On November 28, 2006, via a toll-free telephone call, I responded to a radio advertisement for John Cumutta's Debt to Wealth system offerd by Nightingale Conant - New World Media. I received the system on December 13, 2006, and returned it, unopened, on December 29, 2006.

At the time I ordered the Debt to Wealth system, I was informed that there would be a 30-day trial period. At that time I authorized, via an electronic check, a payment in the amount of $9.95 to cover the shipping cost for the system. That was the only payment I authorized. I was informed that if I chose to keep the system, I could pay the remaining balance in five equal installments of $109.96.

On January 24, 2007, after I had returned the system, I noticed an attempt by NC New World Media to charge my account $109.96. In response, I contacted Nightingale Conant and was referred to an "account specialist." I informed the specialist that since the Debt to Wealth system was returned within the 30-day trial period, this was an illegal, unauthorized and fraudulent charge to my checking account.

Additionally, I explained that I had never authorized Nightingale Conant New World Media to charge my account for the installment payments. In fact, during the telephone call when I placed my original order, I was never even informed that the installment payments would be charged to my checking account. The specialist indicated that they had no record of my system being returned and that I was now legally obligated to make the installment payments.

With the specialist I then listened to an electronic recording of the telephone call when I originally placed my order for the Debt to Wealth system. That recording confirmed that I was never informed that the installment payments would be charged to my checking account and confirmed that I never authorized the installment payments to be charged to my checking account.

When I pointed this out to the account specialist, she disagreed and indicated that their informing me of the installment payments constituted my authorization for those charges. Then I was threatened with collection and legal action if I took action to stop them from illegally charging my account. She then gave me an incorrect spelling for the company name.

I have notified my bank and written a letter to Nightingale Conant, but I want others to know how this company does business. They get your credit card or bank information under the guise of "paying for the initial shipping cost," then illegally use that information to make additional charges to your account. I would never again order anything from Nightingale Conant.
