I was unemployed and becoming desperate and unfortunately fell victim to this scam.  After coming away from a few meetings with David Cutler impressed with his operation and the services they could provide, I paid a $5800 retainer.  The contract provided a 10 day window within which I could cancel and receive a full refund, and within that period I met with the person who would be working with me, Scott Stein.  I came away with my meeting with Scott and was still on board, even after I was given a bunch of homework to complete before our next meeting.  Two days after our meeting and 4 days before the cancellation window was due to close, I received a call from a business associate who told me about a position at his company and after meeting with them the next day, I came away 90-95% sure I would be offered the position and planned on terminating my agreement with Next-Opp.

I called David Cutler to tell him about my situation, how I hadn't yet been offered the position but that I felt I should terminate the contract due to the window for doing so closing on Monday. I was told that I shouldn't make a decision based on the termination deadline, that if this job came to fruition, since it was away from them and I had told them about it before the deadline, that they wouldn't expect to get paid....it was inferred that I would be receiving a full refund if I did indeed get that position and wanted to cancel.  A week later, a few days after the cancellation period, I was offered that job and emailed Mr. Cutler my cancellation notice.  Weeks went by without getting a response to my emails and phone calls, but finally after I threatened legal action, he came back to me and said how much work they had already done on my behalf and that they were owed that money from me, that they had "earned it".  After arguing over the absurdity of those comments and having Scott Stein imply months later that he was still under the impression that I was a client (months after I had started my other job), I hired an attorney and was prepared to sue for the $5800.  At that point Mr. Cutler backed off his claim that I actually owed HIM some more money and we reached a compromise that would enable us to avoid legal bills.  I reluctantly agreed to accept $2900 and in January signed an agreement that said that receipt of the $2900 would satisfy all claims against the company.  

After a few months of asking about my money, I received a "good faith down payment" of $500, with Scott Stein telling me that business wasn't good and that the balance would be paid when they were able to place a few people and get paid themselves. Well its 6 months later and nothing....and total silence from David Cutler to my emails. So now it is back to the attorney to collect $5300 (original $5800 less $500).  What a nightmare. I certainly wish that I had checked this website before I ever wrote him a check. I feel like a total sucker and I was preyed upon while in a postion of weakness. Do yourself a favor and do not make the same mistake I did.
