission).

7-day Contingency. o Ms. Johnson complained that she only had a 7 day contingency period and was told she could not have more days. With any contract, all terms are negotiable. We negotiated the sales price from a $135,000 list price to a $125,000 sales price, we negotiated more seller paid closing cost, and we negotiated a shorter close date. In these negotiations, we also opted for a 7 day contingency and to waive the right to a Seller purchased Home Warranty. I explained to Ms. Johnson that if she would have liked to “demand” a 10 or 15 day contingency period, we could have negotiated that into the contract. But none of this was an issue at the time of signing the contract. - Only viewed home 2 times. o I recollect going by the home more than twice; however, I never told Ms. Johnson that she could not request to stop back by the home to view. I made myself available to her to view the home whenever she felt the desire. She never made a concern to me about viewing the property again as she was satisfied with the inspection and termite inspection, and appraisal.


To give a brief overview of the home, it was built in 1996, has had the same owner since then. There were no major concerns on the inspection or the appraisal. There was no way I as the agent would have known any more than Ms. Johnson going into the closing of this transaction about any latent defects on the home. The Seller was moving into a Senior Community and had been the original owner of the home since it was built in 1996. All inspections and appraisals came back satisfactory without any major concerns of defects, etc.


Ms. Johnson and I have worked together to get her a home since April 17th 2014. We have looked at between 20-25 homes; she put in 3 separate offers, withdrew two, and closed on the home at Cayman lane over the course of our time together. I worked diligently with her to accommodate all of her questions and concerns. I was always upfront and honest with Ms. Johnson about my credentials as an agent, as she and I worked together at SunTrust Mortgage for 10 months, so she was aware that I was new to the Selling side of Real Estate. At no point in time have I ever told Ms. Johnson that I would not assist her to the best of my ability. She was very happy with my work as an agent prior to these issues. I am writing this as a testament in the case the Ms. Johnson decides to pursue further action against myself or BHGRE/Metro Brokers Inc. I want it to be clear that throughout her entire process, she has received the best client care and concern and that any issues that are now being questioned about the home or the integrity of the SELLER is in no way a reflection of neither me (Miracle Holt) nor my Broker.

Again, this was written on 7/22/14 in defense to the accusations Ms. Johnson was posing. I am not sure what prompted her to write such untrue and hateful things in this 'rip-off report'. After her closing in July 2014, Ms. Johnson praised me on her social media posting "[...] She has been an amazing Realtor. This experience was very stressful at times, but having a realtor that cares, made the process much easier! Thank you for everything you have done for me and my boys. We appreciate you [...]"

I truly hope that this report does not deter anyone from utilizing my services as a Realtor. I take pride in my occupation and I have never experienced anything like this before. If you would like to know more about me, please give me a call or send me an email! Thanks!
