WARNING: DO NOT WORK WITH THIS COMPANY

- PromoModels is one of the best run scams I've ever encountered. Somehow, they seem to keep themselves "legal". You don't have to take my word for it but, if you work with them you run a high risk that you may not be paid!!! Good Luck!!

PromoModels does not pay as per contract. They don't pay within 30 days, 60 days or even 90 days. If you are lucky to receive a response from anyone at the company after you work is completed, you will most likely be given endless excuses as to why there is a payment delay. Perhaps they are extreemly busy, backed up, can't pay before others ahead of you, a holiday break made it hectic, busy mailing tax forms, money is tied up in an escrow account, family in a tragic accident and had to become a caretaker to mother who is sleeping in hospital, . . . Although, you may not get paid just because the owner decides he doesn't like you or you might be viewed as impatient or maybe he decides he is being harrassed for payment. Imagine that?

A con artist is often involved in fraudulent activity and is an expert at organizing deceptive tricks and schemes driven by greed and dishonesty to shyster other individuals out of their entitlement. It appears that PromoModels may be involved in operating a business scam of cheating and vicimizing contractors/employees out of compensation owed. An attempt to swindle contractors/employees is not a reputable business practice and the perpetrators continue to withhold payement through the use of deception, intimidation and threats. Pocket the profits from your labor and cut YOU out!

I am writing this report because I am concerned about my situation and would like to warn others so they don't have to suffer this type of experience.

MY EXPERIENCE

Promo Models Account Executive Brittany Sims staffed me to work in early March 2008 with one of the "clients". I completed the assignment turned in all of the paperwork. . . The contract stated that I would be paid within 90 days. In other words, I should have been paid before June 1, 2008. I have received no payment and continue to receive smoke and mirrors treatment from this company.

Equally important, I accepted another assignment with a co-worker from Account Executive Kelly Miller as the program manager of a two week market mobile tour which transpired during late April 2008 - early May 2008 for a different "client". The tour was completed and all paperwork was turned in for this program. The contract stated that I would be paid within 90 days. Neither my co-worker nor I have been paid and it appears that we will not be paid by August 4, 2008 or ever when payment for this assignment becomes past due. Later in my report, you will read that Kelly says this is a lucrative event. . . I would like to ask lucrative for who?

The employees at PromoModels have avoided maintaining their financial responsibility and have no plans to pay. I remained in communication with Brittany Sims until I was informed in April 2008 that she no longer works for the company. I was refered to Lauren Hargrove. I communicated with Lauren exclusively through email during late April & all of May until I attempted to call her in early June 2008 because she left me in limbo about payment for my March 2008 work. I finally reached someone in the office who told me that Lauren no longer worked there. Another person gone!

Suprisingly, I was provided with the owners name and contact information. Lucas Beddows claims to be the owner. He is not easy to reach but, I spoke to him in mid June and early July 2008. However, Lucas was full of insults as he told me that he would never pay me and his company will never pay me ever!!! He said that he instructed his new book keeper Hillary to never pay me either. Furthermore, Lucas threatened that if I contacted him again he would come to Arizona and rip my throat out of my head. . .

In any case, I have invested a number of hours and days with attempts to collect more than $1,000.00 that is owed to me by this organization. I want all readers to know that PromoModels has been paid for the work I did for their clients and has pocketed the money but refused to pay me. Did you know that Promo Models is also associated with The Agency, Inc., BrandStaffing and On Point Marketing? Is it possible that these various brands allow the perpertrators to use bait and switch techniques on victims?

If you're reading and trying to figure out how to collect payment, does any of this look closely related to your situation? Those of you who are already involved in this scam will understand what is happening here.

Here are some examples of email communication I received:

Hi!

Please call me if you have any questions! 858.342.1629

Things to Remember When Working For Promo Models:
Please make sure that your profile on Promomodels.com is complete and accurate, particularly your address. This is what we use to pay you, and this is typically done within 90 days of the completion of the promotion. If the check needs to be cancelled due to the fact that you did not provide the correct information then you will be charged $20 out of the compensation you are owed.

