I have problems with ProServiceTechs. The refuse to pay me unless I sign a non-compete agreement with them. I was never asked BEFORE I went on the jobs to sign it. I was only asked to send a W-9 and direct deposit form. I have been paid for $140 and they owe me $190. Not a lot of money but I did drive 350 miles throughout Ohio and 2 seperate trips in Michigan, busted my but for them for peanuts and now I can't even get paid the peanuts they owe me.

Just to be fair I wanted to share with you the e-mail. Again the trend suggests that these type of companies are bad news. Read the e-mail exchange here and you decide if you want to do business with Proservice techs and Jay Klee. Maybe I am just being difficult but at this point I am not signing anything with anyone associated with this band of brothers (Velocity, The Greatest Phone Company Ever, Inc., Joe Nerd Inc, Nerdy Works, or ProServiceTechs.com )

You decide if you want to take a CHANCE with the company. For what they pay I would just walk away.

Subject: Missing Forms

Mr. N***,

During technician file auditing, we've discovered that we are missing a few crucial forms from you. At this time, we have a W-9 on file and an incomplete direct deposit form. I understand that you do not have a voided check, that is fine as long as you can provide a letter from your bank stating your account number and routing number on bank letterhead. I am also missing your Company/Contractor Agreement as well as your Confidentiality Agreement. You will find these forms in the attached .pdf file. Please return them as soon as possible to avoid future payment issues.

I would just like to be mailed a check. Like the 1st if my paperwork in not ok. At this time I no longer wish to do anymore work for you and do not wish to sign any non compete agreements.

Mark,
I spoke to the owner of the company about this matter and as per his orders, I am to inform you that you will not receive your check if we don't have your required paperwork in. In the very beginning, you were told that payments would not be issued if required paperwork was not completed.

Thank you,

I was not told to sign this before I went to work. Ask the owner if he really wants to start problems? I already have problems with joe nerd. and velocity. Do you really want to be part of the fight? I will not sign anything. I did the work. YOu dispatched me.. I was told by greg that jay assured me I would be made whole by today. I accept vias and mastercard.

Mark,
Actually, I have forwarded several of your blogs and you have already brought my company into the spotlight when it comes to your escapades with the nerds of the world. So your threats really don't hold water to me. Plus we do not want to associate with any contractors/employees or vendors that actually spend any of their lives blogging or reading them.

You were told several times, and it is very well documented with recorded phone calls and emails, that you needed to fill out our paperwork (just like the hundreds of other techs we have around the United States) and that we would pay you for the first set of jobs on good faith (again just like hundreds of other techs). We kind of assumed that you would be an adult, send your paperwork, and live up to your word.

Yes you did do work for us, and yes we have a check waiting to be mailed out.

You are not special, we will not be making an exception for you just b/c you know how to blog. Congratulations.

As soon as we have your proper paperwork in our hands (ie. your W-9, the contractor agreement, and the non-solicitation agreement) you will have a check.

Oh, and don't worry I will forgive your transgressions against my company and your solicitation of Velocity (whether you were working with them prior to us or not) you were asked via our LEGAL paperwork not to solicit, in any way shape or form, our client.

I am asking you as another human being on planet Earth, please hold up your end of this bargain so that I may hold up my end, and we can both move on and you will never hear from us again.

Please also rest assured that you will not be reading any blogs or any information on websites about yourself or your Nerds On Site company from my company or myself. We have much better/profitable things to do with our time than to post or blog our digressions.

I am not going to sign anything. I was not asked to sign anything until after the work was done. If you have anything that proves to the contrary send it to me.

I sent in the paperwork the w9 and deposit form mj sent me. He did not send me anything else. I would not sign such an agreement with the little work you have provided.

At this point you are just as bad as joe nerd. Just a different story.

I don't understand why someone can't simply get paid for the work done. I invested a 14 hour day and 350 miles wear and tear on my car.

I am amazed. Yes I will share this with everyone I can. Not that I want to. All I want is to be paid and go away. I think I might try picketing the novi rite aid on monday and call the local news. Tuesday toledo rite aid. Wednesday in Finley..

This story gets more and more interesting.

Mark,

I will find that information that you seem to have misplaced. Good luck with your picketing, hope it doesn't rain.

Oh, psst..just as a heads up. Greg, Rite-aide, and Fuji's Lawyers are all better than any you could afford.

I am out of this situation. You have my response to the situation. I do not expect or want to hear from you again, unless it is an email with your forms.
Just b/c you don't want to hold up your side, has no baring on myself or my company.

Please don't make this an issue that I have to get my lawyer involved in also. You might want to look up a couple things before you say too much.Libel/slander/defamation of character..things like that. (just incase your not sure..they are legal terms that you might want to read up on before you start getting letters in the mail from guys that have many years of college and a lot of student loans to pay off)

Oh and lastly, hundreds of techs have gotten checks and direct deposits from our company its not that hard to get paid. Hmmm, follow the rules?

This company is definitely a rip off. I did work for proservicetechs, through nufocus. Gander Mountain uses nufocus, who in turn uses proservicetechs. I have been trying for 2 months since I did work back in December 2008 to get paid. I actually sent them my non compete form, too, but that didn't help at all. Their whole excuse they are throwing down here is worthless. They gave me the same reason until I sent mine in, and now they are saying that they haven't received payment. I got in contact with Gander Mountain, who did some research into and found that they paid nufocus who also paid proservicetechs. Greedy worthless company.

