I bought a phone from this guy and it wouldn't work when we put the sim card in it, so we took it to the at&t store and they tried and couldn't get it to work either.

I contacted Mark Larson by email and explained the situation and he said no problem send it back and he would exchange it. I sent the phone back and got signature confirmation of the delivery. He signed for it after leaving it for about a week, and I kept waiting for him to send me a new phone.

Well after a couple of weeks I contacted him again and he acted like he'd never heard of me. I told him I had proof that the phone was delivered to him and his signature on the delivery. He then told me to email him the proof and he would get back to me.

So, I emailed him a copy of my signed receipt and waited and waited and still didn't hear anything or get my phone. I contacted him yet again and he totally ignored me.

So by now my time has run out to file a claim with ebay or with paypal, as he planned I'm sure, and I have no recourse. I contacted him again and told him I would take him to small claims court and he emailed me back that I was bluffing! So now I am in contact with small claims in his county, but I have no street address for him only a PO Box and I would have to be there for the court date, so that is out of the question.

I do still have a couple of avenues to try, though. When I reported him to ebay, they of course could do nothing because the time had run out to file, but they did send me some links for mail fraud and internet crimes.