You are being hired by us to promote for our clients; this means that you may not discuss with our clients anything about the way that you were recruited, your previous work history with us or your compensation. When in doubt, you can always tell them how long you have been a member of Promomodels.com, but please do not discuss which other clients you have worked for if any.

If there is an emergency and you are not able to fulfill your commitment to this promotion, you must contact me before 48 hours of the start of the event. In order for your cancellation to be valid, you must speak with me directly with your reasoning. Please note that if you cancel or no show for an event, unfortunately, you will no longer be eligible to receive work from Promomodels.com or any of our affiliated companies.

Promomodels.com is Americas leading Promotional Model Staffing agency, and as an elite member of our company, we expect you to uphold all the standards that we have set. Please feel free to call me anytime if you have questions or concerns. As your Account Executive, I am always here for you.

This should prove to be a lucrative event with a great client. Youll be able to add some credible experience to your resume while having fun at the same time!
If you have any questions or concerns at all just email me or you can call me on my cell during off-hours at 858.342.1629.

First of all I want to say thank you for your patience. I just wanted to let you know where everything stands. This quarter has been very hectic and we have been trying to catch up. I want you to know that we have not forgotten about the event you worked for us and we understand that payment is past due. Please be as patient with us as you possibly can as we are working our hardest to get everything caught up. You will receive an email when your check goes out. Make sure to add my email address to your Anti-Spam filter to ensure you get this (Spam filters like the word "promo" in our email and block us all the time).

Payment is also sent to the address on your profile so make sure to keep that up to date.

You will be alerted through email once your check has been cut and sent out. Please note that you MUST have sent in your W-9 before your check can be mailed. Otherwise, Accounting will hold onto it until we receive your W-9.

Again, I do not have an exact date as to when you can expect your check but know that we are working our hardest and thank you SO much for your patience. All inquires about checks can be made to me, not your account executive as I see when checks go out. Thanks again! We appreciate you and your hard work!

Hope this helps clarify things.

Thanks again!

JUST TO REVIEW:
Can you believe the AUDACITY of these people? As you have read some of the statments in the emails above give some thought to what is really being said here. ". . .have a great day :-) . . . you will no longer be eligible to receive work from Promomodels.com . . . I figure they are laughing all the way to the bank and proud of their scamming ability. However, the scamming doesn't stop at the emails.

FYI:
Just to let you know, most of the addresses and phone numbers associated with this company appear to be bogus or non-existant. For example, the company appears to be located 3453 Ingraham Street - 190 San Diego, CA 92109. Although, 190 isn't a suite it is a mailbox number. The address belongs to First Class Mailboxes & Services. Call them at (858) 274-6245 and you can ask about PromoModels. I figure you will hear something near the same information I did. All I can say is Good Luck!

Also, a reverse search on the PromoModels phone number (858) 490-5600 reveals an address of:
On Point Marketing
4475 Mission Boulevard - Suite J
San Diego, CA 92109
I checked the address and it appears to belong to:
(What a surprise? - Check yourself and see if you find anything different)
La Jolla Capital Corporation
4475 Mission Boulevard Suite J
San Diego, CA 92109
Phone: 619-483-8600

Next, I did a domain search on www.promomodels.com and other affiliated sites - the results of my search:
(Go ahead and check the phone numbers and address out for yourself and you'll be amazed at how none of them will put you in contact with the company. Although, the phone numbers listed might connnect you with Qwest Directory Assistance. Maybe you are supposed to request a number for PromoModels from Qwest???? Or maybe, it is all a sham of smoke and mirrors!!!)

It's not a scam really????

AUTHOR: unhappy model - (United States of America)

POSTED: Thursday, December 03, 2009

First of all if this is not a scam then why have so many models reported not being paid and give the same exact story as this individual?? I AM ONE OF THESE MODELS AND HAVE STILL NOT BEEN PAID FOR AN EVENT I WORKED IN 2008!!!! EVERY time I try to contact someone for your company, the phones are disconnected or the reps say the "don't work for you anymore". WHAT IS THE FREAKING DEAL HERE?

What IS grounds for a lawsuit has already been told to me by my attorney which is breach of contract on your part!  GET READY FOR A CLASS ACTION BABY!!! My attorney has already been in contact with many many models that have "worked" for you and not been paid.

