While financing a car I was told that it would be in my best interest to get Gap insurance as I was quite upside down in the car. It was explained to me that GAP insurance provided the necessary means to cover the gap between what was owed and the value of the car if it was ever at a total loss.

Listening to the finance guy I did so.

In Jan of 2009, my daughter while driving the car was involved in an accident. She was charged with a DUI and at the time her license from GA was not found in the car.

In filing the paperwork with both Owner Guard and my regular insurance, I was amazed that my regular insurance settled within a month.

Owner Guard however was quite a different story. When I took all of the paperwork necessary to finish the claim  in to the office, Christopher came back and told me to read careful what was covered and what was not. He then gave me a card and asked me to invite my daughter to his Boot Camp by the Bay workout.

He then called my cell phone to again remind me to read my paperwork careful as to what was covered, which I did, and again reminded me to let my daughter know of his Boot Camp Workout.

I then received notification from Ownerguard that they would not pay the claim as I had performed an illegal operation or allowed one to be committed. I rebutted by saying I only had given my daughter permission to drive my car to her work and back but that I never told her she could drink and drive..

I was then sent another note that stated it was again denied with the explanation that it was not the DUI that prevented them from settling the claim but that they would not pay as I allowed her to drive the car with a suspended liscense and so in all intent and purpose I had permitted a criminal offense.

I again wrote them back and shared that she did not have a suspended liscense but did have a GA liscense that was fully operational. I sent them the full report from GA that showed it was a good liscense and she had no points against her.

Owner Guard chose to not pay their part. Totally ruining my credit.

Why is it that instead of telling me right off that they would not cover due to the liscence while in their office Christopher chose to push something that was not even Owner Guard. If he had told me in the office or on the phone message about why they would not cover, this could have been handled that day. But no!

I turned this over to an attorney's office and now they have had the run around. They would no longer talk with me or with my attorney until they had contacted their legal department and all dealings would have to go through them.

We were then told that we needed to once again resubmit all of the paperwork as they only have papers online and since my case was closed, they no longer had any of the information.

All of the paperwork was then resubmitted, TWICE, and after several months still no word.

Calls made to the legal department state they only work on the claims on Fridays and that my claim is in process?

It is now going into Oct. The accident occurred back on Jan 13 and they still have not settled and have no leg to stand on as far as why they will not pay.

I would suggest that anyone being told to consider getting GAP insurance not do it if it is with Ownerguard.

I noticed there is another person on this site that also complained about ownerguard. His loan was also with Wachovia Dealers. So wonder why we both have had this happen the way it has.
