I have a 2002 Altima Nissan that always been serviced by the servicing department as to where the car was bought. Scheduled service maintenance, oil changes, recall parts, you name it (have copies of invoices going back as far 2004). Also, subject car was last serviced for and oil change on 3/31/2007 by Nemet Nissan.

Well to make a story short, engine on the car is no longer good, it happened on 5/15/2007 while on highway on my way to work, heard rattling noise call my job notify them of car problem, and drove it to the nearest servicing department of Nissan located on 11 Ave and 47th Street (5:00AM), waited to be serviced, car is covered by an extended warranty Nemet Nissan sold me when I initially bought car.

Nissan contacted National Auto Care extended warranty, Nissan servicing department had to take apart engine so that an adjuster of theirs could look at car, and Nissan made me signed a disclaimer that assured them, that if claim was denied I would had to pay out of pocket expense of approximately $800.00. Nissan assured me that this was a standard procedure and that National Auto Care would cover engine, since it was still under their warranty.

In addition had to provide copies of invoices/ bill of previous service done to car, which I did about 16- pages in total. The adjuster finally came to look at the car a week later. Well to my amazement, I was told by Nissan that the claim was denied due to not enough lubrication, and only two quarts of oil in car, when car holds four quarts. To my amazement, National Auto Care told us to contact Nemet, since they serviced the car and it was their problem and not theirs.

Although, I threaten to sue, I was told by Mr. Ross, that once a lawyer was involved, he would not be able to help us further. He advised us to contact Nemet Nissan, which we did, and we spoke to Mr. Wayne the servicing department manager, and was told that the reason given was not a valid one and that they are aware that this particular car has a problem of burning oil quickly. The car has no oil leakage; no indication of low oil or engine problems, rattling noise was what triggered me taking the car in a 5:00AM on 5/15/20007.

I'm now stuck with a bill of $800.00 a rental car of about $650.00 as of date, and a car in pieces, which is not drivable.

I'm a patience men, I will find a way to have this car towed to my house, I will obtained legal advise, will sue, and do not care how long this will take to be resolved, but I will find every possible way to make this situation available to the public, I will harass unconditionally via phone, letters, better business bureau, contact TV news and bring this whole situation to light, so that no other consumer gets rip off like we have been.

This is a legitimate claim, I have abide by the contract, serviced my car, follow maintenance recommendations, spent lots and lots of money by bringing car to dealer for servicing, and to be stunt by their callous response as to why they did not honor claim. This is unacceptable, am a hard working consumer, I follow the law, I play by the rules, and to be treated with such callous is unacceptable.

In addition, to all this I was asked by National Auto Care Corporation Mr. Joe Ross to contact Dealer Nemet Nissan which sold the car and the extended warranty to us back as off October 2001, to see what they could do for us.

Well it turns out that failure to the engine is due to vehicle had about 2-quarts of oil left in engine, tech pulled one rod cap and found scoring on bearing, check for isolated failure on more bearings that are failed and this is all due to a recall part that Nissan recalled under document # NHTSA03V-084 for 2002-2003 Nissan Altima 2.5 liter engine have defects that relate to engine damages.

This memo was faxed by Mr. Wayne (Servicing Dept Manager at Nemet) to Mr. Ross at National Auto Care Corp. Base on this new development, the extended warranty is not willing to fix car and Nemet keeps giving me the round around. I been asked by Mr. Wayne to give him to Thursday (5/17/07), on Thursday, I was asked again give me to Friday morning Im 99 % sure that I can help you with this, and on Friday (5/18/07), I was totally ignored, until 4:30 in the afternoon, after leaving numerous message for Mr. Wayne and Nemet Manager.

At this point I was told, please give me to Tuesday (5/29/07) morning, Im pretty sure I could help you with this, the person I need to speak to is out until Tuesday, dont worried Ill handle.

Well today is Tuesday, 4:48 PM and no answer, I left numerous messages and no one has returned my call. I had to send my son in person to Nemet in order get an answer and this is how a finally got through to them. Mr. Wayne supposedly is trying but there is nothing he can due until Nissan gives him an answer. I was told not to contact anyone such as Nissan consumers affair or a lawyer just to wait, but I think I waited long enough, its been two weeks to the day, and no resolution whats so ever.

I been patient, courteous, done everything they have asked me to do, and yet nothing. My best bet is to paid for the rental, paid the $800.00 so amount for Nissan of Manhattan dissembling the engine, have it tow to my house and keep it in storage until I hire a lawyer and sue National Auto Care for not honoring their extended service warranty, Nissan of Manhattan for misrepresentation, knowing very well that this is a known fact about engine problems on the 2002 Nissan Altima due to recall parts, and Nemet Nissan for not properly servicing my car every time I took it in for servicing, again well known fact about engine problems with the 2002 Nissan Altima.

I have tried everything possible to get them to help me, my blood pressure is 140/90, my health is falling due to all this stress, and no one to help. They are all dishonest starting with National Auto Care Corporation, Nissan of Manhattan, and Nemet Nissan.
