Deceptive business practices. Ricj Benner comes to your home and sells you a pool, promises all sorts of things, gives a really good discount then changes the contract and gives a different copy to his Mom (Barbara Benner). Once she finds out the amoutn of the discount she will nickel & Dime you to death to get it back. Every step of the way she was trying to charge us extra for something that was aldready included in the price of our pool. I spent so much time going back and forth trying to sort things out with her. Once Rick signs the contract he is no where to be found. We paid them the amount of ach draw check as it was requested for each stage of the process. Rick told us that if we purchased mosaics our selves (cheaper than the tile company he uses would sell them for) he would install them for us. It is stated on the contract and he did not charge us for them. Then of course when it is time for the plaster to be done...Barbara comes along and trys to charge us $150.oo to install 4 inch mosaics of little fish. Once again Rick is no where to be found to back up the contract and Mom Barbara will not finish the pool until we pay her the $150.00!!!! this is riduculous. They are a mom and Pop shop with no ethics or business sense. STAY CLEAR OF THEM!! This pool was suppose to be a pleasuralble experience and it had turned into a nightmare. They tore up my yard and ruined my irrigation system...riped out the electrical for the system and brake every line including the main pipe. The horror goes on and on!
Now, I have to pay an attorney to get them to finish the pool and fork out more to repaire the damage and find a plaster contractor.

I plan to but them out of business when this is all said and done!

Just to set the record straight for Pleasure Pools, all comments and communications are jointly reviewed and approved by Daniel & Misty. It seems that Barbara has an issue dealing with women. To be clear, this is Daniel replying to Pleasure Pools' (PP) rebuttal.

By the way, it is beyond belief how Barbara portrays women in general in a negative and juvenile way - Beware of women's wrath uhmmm, a little mirror effect here?

In reference to "Pleasure Pools is always willing to cooperate with a customer to resolve issues.", please have Barbara explain how is PP trying to resolve the issues with us. Their tactic so far has been "Pay me first" and then we will address the issues. They want 100% payment when the job performed is sub-par and not finished (example, stacked stone wall), PP wants a 100% payment when the pool is smaller than the contract and drawings (there excuse is that the pool will look beautiful at the end), PP wants 100% payment when they installed spa lights instead of pool lights, PP wants 100% payment before plaster when the forgot to build the pool's overflow...and so on.

Also for the record, both Daniel and Misty are respected professionals occupying important executive positions with major corporations. Daniel is the Corporate Treasurer for 3 oil related business and Treasurer of the HOA. Misty was the Vice-president of a commercial construction company and currently the account executive for a major commercial firm. Both Daniel & Misty have earned MBA degrees. Both Misty and Daniel are well respected in the community. We have never have had problems with contractors working on our home - and we always consider them as family (we will provide names and munbers upon request).

The problem for PP is that they encountered a customer that discovered some of their very unfair and deceptive business practices. This is not in any way intended to slander PP, but to state the facts and prevent potential pool buyers from making the same mistakes that we did. We acted in good faith and believed that PP would do the same by building a quality pool, according to conversations and drawings presented during the bid process. However, Pleasure Pools did not honor their word and commitment, they are not acting in good faith, and is using a very vague contract to cover their omissions and mistakes. But unfortunately for them, there are too manyobvious mistakes for PP to hide. Dimensions, poor workmanship, and sub-par equipment cannot be hidden. So I'm wondering who is breaching the contract here...I'm wondering who is cheating the customer...I'm wondering why PP wants full payment without addressing elemental errors and mistakes. Ask Barbara how many times PP needed to redo the raised beam / wall and redo the coping because they were not following the approved drawings. It's simply a joke.

It does not take a scientist to know that Pleasure Pools is the one in breach of contract and in direct violation of the Texas Deceptive Trade Practices Act (DTPA). As stated by our attorney, PP engaged in unconscionable conducttaking advantage of the lack of the customer's knowledge and/or experience in building pools to an unfair degree.

Hopefully this report will prevent others from making the same mistakes that we did when we hired Pleasure Pools.

Since Barbara invited potential customers to contact PP, I will provide a list of questions to be asked:

1.- How many employees do you have?
2.- Is your office also your home?
3.- Please provide names and numbers of your sub-contractors. Do you owe them any money?
4.- Are your sub-contractors properly licensed, especially the one performing electrical work?
5.- Please provide a copy of your contract, to compare with others.
6.- How do you measure the perimeter of a pool? Is the spa, waterfall, fountain, etc. part of the overall perimeter?
7.- Please provide payment and construction schedule. Also disclose when the equipment will be delivered.
8.- Is there a reason why your company wants 100% payment before the satisfactory completion of the pool?
9.- Please provide a detailed list of the equipment you are planning to install, including size, brand, specifications, etc. Please detail the cost for each.
10. I heard from a past customer that you installed spa lights (instead of pool lights) in their pool. I also learned that PP did not install an overflow as promised. Could you please explain.
11.- Would there be a supervisor on the jobsite, overseeing the sub-contractors job? Who is the supervisor?
12.- Will I receive courtesy calls from PP at least 24 hours before the sub-contractors show up?
13.- Do you offer weekly or bi-weekly clean ups? Please specify frequency of clean ups
14.- Do you have insurance? Please provide a copy.
15.- Are you responsible for damages to sprinkler systems, sewer lines, etc?
16.- Would you meet me to select finishes such as tile, plaster choices, etc.?
17. Would you measure the pool layout with me before excavating to make sure dimensions are correct?

