In mid July, MRC Receivables contacted me by phone stating I owed them for a Discover card debt. I requested the info in writing; they never sent anything to me. I spoke with a rep named Scott by phone and requested the debt amount in writing. He refused to provide the information. I told him I never got any letters from them in the past. He still refused to send anything in writing. I then to attempted to set up payments with MRC, but he demanded an unreasonable, unaffordable amount for me to pay. When I told them I could not possibly make a payment that large, He advised me to borrow the money from someone. I told him I could not do that either. He then told me he could not accept any amount that I offered. He was addimate that I pay at least $5000. I asked to pay on the account monthly, he refused. He told me that wasn't enough money and he could not accept any payment arrangement. He told me to contact him back in less than 24 hours with a payment of a $600. After me asking several times for a lower arrangement, he declined my request completely and advised that if I did not contact him the very next day, he would send my file to a lawyer. By his actions and our conversation, I could see there was a huge rush for me to make a payment.

It seemed weird, because he pretended they had tried to collect the debt, but I never received any information from this company. Nor had I ever heard of them. It did not matter to him, he then told me that they were going to forward my file to the lawyer and start proceedings to garnish my pay. Shortly after that on 8/10/05 Pressler sent a letter stating I owed a debt of over $8000. I responded on 8/12/05 requesting verification of the debt. On 8/23/05 they sent me a partial explanation and advised they would forward any additional information when they receive it. Instead of getting the additional info, they sent me a complaint stating that I being sued. They had my file for less than a month. They never spoke with me about the debt; they did not advise that they would pursue legal action. They did not give me an opportunity to make arrangements, they just filed suit. I contacted them when I got the paperwork regarding the suit. I was told by Sara that even though they didn't provide all the information regarding the debt, they can and will still sue me. I attempted to make payment arrangements with her. I told her what I could pay, she said ok. Then asked for my work information. I advised that I do not want calls to my work place.

I told her that if they got my file from Discover/MRC, then she should have that information. I told her I will not provide employment info. But I would like to pay on my debt. At that point she refused to setup the arrangement, because I would not provide her with my place of employment or my wages. I told her that I would pay on the debt, but I was not giving her that information. She then demanded that I pay the full balance. She stated if I don't give her my work information, they will continue the law suit and will not make payment arrangements for me to pay down the debt. I asked her, how can they sue me and they never made any attempt to collect the debt. They had my file for exactly 1 month when they filed the suit. She stated the suit was filed to protect her client's interest (MRC). There is nothing I could do except give her the employment information. I still refused. When I checked my credit report, it shows a zero balance due for Discover. The debt was paid, but by who? How do I find out if their insurance covered my debt. They are saying that I broke the contract.

Well I never had a contract with them verbal or otherwise. Does anyone know what I can do about this? I do plan to go to court and have a jury hear the case. I will be filing my answer within the next 24 hours
