Nissan of North America unethical sales practice / borderline fraud Nationwide
This case involves leasing a Nissan Murano in 2010 from " Prime Nissan ", which has since been purchased by another group. My wife and I are still trying to figure out how much difference this makes in a civil suit. There are too many lies and distortions from the sales managers and general managers to put in this congested report.
In the end, we were taken for over $7,200 on this lease contract. The math was obvious, but the sales reps kept double teaming us with BS, telling us we just did not understand the complexities of leasing versus buying an automobile.
We ended up dealing with three different general managers over the course of our 14 month grievance. In retrospect, we should have gotten lawyers involved immediately. now all the original participants have been scattered to different dealerships. We found this dealership was going to lose it's Nissan cotract due to what must have been many complaints such as our own. Nissan is the biggest selling auto dealership in Maine, and " Prime" was the largest dealer in the State. They would never have given this prize away.
Unfortunately, the smoking guns did not come forth until the third manager sent us a pamphlet filled with documents we supposedly signed, but we had never seen any of them. We had two completely different sets of numbers staring at us after we had seen a lawyer with enough proof already to sway a judge. Contracts the original sales people said we signed are nowhere to be found - probably because we never saw them in the first place. The 4,500 dollar dealer demo discount disappeared; the nine dollar a month basic tire protection plan we purchased was the least of four tire warranties offered. The pamphlet we recieved from the last GM had us signed up for the top three warranties ( contracts included and siged ) but no sign of the one we actually purchased. When the ultimate warranty covers all four combined, why would anyone buy the next two most expensive ones as well ? There is an area covering the bottom right corner of the contract which has nothing but warranties that have been purchased, usig checked boxes beside the warranty i question. Not a single X in a box is to be seen.
As a laugh for another day, they outsourced these warranties and they say in fine print that they are not responsible for a single thing mentioned in these warranties !
The memory that keeps coming to mind is the sales rep. telling my wife to make sure to press very firmly on the top copy of the contract. I know now without doubt it was to use as a signature duplicator to sign the other documents. Even though the old blue carbon copy process is outdated, these top sheets still can transfer the indented signature two or three times before the effect wears out. The signatures are perfect copies, which any hand writing expert can tell you is statistically impossible. We were together throughout the entire ordeal and can say without doubt that we never saw these three contracts placed into the final package ( seen months after the deal). The one she did sign is missing.
This is what we ended up with - a dealer demo, which they kept reminding us was still a "new" car. It had 4,000 miles on it, driven by a sales rep to and from work; a 15 month old car ( the 2010 Muranos came out in sept. of 2009, and we wanted this to be our Christmas present in 2010), so this new car had been sitting on Nissan lots while not being driven by sales reps for 15 months and we not only did not get our demo discout, or the $1,200 Nissan Christmas sale rebate, but we ended up buying this year old used model for the full MSRP. Nobody pays this total for a brand new model - it is a starting point for the sales reps to make it appear you are getting a great deal. We have been fighting this for the full 39 moth lease period, which ended in Feb. Nissan of N. America, located in Califoria or NMAC, the financier, located in Texas, will even talk to us. The 1,200 dollar rebate from Nissan of N. America had to be siged by my wife, according to the sales rep. from the original dealings, but that conntract also was never seen nor siged by her. This was never included in the final pamphlet as well.
Anti-trust laws were strengthened in 1996 ad signed by Pres. Clinton to prevent just such snake oil purveyers from scamming decent people. Where are the overseers in Congress now ? Sipping tropical drinks in a hot tub somewhere in Tahiti no doubt !
We are once again seeing lawyers, and this Nissan dealership, while claiming to have nothing to do with this transaction, is threatening to repo the car because my wife was a day late in making a payment. If your org. has any suggestions for reasonably priced lawyers ( hopefully pro bono ), as we have exhausted our retirement funds fightig this, we would surely appreciate it. I am sure you could count eough complaits about car salesme to form a class action suit in your daily dealings. Stereotypes are surely earned i these cases.
