Paypal , T-mobile , ebay Sold iPhone on ebay.. Funds sent thru paypal.. Tmobile inaccurately told buyer iPhone reported lost/stolen. Funds taken out of my account..there is a lot more to this story California

We bought an iPhone as a gift for our daughter right around Christmas.  Tmobile had a monthly payment plan to pay the iPhone off.  We decided to sell the Iphone because  our daughter wasn't responsible enough to keep it.  Tmobile said to set the iPhone to its factory settings before selling it.  We sold the iPhone on ebay around February 13, 2014.  The buyer was happy with the purchase and thanked me for prompt delivery.  The buyer said the iPhone was working fine.

The following month my wife went to tmobile to make a payment on her account. Tmobile said because we DID NOT pay off the phone yet, the iPhone we sold the buyer was still on her account.  Also WE SHOULD NOT HAVE SOLD THE IPHONE WITH THE SIM CARD.  Tmobile said we need to deactivate the SIM card or my wife could be liable for any long distance charges plus the SIM card could have personal information on it.  When tmobile deactivated the SIM card the buyers iPhone stopped receiving a single Which meant it no longer worked.   The buyer said she called tmobile and she said they told her that the iPhone was reported lost/stolen.

On March 15 the buyer wrote me and told me what happened so my wife called tmobile right away.  We told Tmobile what had happened and they said to pay off the iPhone completely and it will be taken off my wife's account.  Tmobile said tell the new owner to get a NEW SIM card and the phone will be as good as new. The next day my wife paid the iPhone off completely.  I wrote the buyer apologizing for the inconvenience and said there would be no further issues.  

The buyer then requested a refund because she claims Tmobile told her the iPhone she purchased was reported lost/stolen and that we filed a false claim to get a new iPhone.  THAT STATEMENT IS SO OUTRAGEOUS AND NEVER HAPPENED.  The buyer first contacted me and asked for her money back.  I told what had happened with the sim card and told her once she got a new SIM card her iPhone would be up and running.  When I denied her refund request she contacted paypal and filed a dispute.

Paypal informed me of the claim and let me and the buyer each write our side of the story.  The buyer wrote paypal tmobile told her the iPhone she bought was reported lost/stolen and the previous owners had filed a false claim to get a new iPhone.  The buyer also said if she did not get a refund she would file a report to the authorities that she was sold a stolen iPhone.

These accusations are so far from the truth.  I wrote that I informed the buyer on the SIM card issue.  I wrote that by deactivating the SIM card on her iphone it flagged the iPhone and stopped sending the buyers iPhone a signal to work.  I also wrote that because we had not paid off the full balance of the iPhone tmobile must have automatically reported it lost/stolen. I wrote that we corrected all those issues by paying off the iphone on March 17, 2014.  I wrote because the iPhone was fully paid off all that was needed was a new SIM card.  I told paypal we have proof of purchase for the iPhone.

Paypal wrote me saying they would review both statements and would contact me if they needed more evidence. Paypal said the case would be settled before April 6, 2014.

On March 26, 2014 Paypal sent me an email stating thet were in favor of the buyer and they had deducted the $405.15 from my account.  Paypal never asked me for my proof of purchase of the iPhone.  Paypal never let me show my Tmobile account invoices proving we never file a claim or received another phone on a claim.  Also, Paypal informed me the buyer filed a report to some Authority saying she bought stolen property therefore Paypal will not be sending me the iPhone back.

I just got ripped off from Paypal in the amount of $405.15 and an iPhone.  I feel paypal did not give me any chance to show evidence of the FALSE CLAIMS brought on by the buyer.

I BEG, PLEAD AND ASK for your help to fix this RIP OFF ...   I ABSOLUTELY POSITIVELY DID NOT SELL A STOLEN IPHONE.  I ABSOLUTELY POSITIVELY DID NOT FILE A FALSE CLAIM TO RECEIVE A NEW PHONE..

PLEASE HELP !!!

Interesting how you talked about the lack of responsibility of your daughter..especially after looking at some of your actions.

You purchased a phone on a payment plan that T-Mobile offers.  One of those terms of the payment plan is that if you disconnect service on that phone the remaining balance is due immediately.    So when you sold the phone and FAILED to pay off T-Mobile it is still your phone.  In fact you are now up several hundred dollars.  So of course it is still working for the other person. 

Now, your wife goes into the store and they say that she is still responsible(which is correct).  So they deactivate the SIM card.  But your wife still fails to pay it off.   It isn't for another few days until you finally pay it off.  It is very hard to believe that it took all the way until March 15th and by your report at least 2 contacts with T-Mobile before they mentioned it had to be paid off.

So in the end yes when you deactivated the SIM card it was reported stolen.  So after all of this sorry to tell you but if I was the buyer I probably wouldn't want to deal with you anymore either.

 I told paypal we have proof of purchase for the iPhone.

- You are accused of selling a Stolen Phone and you just TOLD them that you had a proof of purchase?  Why would they need to ask you for it?   How come you didn't send all of this information in the first time?

What you should have done is to pay off the phone, remove it from your wife's account and then sell the phone.   Unfortunatly your only action is to deal with the buyer.  Perhaps write them and see if they will return the iPhone if you pay for the shipping?  If they refuse then you may have to file a Small Claims case against them for the price of the phone..or the return of the phone.   In court you can state your side..and this time actually bring your proof.  As long as you can prove it isn't stolen you should at least get the phone back or may get the money that was originally paid.  Hopefully the buyer is close by.
