I signed up for a gym membership with Omni Health & Fitness in Fayetteville, NC.  The contract was for a 24 month period beginning on 1/16/10 to be paid by automatic recurring payments from my bank account each month.  I have come to the end of my agreement but my bank account was debited again on 2/16/12, even though I did not agree or have any intention on renewing past my membership end date of 1/16/12. I spoke to Jennifer (would not give last name), with National Fitness at the 800-658-7727 #, since they handle membership inquiries and billing. I was told that since the renewal box was checked on my contract that the membership automatically renews and that I would have to send a written request within 30 days of the contract end date to have the membership canceled. Jennifer also assured me that my bank account would be debited again in March.  Jennifer also directed my attention to the renewal check box on the contract and stated that I agreed to renew since the box was checked.   The contract clearly DOES NOT state that I agreed to renew.  The renewal box on the contract that I signed states: This membership agreement is renewable at a guaranteed rate of $37.00 per month for 12 months upon completion of the renewal agreement/application at the Omni Health & Fitness at the address above if the renewal agreement/application is completed prior to 30 days before your expiration date with a written request for renewal.  This is clearly giving me the OPTION to renew at the same rate as the original contract as long as I fill out a RENEWAL application 30 days prior to the end of the membership along with written request to renew.  I did not, will not and have never had any intention of renewing the 24 month membership.

While speaking to Jennifer I did request to speak to a supervisor, in which she then said she was one.  I then requested to speak to her supervisor and she refused.  She advised me that I couldn'tt speak to anyone but her.  The only thing she kept offering me was an address. I then called Omni fitness & Health since I signed the contract at that facility, and was told that since the renewal box was checked that I would have to send written request to cancel.  I advised them that I never agreed to renew and tried to read the renewal clause to her, but she insisted that the membership renews automatically and goes on a month to month at the end of the membership and that I would have to send written request to cancel.  The contract doesn't state that anywhere.  I told her that I was told by National Fitness that I would continue to be billed again next month.  She then advised me that I wouldn't be billed because once I send the letter to contact them(Omni Fitness & Health) and they will kick me out of the system.  These people are clearly not abiding by the terms of the contract and are fraudulently debiting funds from bank accounts.
