In or about May 2009 through July 2009 Morgan Stanley Home Loans refused to provide timely documentation to my husband for his 401 K Hardship Loan requirements in order to make current his home loan. In fact, my husband made numerous contacts with Morgan Stanley Home Loans Customer Service Department and each time spoke to a different representative who knew nothing about this request. Further, on one of my husband's contacts with the customer service department, he was advised by the representative that Morgan Stanley Home Loans did not want his money as it would stop the default/foreclosure time clock. This representative informed my husband that if they accepted his money, that they would take our house regardless. As a final blow, Morgan Stanley Home Loans failed to notify myself, a legal owner of the subject property indicating this impending foreclosure and sale of the family home of 16 years. Morgan Stanley Home Loans had full knowledge of my contact information and failed and refused to attempt contact with myself. It was not until the weekend before Thanksgiving 2009 that I learned that my house was sold at auction. I have made attempts to allow Morgan Stanley Home Loans to correct this deceitful act going as far as speaking with their CEO, Anthony Meola. Mr. Meola refused to deal with the situation and forwarded my complaint to his assistant general counsel, Andrew Stein. My husband and I were advised by family members not to speak to Mr. Stein without legal representation. As it goes, my family has been served with an Unlawful Detainer, will have to move from our home of 16 years and incur costs of legal fees, moving expenses and not to mention extreme emotional and physical distress of myself, my husband and my ten year old son. In conclusion, Morgan Stanley Home Loans never intended to modify our loan terms or accept any payment on our mortgage. Morgan Stanley "ramrodded" our home into foreclosure and sale.

Culpable and negligent

You may have worked for them, and in theory your statements are correct.  However, as a person who had to deal with them, the reality was far different.  Saxon sent me a loan modification packet three times within a year.  Every time I declined it, as it wasn't something I requested, and not something I wanted.  Every time I mailed my check for the monthly loan payment after they sent this UNREQUESTED modification packet that was NEVER completed they cashed the check but didn't apply it to the loan.  So now my account was out my mortgage payment, and then Saxon hit me with late fees and marred my credit by reporting it as late.  Despite over two years of calls, explanations, talking to supervisor after supervisor who assured me it would either be fixed or that there was no way they would do this, nothing was done.  

Why would a company do this?  I was happily paying my mortgage at the regular rate.  I didn't need it reduced or modified.  I didn't ask for this.  Yet now my credit is screwed, and they do not take the blame.  I didn't ask or want Saxon to own my loan.  This was done as part of the process of buying a home, with each lender taking it on for a few weeks or months.  Saxon held it for years.  They were the only ones who couldn't just take my payment, apply it to the loan as any normal bill is payed, and who screwed up the entire process.  Now you tell me how Saxon is not at fault?  I was happy to pay every month, I didn't lose my job, I didn't have any extenuating circumstances.  Yet here I am because of their negligence and incompetence.  How is this not Saxon's fault?

My wife dealt with Saxon and "working" with Saxon was just how it has been described. We spoke to people that had no clue. We were in an 8% mortgage and had been for about 4 years. When the opportunity came around we worked with Saxon to see if we could modify the mortgage. We followed all the directions. We were informed that we would not be able to modify the loan about 3 months later. We had made payments this entire time. Now "they were asking for a additional $1500 for a missed payment that was never missed. We had cashiers receipts for the payments. We sent "them"documentation at least ten times. We didn't get any kind of responce until we called the better business beauru. Still there was no admission on their part. We saw a lawyer and we were told it would cost as much as $10K to get it straighten if we had to go to court (we would win) but then Saxon could still foreclose. So your defence of the company is nonesense. For your reply to that women I bet you there are 100 people this company ripped off with impunity.

You can 'Google' this- WHO OWNS THE FED?, and go to the site with the five charts. Morgan Stanley is listed in 'Chart 1', along with Lehman Brothers and J.P. Morgan Co.

If you type in 411913 at this site you will see that JP Morgan Chase was named in that Ripoff Report for taking out 'secret life insurance policies' on its employees. I believe that JP Morgan Chase has $11 Billion in these policies.

Simply 'Google' this- BANK EXECUTIVES PROFITING ON THE DEATH OF EMPLOYEES, and read the related articles on the web for proof.

It appears that the big banks in America have done a lot of damage to our economy, wouldn't you agree?

You have no idea what you are talking about.  In my quest for justice, I contacted at least a dozen state, federal and local agencies including the Better Business Bureau.  I was notified by the agencies that there were so many complaints filed against Saxon Mortgage/Morgan Stanley Home Loans that it would cost a fortune to obtain copies of the complaint.  The Department of Corporations, Department of Real Estate and other agencies have open files in connection with Saxon/Morgan Stanley Home Loans.  I am still waiting (4 months) for the backup documentation from their unlawful foreclosure and sale.  My guess is that they don't even have legitimate documentation.  Their General Counsel, Greg Smallwood and Andrew Cline are extremely condescending and arrogant, and impossible to get a straight answer from.  I will continue my quest against their criminal activites.

Does everyone remember how the price of OIL went up to $147 a barrel in 2008, causing gasoline to go over $4 a gallon in the USA?

And I can assure you that they are NOT in the business of taking your home.  If you pay a $300,000 mortgage on time, it makes Morgan Stanley approx $500,000 over the life of the loan.  If everyone paid their loan on time, the banks would not be in crisis. 

BELIEVE ME, they DO NOT want your house.

The TRUTH is, the bank has to do some risk assessment.  If they see that you are 90 days past due and your ONLY means of catching up a little is a LOAN AGAINST A 401K, they realize that there is no point is dragging out the inevitable.

I'm sorry, but you are only telling half the story.  I know Morgan requires you to be 90 days past due before they start foreclosure proceedings.  So what you are conveniently leaving out is they let you borrow thousands of dollars and you decided to take a 3-month long break from paying them.

Whatever your reason for being late, banking is a cold business.  That's why you sign 40 papers at settlement.  They are giving you hundreds of thousands of dollars, and if you miss 3+ months, they take their collateral.

I know it's emotional.  I lost a duplex when my wife lost her job; it sucks.  But let's not pretend we thought the bank was an altruistic institution; they are a bank - their only concern is profit.
