This report is about law firms going after small businesses under the "guise" of enforcing the ada act americans with disabilities act
I think, just by looking at the sheer volume of cases they are doing it for profit ( at appx $8000 settlements per case times over 2000 cases) it is big money.
What I am focusing on here is just in the San diego area, nation wide it is enormus.
The lawer Pinnock had hundreds of cases on the books in federal court.
one of his "clients" Mr. Gash has many also ( all using Pinnocks firm) below is just a few, I have found hundereds by cross referencing them on the federal court acces site.
I found most settle out of court for about $8000, the ones that go to court ( at the request of the persons being suied) seem to be setteled in favor of the small businesses, or thrown out of court by the judge, never going before a jury as requested )
my advice ( request) it spread the word on this, make them ( and all the other lawyers that are doing this for profit) take every case to court.
also, complain to your local congress persons, the media, ect.

I have heard ( as we all have) of this going on, but until I actually looked at the federal court site and saw the volume of cases it did not have much meaning.
also, looking at the complaints being filed, it appears to be generated by a word processing programme, and the lawfirms just insert the names of the persons and businesses.

A sad Case

Unfortunately there are not gonna be very many businesses left in Julian. They were alreaqdy damaged by the fires 2 years ago, and I talked with one business owner and they do not have the $$$ to fund what this "victim" sueing him for. According to my friend, Pinnock, or whatever his name is, had never even tried to enter in his shop.
Julian is gonna really suffer so this guy can make money. Reminds me of that book "King of Torts" by John Grisham.

This same lawyer has threatened to sue an entire community called Julian in Southern California. This is a prime example of why the ADA laws need to be reformed to prevent abusive lawsuits.

I have had client victimized by this type of lawsuit. In 99.9% of these cases, it is cheaper to get the the ADA violations fixed and the extortion money than to hire an attorney and fight the lawsuit.
The ADA has been around for over 10 years and there is no "grandfathering" under this law. The best thing you can do is hire and ADA compliance expert and get into complaince. At the very least, make sure your handcapped parking signs and stalls are all properly posted and marked. Handcapped parking violations are the first thing these "victims" look for.
Finally, write your senators and representatives to change the law. There should be a "safe-harbor" clause added to give businesses time to comply after written notice if they are unaware of the violations.
