Real Manage has used a game of lies, deceptive business practices, and false statements, in an attempt to steal money from me.  Last February I contacted the company to pay my HOA dues and at that time requested that a late fee be removed from my account.  The customer service employee directed us to send an email in and it could be done.  We sent the email and the late fee was note removed, but during this time they also charged us a second late fee. 

As I communicated with the management company back and forth they charged me a third late fee.  When I argued about these 4 late fees they then turned my account over to a law firm for collections and added a processing fee for that.  The law firm said to send them an email explaining everything and they would take it to the board.  I sent them the email, the board denied the request AND charged me more late fees while I was waiting for their decision.

How insave, being charged late fees while waiting for a board to decide if you have to pay your late fees.  The entire time I stand ready to pay in full all of my HOA assessments.  The easy thing to do, waive the late fees and take the nearly $1,000 check I am trying to write. They don't want assessments from me, they want to continue to charge me late fees with their deceptive business practices.

The complaint submitter is a property owner and member in a mandatory homeowners association (HOA), the "Association." The Association is incorporated and governed by the Association's governing bylaws, declaration of covenants, conditions, and restrictions, and policies. These documents are recorded documents filed in the Association's county of operation. The Association operates under the authority of the Texas Property Code Section 209. The affairs of the Association are carried out by the Association's Board of Directors which are elected by the members of the Association. RealManage is a management company service vendor hired by the Association to assist the Board of Directors with the operations and administration of the business affairs of the Association in accordance with their governing documents.
 
The governing documents of the association require every member to pay assessments, or "dues," in order to maintain the community amenities and maintain the associations operations. The failure to pay mandatory assessments in accordance with the Association's governing documents results in a delinquent account and late payment charges. The Association collects delinquent accounts in accordance with their collection policy. RealManage, in turn, bills, receives payments, and applies late payment charges on delinquent balances in accordance with the Associations governing documents and collection policy. RealManage does not receive any benefit of charges applied for late fees or other penalties assessed due to a member's delinquency.
 
Only the Association's Board of Directors is authorized to "waive" a member's late payment charges or other costs of collection applied in accordance with the Association's collection policy, but is under no obligation to do so. Late payment charges continue to accrue on the member's delinquent assessment balance in accordance with the Association's governing documents until the assessment balance due is paid in full. Once paid, late payment charges are no longer applied.
 
Only the Association's Board of Directors can authorize the referral of a member to the Associations attorney for the collection of member assessments. The Association's attorney, like RealManage, cannot "waive" charges without authorization from the Association's Board of Directors.
 
This is a matter between the member and their Association. The Associations Board of Directors has a fiduciary obligation to the members of the Association to govern the Association in accordance with the governing documents. This matter does not pertain to RealManage's business practices. RealManage is contracted to administer the policies of the Association.