Hi Protech Services employee I filled out a W-9 just like any other sub-contractor. The problem was that later they wanted a non-compete agreement. That is not normal nor was that agreed to. So I did the work then they ask for additional agreements. I am glad to hear they are not doing work for Velocity DSL anymore. Frankly I don't think they should be in business. Hopefully other techs are smart enough to google their name Protech Services and find out their scam before agreeing to anything in the future.

Funny thing is I just got an email from them asking me to do more work.

Sorry, Stephn Milton stephenm@proservicetechs.com ProServiceTechs Recruiter I am not interested. Maybe you should look around and see how the company you work for scammed lots of people.

Here is the letter they sent me today.

Thank you for taking the time to look at our company, Professional Service Technicians, Inc. (PST) is a national dispatching company that dispatches jobs across the country. Our primary objective is to dispatch jobs as efficiently and effectively as possible. Currently we dispatch approx 400-500 weekly (and growing). PST is looking for experienced and knowledgeable techs (techs must have experience, there is no training) to have in our database as available techs to handle these service/install calls as they come in. Our current database holds thousands of techs nation wide that are able to accept jobs from our clients.
We have launched a revolutionary new website specifically designed to meet the needs of both our clients and you, the technician. Our online database is updated in real time to provide you with the most comprehensive list of jobs in your coverage area. Finding jobs has never been easier, by signing up you will gain access to our job board and able to view jobs in you local area, print work orders and complete jobs. In addition to these features, you will also have access to 24-hour live technical support (either through ProServiceTechs.com or the client). As jobs become available in your coverage area, you will be one of the first to have access to those jobs (that's the great thing about this website). These are on-call subcontracted job opportunities not a full time job. The jobs pay by the scope of work performed for each job. We currently have over 50 different scopes of work in different fields and each one pays on a different pay scale. We are planning to be flooded with incoming calls in the beginning of the New Year, don't delay.
When signing up please follow the instructions (you will be asked questions twice, this is to insure that you understand everything and you are submitting correct information). You will have to select the state, county, and zip codes within that county that you want to except jobs in. W-9 form, Company Contractors Agreement and a Non-Solicitation Non-disclosure Agreement (confidentiality). The W-9 allows you to be paid legally in the US as a subcontractor. The company/contractor agreement is an agreement between us and you that gives you guidelines of the work and things we require on our job sites. The non-solicit agreement states that PST will be sending you information about multiple clients that you currently are not receiving work from (if you are doing work for them currently this form doesn't apply to that client just the other clients we send you, and still needs to be initialed/signed by everyone). We have agreements with all of our clients stating you will not contact them directly to do work. If you do, neither our company nor theirs will be able to use your services. The other part of that agreement is so you don't share important information with anyone that doesn't have an agreement with us. Please print out all forms and return to our office via fax (813-514-0994) or Email PDF, original notarized copy of non-solicit needs to be mailed to our office.
$19.95/month + One time $25.00 administration fee.
If you do not want to sign up at this time please still fill out the attached Tech Package so that we will have you on file to be able to accept calls. Please understand that by not signing up the technicians who do will have first grab at these jobs and you will be at the bottom of the list.
If you are still interested, please go online and sign up. Don't delay.
Our office is open Monday - Friday 9:00 am - 9:00 pm EST. 24hr emergency service.
Any questions, please call our office at 813-514-2121 or toll free 877-234-9079.

#3 UPDATE EX-employee responds

Techs Beware

AUTHOR: Ex-employee - (U.S.A.)

POSTED: Saturday, October 11, 2008

As an ex-employee I would NOT recommend working for this company. Like many others that went through Joe Nerd, I was rooting for ProServiceTechs to succeed. However, what started out as a nice relationship became rotten when they manipulated the contract retroactively; giving them reasons to delay payment. I have 5 different emails stating their contract terms that appeared to evolve during our involvement. So I could only presume even if you satisfy their paperwork they'll come up with something else to sign giving them more reasons to delay payment.

ProServiceTechs lost the Velocity contract, which is only fair considering a bunch of good techs never got fully paid. It's actually worked out because it just made the GGE network even stronger, which I am glad to be a part of now. GGE takes good care of us: Only a few forms to fill out in the beginning that have never changed and don't require notaries, administration takes our suggestions to make things better, and we get paid on time every week.

I hope to spare others from this frustration by forewarning anyone on the fence. We have a rough economy ahead of us so why risk your time and money with companies like ProServiceTechs. I wish all of you techs the very best and good fortunes!

#2 UPDATE EX-employee responds

It's like any other Company.

AUTHOR: Zanza - (U.S.A.)

POSTED: Sunday, September 28, 2008

ProService Techs is like any other company. you have to fill out paperwork to get paid. W-9 form for government purposes and the Employee contract is just like any other employee contract ive ever signed before. Theres nothing more at risk here than giving your information to any other company when you work there. It's legal documents that all companys have to report to the IRS. The ProSerivce Techs employee contract basically said that "I will not give away important company/customer information" and "For at least 1 yr I will not work for another company like ProService Tech"

It seems like to me you misunderstood the contract. I know I was told I had to fill out the W-9 form and the company contract to be paid before I started. You can pick between being paid by a check in the mail or Direct deposit, but no matter what you have to fill out the W-9 and company contract to be paid. It seems there is where you failed. To assume that a company will go ahead and pay you when you do not follow I've done a few jobs for them and they paid me a fair share for the easy work that needed to be done. The hardest part of the job is driving to the stores they dispatch you too, but for further stores I was paid extra for the mileage and time.
