New Merchant Services made great promises, but failed to deliver.

I decided to try the business described by New Merchant Services. I explained many times to different representatives that I was unsure whether I had the time to list the number of items that were described. I was told that it was flexible and that If I wasn't satisfied with the results - even within as short as 1 month's time - I would be able to terminate the agreement and receive "assistance" in transferring the lease for the credit card system (which is not required for this kind of business anyway).

I received some paperwork via overnight mail which I did not ask to be sent overnight and was later billed for it.

After a short time, I realized that there was no way for me to list 5-10 items per day. Not to mention that the products offerred by the lousy dropshippers that were provided, would not have been profitable anyway.

I opted for the release described in the so-called guarantee of success. Mr Lipski, then informed me that because I hadn't performed the minimum number of auctions that NMS would not honor the guarantee.

I paid $250 to be released from the agreement with 1st National Processing which charged a monthly fee for processing the credit card transactions.

Then I asked for assistance in transferring my equipment lease (from MBF Leasing) as promised. I was told to advertise locally which I did with no success (no surprise there - who whould want such a lease?). When I confronted NMS about their promised assistance (and after many unreturned phone calls and emails), I was told by Mr Lipski, "If they ask for a used terminal we can offer people looking to transfer their lease. Otherwise, we cannot violate our leasing contract." In other words, no assistance at all because no one knows to ask for a transferred lease. I have my doubts as to whether the lease would be transferred even at that point.

This is at the very least unethical and borders on fraud - promising something that while technically true is practically never going to occur.

In short, I was promised something by more than one representative of NMS which was not honored

I contacted MBF Leasing about being released from my equipment lease, but they were under no obligation to provide a release. MBF Leasing has terminated its relationship with NMS and Mr Lipski, but I am still stuck with the lease.

So, even though MBF Leasing is not technically associated with NMS or Mr Lipski now, they are effectively associated with them because the lease agreement was entered into through NMS.

I made my share of mistakes here, but please beware of:

Please Note: This complaint is not from a client of 1st National Processing New York. 1st National Processing New York is an independent sales office and provide our own customer service to our clients. There are over 100 across the nation. Just like insurance brokers. The independent sales office who services this client obviously dropped the ball and did not help their merchant. Please don't be confused, this is another Independent Sales Office , not 1st National Processing New York.

I stopped paying the bill in 2/2007 and retained the services of an attorney. He sent a registered letter to MBF Leasing, and it was received, but they never responded. My attorney then tried many times to contact MBF Leasing, but was never able to speak to a representative. We never heard anything regarding the return of the equipment or anything, until...

Now almost a year later, I receive a Summons to appear in NY court. My attorney and I try to reach the attorney for MBF Leasing for almost 2 weeks without success. Finally he called my attorney.

MBF leasing is a sleazy as New Merchant Services in my opinion. They are not interested in dealing with me or my attorney personally. They are only interested in scamming people with their lease program.
