I ordered a sofa online via mydesignersofa.com September 16th, for $1,782.50 it is now January and I have no sofa and no tracking # to show any physical product exists or is on its way to me.

At the time of my purchase the merchant's website listed 15 weeks as the maximum amount of time the order process might take.Since that date she has changed the estimated order process time several times, extending it to meet her delays, and it now reads "3 to 5 months or more". Thankfully Google's cached pages preserved a copy of the website's terms stored just days after my order was placed to preserve the original terms and conditions.

Originally after I placed my order on September 18th the company sent me an email stating my sofa had gone into production and I would be receiving photos soon. I emailed 2 more times throughout October and was told again and again that I would be receiving photos of my completed product any day. On October 29th, a month and a half after placing my order, I grew concerned, I requested merchant give me a due date when photos would be sent, merchant responded the reality of the situation was my order had not been processed at all, construction had not started and I should check back in "a couple of weeks".

At that point, angry I had been lied to for over a month, I requested a refund, the merchant refused. I was instructed by paypal and my bank to file a claim with the BBB. The merchant told the BBB in mid November that the sofa would be leaving in a container to the US "within in 10 days". This did not happen. The complaint, 9280053, is still open pending proof of shipping by the merchant, which has still not transpired.

Frustrated I began opening complaints with other organizations. The seller sent me an email on December 18th with a photo of a finished sofa that claimed to be my order and said it was being put into a container and being shipped to me. After telling me this- that very same day- Dagmara Pospiech contacted an organization where I had previously lodged a complaint and told them she was cancelling my order and not delivering the sofa to me.  

From Dagmara Pospiech's email sent after she told me the sofa had shipped-  "I am actually loosing money on her order and I am willing to just cancel the order and don't deliver her already produced sofa"

The agency replied requesting the company refund my money, again she did not.

Prior to learning she never shipped my sofa I had spent the last several weeks requesting to receive some form of tracking information. Naturally since the sofa was never shipped I have received nothing in the way of tracking or proof of shipping. I now realize the seller lied to me again about having shipped the sofa in an attempt to placate me for the last several weeks and further delay refunding me my money.

Dagmara also likes to say in response to my complaints that I am "unfamiliar" with the custom sofa ordering process. This she knows not to be true. She is a reseller for Shangri La China, who I have ordered a sofa from in the past. When I ordered through Shangri-La China through another reseller I received my completed custom order, start to finish, in approx 2 months going through the exact same factory. The website for Shangrila China also lists production time, including shipment to the US from china, to be 8 to 10 weeks. Why is my order through this reseller taking more than twice as long? Fishy indeed. Avoid this company at all costs, I know I wish I had.

Sofa finally received over 5 months later

We finally received our sofa on February 22nd, over 5 months after we originally placed our order.

I was not happy that we wound up having to pay more than our original shipping quote to get it, and even though the receipt clearly listed "inside delivery" and not "curbside", the company that delivered the couch left it on our doorstep.

There are also a few construction issues with the peice, but I have chosen to deal directly with the manufacturer, shangrila china, to try and resolve the problems.

I feel if Dagmara Pospiech / Dagmara Malinowski had been honest and upfront about the delays when she found out about them, and had given me the option to cancel my order when extending the wait time to 5 months or more (especially since she knew I needed this couch by December for company coming for christmas), I would not have filed the complaints I had and would be walking away with a much more satisfactory experience.

Instead when delays became evident this vendor changed the terms on their site close to 2 months after the order was placed and pretended the text had been there all along. Because of that attempt to defraud me as a buyer and various other dishonest actions I cannot reccomend anyone do business with this merchant.

Also if you are buying a built to order sofa pay with a credit card- not paypal. Paypal has a custom item clause that was the cause of many headaches and an inability to be refunded when the merchant didn't follow through with the original delivery schedule. If you use a credit card you have 6 months of buyer protection where they will reverse the charges when merchandice is not received. I wish I had done that instead.

IT is not ripoff, it is only delay

We at  Shangrila China building sofas for mydesignedsofa but  because of slow economy we have reorganize our distribution channels and we closed our California warehouse. During transition we ship current orders later than normal, but your order is already in Long Beach and all orders we start delivering this week. This happen not only to mydesignedsofas, but to all our dealers. Sorry for delays,  we are working to shorter delivery time and it will happen.

We are in business for 10 years and all our orders were delivered, we never ripoff anyone, but delays happen.
