My debit card was charged $9.95 as per 'free' promotional offer on March 23rd.  I rec'd the product March 26th. None of the Companys' web-pages contained the words 'Terms and Conditions' (on the bottom of the page) but the checkout page. All of the advertising information leading to checkout implied a literally 'Free Trial' (except shipping charges).

"The SATISFACTION GUARANTEE"

RISK FREE TRIAL    'Here's how the free trial works'

We are so confident that you will love Your Prado E Cigarettes that we are going to give you a 10 day free trial. Your credit card will only be charged the $9.95 or the reduced shipping above. If you are not satisfied with the Prado Electronic Cigarette for any reason, just cancel your membership anytime before the end of the 10 day trial period and you will have no further obligation. If you are happy with the product, do nothing and your credit card will be charged an additional $89.95 approximately 10 days after your initial trial shipment. In addition 20 cartriges willl be sent out with your starter kit when you order your risk-free trial, and about every 30 days thereafter. we will send you another months supply. The credit card you provide today will be billed the low price of $59.95 plus $9.95 S&H. (ETC.) You may cancel your membership during the trial period or any time thereafter by simply calling our Customer Care at 1-800-558-9643.

.............and, JUST ABOVE THE BOTTOM OF THAT CHECKOUT PAGE, when clicking "Terms and Conditions"........

..............IN PART (I can't copy and paste the entire disclaimer for the offer above without logging in and ordering something)

....We make no warranty of any ind regarding this website, the trial offer,The Value refill Autoship Program, or any product or service available on this website, each of whch is provided on an 'as is' and 'as available' basis. We expressly disclaim all warranties including implied warranties of merchantability , fitness for a particulaypurpose, title, non-infringement, and those arising by statute or otherwise in lawor from a course of dealing or usage of trade. We are not responsible or liable for any warranty, representation, or guarantee , express or implied, in with respect to them. Some States do not allow the limitation of liability and disclaimer of implied warranties, so the disclaimers and limitations above may not apply to you.

Anywho...if you do not read the 'Terms and Conditions' (which you are not directed to in their web-ad-format) just above the bottom of the checkout page (the one containing the 'risk-free-trial info above) 'you are liable (in their words)  "If you keep, and do not secure an RMA number  AND RETURN THE PACKAGE in the specified time frame when you cancel your offer (which they do not mention in their obvious trial-offer window) for $149.95 plus S&H.

It was indicated in the Quick Start Guide  that the battery should be charged 'till the USB LED turns green. Mine was green at insertion. Went through one cartrige 'till the device/battery wouldn't function. The pseudo-cig tip started blinking, and the device wouldn't heat the p-glycol/nicotine configuration. 'Thot it could be the cartridges, so I opened a third cartridge (which nullified an aspect of the not mentioned in the 'risk-free-trial' scenario, so I'd be liable for the cost of a cartridge (they only allow the use of two cartridges in the hidden aspects of the so-called free trial). Anyway, I had the use of one cartridge, and a littel of the second 'till the battery malfunctioned, and wouldn't recharge. 'Tho the green LED indicated it was fully charged.

I closed my debit card, and plan to call Prado tomorrow. That's a lot of money for a retiree who has to work to pay for slick legalese and a bad first impression of a faulty product.

Explanation of pictures in my complaint.

The typed pages are their disclaimer of the Prado company's "Satisfaction   Guarantee". (that's the certificate-like window on their checkout-page). (In my pictures, it's on the page with colored graphics).  It contains the words ..."if you are not satisfied with the Prado Electonic Cigarette for any reason, just cancel your membership anytime before the end of the ten day trial period AND YOU WILL HAVE NO FURTHER OBLIGATION".

Their guarantee indicates nothing of the twisted/convoluted reasonng nullifying their guarantee, or their extention of the 'must be returned in 10 days to 14 days. It also mentioned nothing of the $30 restocking fee.

Their guarantee does not specify to direct you to the bottom of the checkout-page, through insisting you must read "TERMS and CONDITIONS"

I'm not a lawyer, but since the Satisfaction Guarantee specifies in the relavant aforementioned paragraphs, "....no further obligation", they wouldn't stand a s****.>
