On October 5, 2008 I attended a timeshare presentation at the NH Krystal with Marco Olivera. The NH Krystal offered to pay me $19786 for my timeshare in exchange for my buying a unit in their resort. They had a partner (Mr. Brian Jackson of Resort Solutions) in the USA that would then rent it out for $2100 per week for up to 25 weeks. This would be a profit maker for me.

Upon my return to the USA, I learned that Mr. Jackson would help me sell my timeshare for a fee, but that the NH Krystal was not the buyer and for an additional $698 he would help me rent it out. When I refused, he informed me that he would have nothing further to do with me and that I could work directly with his friend, Marco Olivera.

Starting on October 22, 2008 to the present, I have been working with Bank of America to dispute this fraudulent claim. On December 2, 2008 I was told that my dispute failed and that I was liable for the $18,315 cost for the timeshare purchase! Clive read the transfer agreement, but stated that it was separate from the Bank of America NH Krystal contract. Clive, the bank representative, told me that Bank of America is aware that timeshare resorts in Mexico are well known for plying unsuspecting clients with alcohol and agreeing to anything that will get US citizens to sign their contracts. His suggestion was to hire an attorney.

I am incensed that Bank of America does not see this as a gross misrepresentation of their loan policy. I plan to work with PROFECO, the Mexican consumer fraud department as well as the Mexican Bureau of Tourism. WARNING: Stay away from the NH Krystal resorts in Mexico.
