Money Train Total Rip Off and I will be Suing Boise Idaho
I took out a loan in March of 2013, because I was in a dsperate situation and did not have another avenue to turn to. I liked that they had the 30 day no repo guarantee, just because you never know what may happen in life. I was not able to pay on teh 1st every month but I paid EVERY month. All of a sudden I was told that I was 56 days past due, how is this possible when I never missed a payment. I was told via text message that I needed to make larger payments, I was already making more than the original contract stated, granted not an amount that would have mattered in the long run. I always told them what day I would be in and always came in to pay on that day. I kept getting told corporate was watching my account and that I needed to make larger payments, they sent this via text. I told them I was paying what I could and that it was the contracted price. Finally I got tired of their relentless harrassment and went to an outside government agency to see about getting help paying off the loan. They were informed of this and wrote me a letter stating the payoff balance and that I was 56 days past due. My appointment with the government agency was 1-27-14. They called me twice that day, after my appointment I called and spoke with the manager Julie personally and told her that I would know if I was approved by 2-3-14 (mind you we already had a date set that I would pay my regular payment by 2-13-14).She said she would note my acccount. Imagine my surprise when I woke up at 2:00 am on 1-28-14 to find my car repossessed. When I was able to get ahold of Julie the manager she said she had no idea and that Bill the head of collections (who I was told has no boss) felt that I was not making a GOOD ENOUGH effort to pay off the balance. After almost losing my job and having to jump through hoops with family members to get the total amount paid I was able to get my car back. Today I asked for a copy of my contract as well as my account ledger from their computer system, which low and behold shows that I paid EVERY MONTH! Their contract does not state that late fees or interest accrued makes you behind. Julie told my family member that ended up helping me that at one point I was 82 days past due, then it was 63, and she finally settled on 56.
Their contract reads they may repossess if I default and they consider the secured property to be in jeopardy of being unretrievable. So making your monthly payments is a jeopardy? I also did some research on Money Train in Idaho and they had to pay the state $10,000 for giving out loans without a lenders license. Idaho Title Loan law of 2006 says a lender must send a 10 day letter to cure, which I never received. I receiveid a certfied letter on 1-30-14 stating that my car would be repossessed on 1-28-14, which oooppps they repossessed on 1-27-14. Needless to say this is going to court, I have filed a report with the FTC and the State of Idaho, and will be following up with a small claims court action.
This company is completely unethical and I would never recommend them to anyone, heck even the repo man told me of a better place to get a loan should I ever need one again (trust me I will never take out another title loan in my life or payday loan either for that matter).
