Tessa is the manager of the Afton Ridge apartments, and a Realtor in the State of North Carolina.

 

The Afton Ridge apartments are located at 410 Starmount Park Blvd., Concord, NC 28027, phone: 980-255-8682.

 

Based on my analysis of this situation, I hereby submit this complaint against Tessa, manager of the Afton Ridge apartments, and a Realtor in the State of North Carolina.

 

Here are my thoughts.

 

It appears as though management and or other personnel of the apartments did willfully and intentionally alter our lease at the apartments without our knowledge and approval.

 

It appears as though management and or other personnel vandalize the carpet in the apartment that we rented and vacated at the apartments.

 

After vacating said apartment, we hired an apartment cleaning service to clean said apartment, and we hired a carpet cleaning service to clean said carpet.

 

After management and maintenance personnel from the apartments examined and approved the condition and cleanliness of said apartment, it appears as though management and or other personnel at the apartments intentionally forced a finger between the seams of the carpet and ripped the seams apart.

 

The management and or other personnel then blamed me for ripping the carpet seams apart and billed me for the replacement of said carpet and violating the end date of said lease.

 

Please find attached a copy of the page of the lease that management and or other personnel at the apartments appear to have willfully and intentionally altered without our knowledge and approval.

 

Please find attached pictures of what appears to be management and or other personnel at the apartments.

 

It appears as though management and or other personnel employed by the apartments allegedly took the photographs. 

 

The pictures appear to show management and or other apartment personnel in the process of I think willfully and intentionally vandalizing the carpet in the apartment that we rented and vacated from the apartments.

 

Upon my denial of said accusations, management and or other personnel at the apartments ordered a collection agency, Resolve Partners, 2733 Horse Pen Creek, Greensboro NC 27419, phone: 866-921-5388 to collect payment from me for damaging said carpet and violating said lease.

 

Based on my analysis of this situation, I hereby submit this complaint against Resolve Partners.

 

Here are my thoughts.

 

When I refused to pay the collector for damages by management and or other personnel at the apartments to said carpet and what I think was contract malpractice by management and or other personnel at the apartments, the collector referred me to Trans Union, thereby damaging my credit rating.

 

The collector accepted this account from the apartments with I think possibly no proof of wrong doing by me.

 

The collector accepted this account from the apartments and referred this account to Trans Union with no substantiated proof of wrong doing by me.

 

It appears as though the collector is not a stranger to fielding complaints.

 

I think the astounding thing about an agency of this type is that it appears as though consumer agencies, better business bureaus and government officials actually allow an agency of this type to figuratively play a little game of alleged unseen blackmail with whom ever they wish to hassle in behalf of their clients. 

 

I think the problem that is upsetting an agency of this type is that new consumer laws have apparently substantially weakened their ability to pursue litigation in behalf of their client’s accusations. 

 

Also, it appears as though an agency of this type is apparently finding that the business model of perhaps trumping up false charges against a consumer, and then trying to shake down that consumer into paying what I think is a ransom to avoid being reported to Trans Union.

 

I think the business model of an agency of this type is doomed to failure because I think their business relies on allegedly dishonest claims from their client and Fair Isaac ratings from Trans Union to perhaps coerce consumers into paying a price.

 

I think an agency of this type may attempt to compel payment by subtle unnoticed and unseen force, or intimidation, or authority, apparently especially without regard for individual desire or volition.

 

I think an agency of this type appears to attempt to bring about payment through the use of subtle unnoticed and unseen force or other forms of compulsion.

 

I think it appears as though an agency of this type attempts to dominate or control, especially by perhaps exploiting fear anxiety in order to receive payment.

 

In short I think it looks as though an agency of this type holds a consumer’s credit rating invisibly hostage until the consumer pays what appears to be or not to be a requested ransom.

 

However, I think there is a major flaw in the reasoning and logic of an agency of this type.

 

I think false accusations will not stand up in court, and even if by chance they did, an agency of this type would have to work very hard to try and collect.  

 

I think that an agency of this type is a lazy collection agency.

 

I think an agency of this type prefers a laissez-faire way of working.

 

I think an agency of this type simply accepts possibly and perhaps any substantiated account that may very well be in error an unsubstantiated account and quite probably simply submits said account to Trans Union, and then maybe just sits back waiting for the money to roll in when the consumer wants to buy a house or a car or any item that involves a Fair Isaac number.

