Since the year 2000 NCO Financial has been trying to collect an account for AT&T. I have explain to them in thousands of different ways that the account is not mine. The middle name on the account is not mine plus the address on the account is not mine either. But somehow they have mixed my information with this other individual.

They call me almost every day. I have been insulted and treated like a delinquent on the phone. I have to get a credit report at least every six months and request to have this delinquent account deleted from my report since the account is not mine. All 3 credit bureaus acknowledges that the account is not mine and therefore gets deleted until NCO Financial reports it again And the cycle starts all over again.

Its becoming expensive since I have to pay for the credit reports and my credit score goes down until the matter gets resolved. Meaning that even when my credit is perfect I'm not offered better interest rates because of a 'delinquent' account that its NOT mine.

Is there any way to make this people understand? How can I get this permamently deleted?

#4 Consumer Suggestion

Carmen, I have your answer...

It's called a lawsuit! SUE THEM for damages!

AND, report them repeatedly to the FTC. The more complaints, the quicker the FTC gets them AGAIN for violating the law.

Contact your state AG and the FTC now

Even if this is a case of mistaken identity, if NCO is putting this on your credit report, they have your SSN. I would not sleep well at night knowing those crooks have your Social and could be doing any number of things with it, including possibly opening other credit cards and buying merchandise they'll never pay for.

Contact your state attorney general and the Federal Trade Commission immiediately. File as many claims as you have to, and it wouldn't be a bad idea to sit down with a lawyer to see what other legal means are at your disposal. Fraud is one thing, but identity theft is another, which could take you years to clean up.

#2 Consumer Suggestion

There is a way

First of all, everytime they report this account to the credit agencies, they are breaking the law, and, I belive there is a $1000.00 penalty for each occurance, that is payable to you.

But for now, send them a letter demanding they validate the debt to you. Have them send you any and all contracts and documents with your signature. Demand they stop calling you, and only communicate via the US Postal Service, certified. Do NOT give them any personal information, ssn, date of birth, etc.

Send this letter certified, return receipt requested. There are samples at budhibbs.com of how to word this letter.

#1 Consumer Suggestion

Next time they call do this

AUTHOR: Jim - (U.S.A.)

I've had a very good response to this tactic, next time they call say "This is not my debt" then take the reciever away from your ear, press and hold down the #1 button, this sends a squeal through the lines to their ear.

Hold the button down until they give up and hang up, (Don't press any other buttons) then use the "Redial" function (Or the star 69) to get their number, call them, and when they answer again press and hold the #1 button down and annoy them as they've been annoying you.

I actualy had one not only stop calling, but put my number on their "Do not accept calls" list so I cannot call them and bug them.

A clear victory, don't get irritated, that's exactly what they want, get even, drive them away.
