I bought a car at Ray Skillman Kia. When it had been in for the 5th repair ticket,(the lemon law requires only 4) we started yelling lemon law. When you do that the dealership goes deaf , dumb & blind. From that point on they hear no evil speak no evil and recognise no evil. They turned there backs on us. All I got from that point on was its out of our hands......you have to talk to Kia. Kia does not want to talk either. We have already filed with BBB and had our arbitration hearing. Waiting on decision.The really bad part of all this is...even if we get the car declaired a lemon, they will "title wash" and it will be in another consumers hands in no time. Contact NHSTA.gov, safecar.org and enter all the info you can about your car. This will be looked at nation wide. Get yourself a consumer action handbook, free of charge at www.ConsumerAction.gov. Arm yourself with anything you can. File complaints with Attorney General and BBB Auto Line. Do business by certified letters only. Don't talk to them on the phone. If they mean it, they will but it in writing. You will have nothing to go to arbitration except he said she said if you talk on the phone to negotiate. Don't do it. It is how we are comming out ahead in this. They will use any tactic to get you on the phone. They will send letters telling you they can't reach you due to incorrect phone number and please call. Dont do it....it is a trap. Pay attention to they red flags.We did. Don't give up. They make it so frustrating that you want to give up, but don't. And go public. Make your info known. Contact the media

Update March 2008-Awarded Replacement of Vehicle

As of march 2008 The BBB has awarded a replacement car after a request for correction was made. It was discovered during arbitration that a repair oder contained a notation" with DPM's approval-shorter. The customer invoice of the very same day states"advised not to attempt any repairs. It is only my personal opinion, but it appears the car was worked on behind the customers back to avoid the lemon law.
Kia Motors America and Ray Skillman have been asked to replace the car with a new 08 or new 07. This is considered proper restitution for the situation. Another option for the consumer is to take the "used" replacement vehicle and address the repair order/customer invoice issue in the courts with a jury trial. An update will be posted when it occurs. Please note: the consumer has never asked for a monetary award to date.

Buying a Lemon can be any car from any manufacturer. Maybe Kia has more and now is too late for me to find out , so I am dealing with what I have. The car has met all the qualifications to have the Lemon law applied. I have the paperwork from the arbitration......getting the Manufacturer to co operate may now take up to 2 years. This is the way the Manufactuers work in my opinion. ........Get your money/keep your money. Time will tell on this one. It's business not personal with these companies.

Lemonvictum,
The first thing you did wrong was buying a KIA. They are JUNK. This is well known. But they are CHEAP so people buy them anyway. First mistake.
You never mentioned what the time frame was on these repairs, or the mileage.
You should give us the mileage on the car currently and what it was on each repair.
We also need to know what year the vehicle is and when you bought it, as well as if the original warranty has expired, and if you bought the extended warranty or not.
If you were under any sort of warranty, you should not have screamed lemon law.
FYI...There is no such thing as "title washing" as you suggest. If this car is taken back under the lemon law, it can only be resold with full disclosure. And, a CARFAX report will show the manufacturer buyback.

When a consumer requests the lemon law in IN, the dealership has no liablity to the car after that. They can not be held responsible for a Manufacturers product.
