We purchased a mobile home for Oakwood in early 1994. We lived in it for approximately three years. We moved back to Dallas Texas. When we bought the mobile home, Oakwood assured us that they would help us sell the mobile home if we ever needed to move. We went to them and told them we would be moving and would they help us sell it. We sent SEVERAL people to them that wanted to purchase the home and they would not work with anyone. We moved, made the payments for a little over a year while it set empty and made lot rent also. A man ask to buy it so we had a lawyer draw up a contract and legally let the man assume the payments. The payments from Oakwood went up so we sent the man the extra money. The man moved off and Oakwood called us and told us that we were behind on the payments. We explained our situation and that they had said they would help us sell it in the year it set empty. My in-laws live in Greensboro and when we left for Texas, Oakwood said they would put a For-Sale-Sign in the window and help. That never happened. My in-laws checked on the mobile home every week. They finally went to Oakwood and got our keys. They never attempted to help sell it as promised or work with anyone we sent who wanted to purchase the home. After about 7 years of payments, they repossed it. Now here after three years, we get a call from Vanderbuilt and are told that they bought the mortgage and they have sold the mobile home and we owe them $15,000 dollars or if we pay them $8,000 dollars by the end of February, the will for get the other $6,000 dollars and clean up our only blemish on our other wise good standing credit report. I smell a rat and I decided to check out the internet tonight and came across your rip off report. I think we are being had. Anyone else out there have any insight on this??? Help is needed in TEXAS!!

Heres what you need to do.

You need to WRITE to Vanderbilt and Oakwood. Demand all copies of reciepts, work order, etc. proving the debt they claim against you. Inform them you dispute any and all claims they have against you and cease any and all debt collection attempts until the copies have been sent to you.(careful, they will try to send itemized statements or a copy of your original contract, they will ask you to pay a "copy" fee)

You do not need to wait for a response from Vanderbilt/Oakwood, send a COPY of your letter and COPIES of all contracts, letters etc. to the Attorney General of Tennessee (obtain their address and complaint form on their websight) Make sure your complaint includes "will you please help" or "can you interviene" privacy laws will not allow them to get involved unless you do.
You may also do the same with the Attorney Generals Office of N. Carolina as well as Texas.

Contact all 3 credit reporting agencies and file a dispute with them (this can also be done over the internet)

Watch out, their is a collection Agency in TX that Vanderbilt/Oakwood uses, SYNCOM. They are very nasty people, as soon as you hear from them. Send them the same letter you sent to Oakwood/Vanderbilt.

You should know that Oakwood filed bankruptcy in 2004. They cannot file a claim against you in any court. How much business have you done with Vanderbilt? Have you signed any contracts with them?

I think your statute of limititations is up (as well as theirs) but you might try spending the small court fee and taking them to small claims court. Charge them for all the phone calls, postage, copies etc. Even if you loose, knowing they spent thousands on a lawyer to come defend themselves will at least make you feel a little better.