To Prospective Pool Customers: Regarding (2) complaints by (2) women

Pleasure Pools has been building pools for more than 25 years...we aren't perfect but we try hard to please our customers. There is no way Pleasure Pools can fight back when facts are distorted and people can say whatever they want on a site like Rip-Off. There are always (2) sides to a story.

Ironically, the two complainants are similar personalties. Both tried to ignore the contract when it suited them to do so, and both thought they deserved more than the contract specified. Both had a problem discussing issues and both used sarcasm and temperment to try and intimidate us. Dayna's pool was paid in full. We continue to honor our warranty. M&M is in breach of the contract for non-payment. If asked, Pleasure Pools will gladly explain the facts behind every allegation in both of these complaints.

Pleasure Pools is always willing to cooperate with a customer to resolve issues. But there are times when a customer will not be satisfied. Sites like Rip-Off allow people to say anything they want and not be liable for untruths and misrepresentation of the facts. This is all about 'beware of a women's wrath when she doesn't get her way'. Reason does not apply. I am having the same problem with Pleasure Pools - wish I had found your report sonner!

We started building a pool with Pleasure Pools this summer.....I read your story and it sounded as if I wrote it myself! Much of our experience with Pleasure Pools is idetical to the experience you describe.

Rick Benner supposedly left the company after we signed the contract (basically sold us down the river).

d**k has been building whatever pool he wants to build, whenever he wants to build it - with no regard for the contract documents, pool sketches and bid process documents. .

Barbara is the guard dog who verbally abuses me whenever i call requesting any information on the pool schedule (or the sink hole forming due to the underground plubing leak, or the ac that they disconnected, etc. )

All the whiile our dogs stay penned up all summer long awaitig for the pool to be complete. Everyday we await a crew that rarely appears to work on the pool.

After 3 months, our pool is still not finished. The yard is a disaster, the quality of the work is poor, the Benners are rude and volatile, the pool is smaller that contracted and not square, the coping is cracking, stacked stone is falling off, the concrete stamp pattern is crooked, sprinkler and sewer lines damaged beyond repair, landscape stones and edging missing, water hoses missing, the whole thing is an absolute circus. We have had to hire a plumber and an electricain to resolve problems that the contractors caused and the Benners were not available to resolve.

All the while the Benners are trying to convince us that the pool is great and per contract...even though it is clearly not! A calculator and some reading glasses could resolve their confusion if they had any desire to resolve problems. They do not choose to resolve anything - they try to frustrate you so much that you will pay them anything just to get rid of them and swim in your pool (even if it is not pool you paid for).

Today, Pleasure Pools refuses to do any more work on our pool until they receive 100% of the contract amount YET our pool is no where near complete.

They have suggested that the subs (mostly illegals without proper liscences and insurance) will be knocking on our door to obtain payment for their work. This is nonsense since we have already paid PPools almost $30k in progress payments which should be more than enough to pay their subs.

I feel deceived and extorted. I feel as though I paid to adopt a beautiful child and received a baby monkey instead. (for men, the analogy is as if I paid for a black corvette and received an old ford probe without an engine and paint job).

I would love to know if you were able to resolve your situation with Pleasure Pools-please let me know!

Once again Barbara (Pleasure Pools) who claims to be a broker and one that "understands legal contracts" is again finding her unscrupulous business tactics under fire.
I am taking time from my busy schedule to set the record straight with facts that can not be disputed or misrepresented as I have all the documentation and will be glad to present at any time or place.

