I hired Elizabeth, the owner of Pure Creative out of Cincinnati to create a web page for a business I was starting. The agreement was to make 3 payments of $300 along different stages of the development process.
Upon first payment everything seemed to be going fine with the design process, no issues. Samples were sent and I liked the work that was being done in terms of the design.
After the images for backgrounds were finished for the 4 pages I was having built 2nd payment was asked for to start the next stage. Payment was made. Text content was asked for which I said I would work on. All work stopped at this point because I could not provide text. Even though there were other aspects like the inventory engine (wordpress, joomla, etc) that could have been created in this time. 2 months passed because I didn't have "content" to give her (I spoke to many other developers after this who ALL stated the content such as text for "about pages", and items to put in the inventory should be done last. On top of this should be done in a way which can be changed and not static.)
Time passed and I wanted to push forward with getting the site done, I made multiple attempts at contact with no answer. When finally replied I was told that she couldn't take on anything more at the time due to school. I said that was fine and let's figure out how much was paid and would like to get whatever portion of the money I had paid for work to be done that hadn't been completed at this point, and to get all files sent to date. She proceeded to also tell me that because I couldn't provide the text and "content" she needed right when she "needed" it that I should wait for her to have time to resume work. And that I should help her out with that, also that I don't get to put a hold on things whenever I want and expect her not to do the same. Ding ding I'M PAYING YOU, yes I actually can.
She proceeded to tell me I owed her the final balance for a complete site, and that she had uploaded files to a ftp server and to just get them off of there if I want them. WOW. After arguing via different forms of communication for hours she finally started sending files. The home page and about page which were "completed" consisted of images and about 20 lines of basic HTML code. No "featured items, sold items, news", or anything field discussed. The inventory and about page were nothing more than photoshop image files.
On top of this she started to insult me personally when I insisted that I would take legal action if she didn't send me the files.
The following day I hired a new developer, gave him the files I was given and he said it was probably $150-200 worth of work. I also asked another girl I know that does graphic design what she would have charged for the same work and she estimated $200-225. Yet I paid $600 for 4 photoshop images, and was asked for another $300 before she would give me anything.
Be careful before hiring Elizabeth/Pure Creative for anything! Photoshop work is mediocre at best for professional prices, I can't comment on the coding because none was done, yet part of my $600 was for 2 "completed pages"!!!
The new developer has proceeded to implement ALL of the fields I asked for, the inventory, and code the site to near completion in a matter of 1 week with no "content" needed from me like Pure Creative insisted had to be given before any further progress could be made.

Rebuttal with misleading information

The terms of the contract did no have set dates as the owner said "we can just change those when we need to". Also the terms of payment was 3 payments of $300 with the third being paid upon delivery of final product. 2 payments were made for 4 photoshop files and basic html I learned in Intro to Web Development. Owner declined to finish work but still asked for payment.
"To: Elizabeth E.
Owner/CEO of Pure Creative,
After an insult to personal character and claims of harassment there will be no further work between Pure Creative and Hobo's Mandolin. The agreement was that final payment would be made up delivery of a completed site. Also stated in the agreement was that FileMaker would be implemented into the site as a form of online inventory management. Since this cannot be completed as no request for the program has been asked for, the website is in no way shape or form completed. The terms and conditions state that if either party would like to discontinue work no further charges nor work will be incurred. On the 15th of October you stated "No its not that its called I'm taking a full load of classes and summer is over and I'm working. it has nothing to do with interested. speaking of I have to get back to studying for my spanish test, it's up to you, i just cant take on a lot right at the moment". to a response of "You haven't seemed like you are interesting in doing it anymore so I wanted to know if you wanted to just wrap up what is done and I can have it finished elsewhere or if you wanted to continue and finish". You yourself stated that the site was not complete and to let you know if I wanted to have it finished elsewhere being that you do not have time. When I opted for this choice the sudden balance of charges came were brought up. You cannot state you do not have time to take on the work and still ask for more payments. Please package together what is done and deliver it so I may pass it along to have completed with the features it needs to have.
Best,
Joseph

Sent from my HTC Touch Pro2 on the Now Network from Sprint."
The site "isn't working" because I choose to have that way while I negotiate the purchase of another business of which I will likely adopt the name and website.
Use at your own risk.

Final Payment Not Received

The owner did not fulfill the final payments of the web design project. We could not complete the work. He returned outside of his contract 6 months later after disappearing without finishing payment. We provided photography images we designed specifically for the client and did not finish coding due to lack of final payment. If the client found someone less expensive he clearly got what he paid for because his site does not work properly and still used our imagery on his website. It is unfortunate he would write a report as such when we provided great work in a timely fashion and he was completely unprofessional towards us showing back up 6 months later demanding work be done for his site without paying the last 2 payments of his contract. We have great references from all of our clients which we would gladly provide to any new client. Thank you.
Sincerely,
Elizabeth Eichelman