THIS IS A SCAM COMPANY-DO NOT BELIEVE ANYTHING THEY TELL YOU!!!!

File a complaint with the California Labor Board!!!!!!!

AUTHOR: Nottobetakenlightly - (U.S.A.)

POSTED: Sunday, June 14, 2009

Every model ripped off...the San Diego I-Team wants to hear from you...so far only 19 have come forward and filed official complaints with the state of California....I have tried getting a group together for a class action but no one seems that interested in doing it...at the very least please file a report with the state of California so this company will be shut down as they are still operating on the internet and I still get emails from them for work even though they never paid...WTF.....

The I-Team's quote see below

It's perfectly logical that we would look for Beddows wherever we thought we could find him, including the Judo School. After all, he closed his office and his P.O. Box; he wasn't at home and the phone numbers we had for him were out of service.

Meantime, we want to hear from other Promo Models who haven't been paid. The California Labor Board wants to hear from unpaid models too. They already have 19 complaints statewide about the company.

#9 UPDATE EX-employee responds

Scammed in Boston

AUTHOR: Cara Maria - (U.S.A.)

POSTED: Wednesday, April 08, 2009

I worked for them before and was paid in the allotted contract time. The second time I worked for them.... it's been over 2 months passed the contract time and still no payment. Numerous emails and phone calls have gone unanswered. I also can not find an accurate address to send a legal letter to.

All that work.....I can't believe I got scammed. They owe me over $800.....
I just don't know what to do anymore....
I know for a fact that the company i worked for already paid promomodels in advance double what I was being paid. I saw the invoice.

no matter how polite i was- i get nothing back. i just don't want to give up though. it's just not fair...
------------

Hey girl-
Just asking for simple honestly and courtesy of response. Remember the conversation I had with you before I agreed to the job- I was concerned about payment regarding my friend who worked a promo-model event in April and never got paid. As of now, she still has not been paid. Her contract was only for 90 days to get paid.

I, however, agreed to work the event because you stressed that the client really wanted me due to the fact that I was a psychology major. You also told me that Promomodels had taken out a huge loan and could pay the girls in time. It's been 160 days as stated in the contract and I have not been paid yet.

I need to know if the check is on it's way or if I need to get a lawyer involved. Not only am I a psychology major, but also a criminal justice minor. I interned with a very reputable attorney for an entire semester and he will be more then willing to help me get the money I worked for.

Promo-model already received the money in full before the event even went on. I have been in touch with the clients and they showed me documents saying how they already paid the company for my services. I just want to be paid for my time worked.

Any help or information would be appreciated.
Thanks,
Cara Maria

Hi, Cara!

*Please let me know you've read this email and are able to open all attachments! *

This is in regards to your event Aug. 14th-17th, 2008 > > > > . Please find attached all of the following documents:

Event Details Document

Independent Contractor Agreement

W-9 (attached in 2 formats in consideration for your computer's capabilities. Please just send back one)

*** If you have submitted both the Contract and W9 to Promo Models from a previous event, you do not need to send in the documents again ***

Simply type in your name as the signature on the Independent Contractor Agreement and email it back to me (or print out, sign and fax back).

The attached W-9 needs to be returned to us before you are paid. If it is not returned then you cannot get paid. We will not wait on you to return this to process payroll so it needs to be returned within 5 business days of your scheduled event. It must be fully filled out (legibly), signed and faxed back to us 858.430.3431. This is essential as you are technically an independent contractor and are responsible for all taxes from earnings. Also, you must make sure the address in your profile matches the address on your W-9. It is your responsibility to edit your profile with your correct address.

Things to Remember When Working For Promo Models:

I need you to understand some key points before you work for us:

Please make sure that your profile on Promomodels.com is complete and accurate, particularly your address. This is what we use to pay you, and this is typically done within 180 days of the completion of the promotion. If the check needs to be cancelled due to the fact that you did not provide the correct information then you will be charged $20 out of the compensation you are owed.

I am also a victim of PromoModels (and I stillllll have not been paid for work I did in July/August) and I cant believe you all are defending yourselves and your organization against models that have been ripped-off! YOU ARE NOT A LEGIT company- LEGIT companies PAY THEIR EMPLOYEES!!! I only know a FEW girls that actually got paid (though NEVER with in their contract time), and of those few, their check actually bounced.

