On October 2nd 2009 I visited Paragon Honda in Woodside Queens. I signed a contract to purchase a 2006 Honda Pilot with the VIN # 5FNYF18106B027651. I was told the list price was $21,000 & I agreed to pay $19,000 plus extra charges for tax, NYS Inspection etc. minus allowance for my car. The total on the contract came to $18,853.75, towards which I left a deposit of $1,000. I explained to the sales rep David Garcia, a manager Jack Levant & one other manager which I do not remember his name that I would return to apply for financing for the car after I secured a mortgage for a house that I was buying & hoping to close within the next few weeks.

On 10/15/09 I visited ParagonHonda.com & seen this came car listed for $15,878. I called David at ext 142 & left a message explaing what I had just seen, he never returned this call or the other calls that I placed for him over the next four days. When I finally was able to get intouch with him on 10/19/09 he claimed to have no knowledge about the car being listed on thier website for under $5,000 less than what he told me was the list price. He placed me on hold & within a minute his manager Jack levant came on the phone & told me the car was sold. I asked that my deposit be returned to my credit card & gave him the credit card # again. On 10/21/09 I called jack to ask why the deposit was not returned to my account & he told me that he thought I wanted him to hold onto it towards another car that I may purchase from him in the future, I informed him that was not my intentions & to return the money that day. I also informed him that I was intouch with the legal fund through my union who informed me that Paragon Honda was in breach of contract. When Jack heard this he told me to sue him for the deposit & hung up the phone on me.

I called back to Paragon Honda on 10/15/09 and 10/21/09 & gave a false name, I spoke with an employee by the name of Jessica both days who infomed me that the car was still available for purchase at the advertised price of $15,878. I also spoke to Jessaca again on or around 10/24/09 & I explained to her what had happed & asked her to ask Jack to return the money, she said she would ask him.

As off 11/12/09 the money has not been returned. Anyone know a good lawyer?

What happened to the 2006 Honda?

What happened to the 2006 Honda? I thought you had a contract on it and that is why you left the deposit. What happened to that contract?

Hopefully you have something in writing from the dealer voiding or cancelling the contract on the 2006 Honda. If you do, then taking the dealer to small claims court to recover your $1000 would be the way to go for you. Otherwise retaining an attorney to get the return of your $1000 might not be cost effective for you.
