Otay Mesa sales In November 2012 They sold an electric forklift with dead batteries. After numerous complaints they finally picked it up first week of January 2013 and to date I still do not have the forklift back Internet

In November before Thanksgiving I purchased a used electric Forklift from Otay mesa sales. As soon as I got it and tried to use it I could not because it had no power. I called Rick the manager and told him it had no power. He told me to give it a good charge and I did. Still no power. I tested the battery cells and discovered that 3 of the cells were dead. I called and told him. Rick ignored my every subsequent call until the middle of December. I was frustrated, so, on a Friday afternoon late in December I called and left a message with the secretary. I told her to tell Rick if I did not receive a call today I said I would be down there with an army the next day. 
He called me back within 10 minutes from my call. He asked me if I was going to go down and shoot up the place. I told him I did not say that and again asked him when he was going to come and get the forklift and replace the batteries and fix an oil leak. He said he would be sending someone over after the holidays. Someone indeed came and picked the forklift up towards the end of the first week of January. About a month ago Rick called me and asked me if I wanted to go to his workplace and inspect the forklift. I asked him if it was fixed and he said it was. I told him I did not need to see it as long as it works, he should just send it over. To date more than a month later and perhaps another half a dozen calls he still ignores my calls and I still do not have my forklift.
A week ago I left a message saying if I did not get a call back I no longer was interested in the forklift and that I wanted my $6500 back. I still haven't heard from him.