And to miss-Employee that thinks these are "libelous statements", you obviously do not even know what you are talking about....ANYTHING said ANYWHERE is 'libelous', but the info. that this victim brought up is not any kind of grounds for a lawsuit. You just blurted that because your company is being cornered. ANYONE not getting paid for what they were hired for is going to be upset and wanting a lawsuit....so why even try defending yourself??!

**ALSO I heard from some vendors that I worked for that PromoModels said that we (models) were actually paid "months in advance!" uh....helllllo?? That to me is pretty 'libelous' and grounds for a lawsuit!***

And to all those Ex-employees being 'haunted'....it is your fault you got that job in the first place!!! WHAT WERE YOU THINKING??! Did you even know that you are ALSO held accountable to every model that did not get paid??! You all deserve to be 'haunted' for working for a badly run business that does not even pay their employees on time! (wouldn't YOU be upset if YOU were never paid?!) Now- I am not one of those 'haunters', I figure there are other girls better for that. DO all us a favor and give us some beef or at least explain why this company ran so poorly.

Now here is my side:
I am going to work as hard as I can to bring PromoModels down. I have been posting billboards/flyers on college campuses, attending large promo model events to educate models. I have friends in the modeling agency's spreading the news around and talking to clients that have either previously used Promomodels or is thinking to, to search else where!!
...and this is not even including Craigslist, Facebook, Myspace and all my email trains. SO lets all bring this company down the American way and stop the models from even showing up! BTW- for those affected, sometimes the BBB might not be able to refund you...but your state's Labor Commission can!!

I cant wait to see this company crumble and all of its owners left for scraps under our feet!

RE: Payroll Inquiry?

Hi Kim,

I'm so sorry for the delay. We are trying to get caught up ASAP here. We are behind in payments and we are trying to pay out each event in the order it was worked.

I understand this is frustrating but please realize that we are working very hard on our end to settle this issue and you will be paid.

I will send an email when your check is sent out.

Thanks,

Hilary

It's the same message everytime. I can' get through to anyone. I have spoke to the client and know that they pay upfront for the events. Promo models received $60 per hour for us and they don't want to pay us for the time that we have worked.

18th email!

#3 UPDATE EX-employee responds

Unfortunately Trashing Ex-Employees

AUTHOR: Lauren Hargrove - (U.S.A.)

POSTED: Wednesday, December 10, 2008

I am a former employee and unfortunately these reports have followed me from this past job.
Please do not hold this against ex-employees as we are not part of the corporation that is involved in this. Now I am getting calls at my new place of employment.
Those of us that have left do not have anything to do with this company so please don't stalk us.
We left for a reason, please don't haunt us.
Thank you!
Lauren

#2 UPDATE Employee

These Are Libelous Statements

AUTHOR: Pm - (U.S.A.)

POSTED: Sunday, November 23, 2008

First, the individual who wrote this report provided false information and damaging accusations in an effort to harm Promo Models reputation. This is called libel and is grounds for a lawsuit.

Second, by naming specific individuals in this report and elsewhere on the Internet, he has also opened himself up for lawsuits to be brought against him by these individuals, specifically since these indviduals who were named are or were only employees or partners of Promo Models.

Third, he has also attempted to damage the other companies reputations he also named in this report by saying they are involved with Promo Models in some sort of scam. This is grounds for yet another lawsuit.

Fourth, once again, Promo Models is not a scam. But by posting false information such as this report, individuals have damaged the company's reputation, causing it financial damages. Consequently, these individuals will be held responsible for these damages.

#1 UPDATE Employee

These Statements Are Completely Untrue

AUTHOR: Pm - (U.S.A.)

POSTED: Saturday, November 01, 2008

First, this individual has been paid in full.

Second, this company is not a bogus ageny or scam of any kind.

Third, the company is owned by a corporation and not any individuals, including Lauren, Kelly, Brittany, Hillary, Lucas or any one else. They are simply people that either worked with the company or partnered with it. As such, any issues with the company need to be addresses to the corporation, not individuals.

Fourth, every effort is being made to catch up with any delinquent paperwork as soon as possible.
