I leased Outlander sport 2013 from Max Madsen's Aurora Mitsubishi in IL on Oct 2012. The sales person 'Dale' told me that the time of return after 3 yrs, I have allowance of $500. My car was totaled in car accident in Nov 3rd 2014 after 2 years of lease. I paid the lease of that month ($262) in full. My insurance company compensated the loan company (Mitsubishi Motors Credit Of America, Inc) with about $13,500. The loan company sent me the bill of insurance gap 0f $705. I explained to them that with my paid month of Nov 2014 ($262) and $500 allowance I should not owe them any amount. In additional to that the brand new vehicle is around $16000. They send me a letter that if I do not pay $705 by April 13th my account will be charged. They told me that they are not affiliated with Max Madsen's Aurora Mitsubishi. I need to waive this payment. You seem to be under a false impression of how "F"leases work.

You were promissed a $500 allowance at the time of the return in October 2015.   The dealer also expected the car to be returned in a "sellable" condition.  You did neither of these so there is no claim on this $500 allowance.    More importantly, that was a deal you made with the dealer...it has nothing to do with the finance company.  So even if you had a claim on it, you would have to get it from the dealer.

As for your payment.  It was most likely due on the 1st, you totalled your car on the 3rd.  So unless there is some provision in your agreement that allows for pro-rated payments.  Generally your entire month goes to the payment and again you are not entitled to any portion back.

Now, of course there is nothing that says they can't waive a payment or give you credit toward it.  But if they don't do that as long as they are following the terms of the agreement there is really nothing you can do.