Facts:

1: Rick the son who claims to be the salesman, came to the house and presented a pool that would beat the competition in price and quality. He knew he was competing against other pool dealers and promised numerous items to gain our business.
- The pool size was not built to specifications. The width of the pool is incorrect, the benches where shorter than documented on the contract. We where promised swim area in width and length, and did not even get close, almost 2 feet in width less than what we paid for. We had Pleasure pools over and the Father Rick Sr measured the pool with me, and admitted the pool was incorrect. Once again I have a signed diagram where all parties agreed. The remedy once brought up, NOTHING. Tried to weasel out, but even when you count the flagstone width it still did not add up.
- On the contract we had safety fencing which states greater than 100ft included" with no price attached as the price was rolled into the price of the pool. When the time came to install the fence we received a bill of 656.00 dollars? We asked and were told they set an allowance, but no where on the contract was this allowance written. Although, when I inquired they had a contract that a number was written in, but the two contracts signed I had did not? I would love to take this to court. I wonder what a judge would say. I would think deceptive trade, fraud, and many other things. Pleasure Pools answer, did not have one? Hmm I wonder why?
- Building of the pool was a disaster they came when the weather was wet with the tractor and tore my yard completely up. The first day they show up with a tractor that is to big, then show up the next day after the soil is wet and make huge trenches that go 6 to 8 inches down that rips the irrigation from my front yard. I would understand the back, where the pool is, but once again shows there workmanship. They never came back and fixed the front, and I had to hire a landscaper and put in new drainage due to the mess they caused in the front.

Mosaics-
Facts-
-Rick Jr promised if we bought the mosaics they would install, but once again seems Rick has no memory of this. Although, Barbara who is never at the contract negoitions seems to know all the information that was discussed? Once you sign Rick becomes a ghost and Barbara irritates you with lack of business and social skills where it is better to finish the pool and tell them to leave. Barbara and her husband threatened me and my husband that they would not finish the pool if we did not pay for the mosaics labor. Although, remember they could not build the pool to spec, and tore up my yard, but felt that was just. At this point we wanted the pool done, and had to much invested to start over. Many of the work requests are sent on the plaster, flagstone etc, and wish they would have supervised the work and used quality materials.

Communication-
The facts:

My husband would not talk to Pleasure Pools because he could not stand the poor business practices. My husband actually was the one that gave Barbara choice words, and allowed Dayna to handle the dealings after two weeks into building the pool. Many times he regrets calling them from the start and would have fired them, but too much monies where already sunk in. After first draw you are 15 to 20k in the hole, so you cross your fingers and hope.

Warranty:
The Facts:
The warranty Pleasure Pools commits to is a "JOKE". They do not fix anything they call someone to fix the issue, they have no clue on how fix anything. They are a small business that acts as "Project Managers" for building a pool. Please take my word "Project Mangers" lightly as they have no clue on how to run a project. My husband is certified PMP, and runs multi-million dollar projects, and was disgusted on how they ran the project.
- We do call them to get numbers as we need numerous repairs all the time, as the pool is built with the poorest materials, cheapest labor and little supervision. If they don't service our requests we have no other avenue except to see them in court. So far they have returned our emails. So hopefully won't have to go court, but we expecting to go down that road.
- Just tonight we sent a request for 5 more items, and they where prompt to make sure they are not liable and won't help fix anything. They give you numbers so we can call, and then Barbara changes the contract and claims things are not covered. Please go out the website and review vacuum warranty is one year. Our bag breaks and Barbara says "only 90 days" once again they do not understand a contract is an agreement between two people, not whatever you want it say at the time. I have the contract sitting right here, and make explicit reference to bulbs 90 days, but no vacuum bags, so I guess the consumer should interpret Barbara's logic? Once again clear example Pleasure Pools does not know what a contract is or how to follow one.

Closing-
I have wasted my time and money on a business that should not be in business. I agree websites like these can slanderous, but it sure helps the consumer think before making a decision like we did. Also please check the BBB, they are not listed I wonder why? Lastly, I will be glad to share my experience with anyone, and tell only the facts and let the next person make the decision.

After sorting out the slander and gross exaggerations anyone reading the report filed by 'Dayna' will quickly realize 'Dayna' was complaining about a $150 installation fee for tile mosaics.

A fee we pass on (no profit to us) from our plaster subcontractor. The mosaics were one of several items that 'Dayna' thought we owed her. None of the items were in writing but Dayna didn't care. She thought she should be given anything she wanted and at no cost. The woman's sense of entitlement was amazing! A pool can't be excavated without messing up a yard, and we warn consumers about their sprinkler systems and other utilities underground that could be damaged.

Dayna never had to hire a plaster contractor and there was no damage to repair. There was no attorney involved. All these statements by Dayna were false. I personally spent several hours alone with Dayna making selections and I treated her like a friend -we got along very well until I had to say 'no', then vindictive Dayna showed up.

She was verbally abusive and I refused to talk to her and would speak only to her husband. The pool was turned over in March. Since then Dayna and her husband have no problem contacting us about a warranty issue, most recently 8/25/07. It's strange isn't it that someone who is trying to ruin us would trust us to back-up our warranty-but that's exactly what we have been doing because we aren't the kind of people Dayna is trying to make you believe we are!

It is much too easy for an unscrupulous consumer to tarnish someones reputation on a site like RipOff Report. There oughta be a law! Or there should be a website where businessess could file complaints on unethical consumers; then the scale would be balanced.