 

I think they appreciate a regulatory policy that allows businesses to operate with very little interference from the government.

 

I think that they would not last a month working with a collection agency where they would actually have to work accounts for collection.

 

I think that thanks to new consumer laws companies like Trans Union are losing their influence on consumers as some businesses are finding ways to make a sale regardless of what Trans Union reports about that consumer.

 

The following are some complaints that I compiled from the Better Business Bureau web site made to the Better Business Bureau against an agency of this type and their clients.

Complaint

Agency is trying to collect on unsubstantiated bill and was told pay or would be put on credit and then hung up on.

I was leasing a property in Charleston SC. I have an email from them stating that I have a $3 refund coming back to me. I am now two years later receiving call from (said agency) about a bill for $1800. I told them that I had the email to show that I had a refund and they told me to pay a third of the bill or it would go on my credit and then hung up on me.

 

They do not have the right to threaten with no basis and just say pay or we will put something on your credit.

 

Desired Settlement

They have the email that was sent to me showing nothing was due. They need to send me verification that they are removing any charge against me and notify that nothing is owed.

 

Problem with collection agencies is they do not listen and just threaten.

 

Business Response

The Agency certainly understands and appreciates the Consumers' question which is why we are conducting the Validation process designed to offer a clear and exact response to any funds that may be due; or not due. We are pending that confirmation from the initial creditor and will be able to complete the response upon that arrival. While we were unable to provide that completed response during the Consumers' call, we appreciate his patience as we continue to monitor and obtain the actual specifics he seeks.

Complaint

The company is a collection agency that has a collection account from a house I leased 5 years ago. The collection is for damage that existed when we moved into the house, mostly carpet at the tune of $800. I have move-in inspection that lists in several places all of the carpet damage throughout the house. The inspection also clearly states that the yard is not kept yet another $100 charge for lawn care. I was shown hand written invoices by the leasing agency to prove estimates for repairs. I have provided this information and the walk through to the collection agency. I have also requested itemized receipts of purchase for materials and official invoices for jobs completed. I have requested this from the company as well. I was sent a copy of an itemized rent payment schedule with the charges included and told that was sufficient by the collection agency. I am entitled to see the information I requested. Actual receipts for purchased materials and services rendered. Please consider this a complaint against both companies. I can provide documents for everything as well as a notarized statement from another previous tenant who I have met that has had exactly the same thing happen to them.

 

Desired Settlement

I want the charges dissolved and removed from my credit immediately and a letter saying the charges were a mistake for future lenders.

 

Business Response

(Said agency) is servicing a debt file on behalf of our client. The file is for and was received from our client on 08/16/2011. Mr. has exercised his right to dispute the validity of this debt, and (said agency) has performed all validations. The two parties in this transaction simply disagree. (Said agency) has reported the file to credit repositories in accordance with our permissible purposes and according to all state and federal laws in the appropriate manner. (Said agency) would appreciate the opportunity to negotiate this file on behalf of our client. Mr. is welcome to contact us where he may speak with the Department Head. (Said agency) understands how frustrating this issue may be, and devote us to helping in any way possible.

 

Based on the above complaints to the Better Business Bureau regarding (said agency), the Better Business Bureau gives (said agency) an “A plus” rating.

 

I find that very hard to believe and I will remember that next time I search for a business on the Better Business Bureau web site.

 

I think perhaps an agency of this type quite possibly may be violating the spirit and not necessarily the body of many of the rules and regulations as outlined in the OBLIGATIONS OF FURNISHERS UNDER THE FCRA.

 

My desired settlement is I think that an agency of this type and their clients may be perhaps running a non-scam type of scam to maybe attempt to figuratively but not literally extort monies from consumers and should be investigated as such.

 

I think an agency of this type and their clients possibly attempt to maybe perpetrate a mock confidence game, imitation fraudulent scheme, or perhaps un-swindle in order to make a quick profit.  

 

I think an agency of this type and their clients perhaps attempt to pretend to wrest or wring monies from not all consumers by an unnoticed intimidation, or a subtle unseen abuse of authority.

 

I think an agency of this type and their clients may attempt to perhaps obtain by a force, unseen and unnoticed threat, or the like to take monies I think perhaps maybe unbiased by reason of their office, thereby appearing that an agency of this type inserts themselves into the chain of causation by their bias.  

 

My wife enjoyed visiting the office at the apartments and getting to know the staff, one of which was the mother of the manager of the apartments.

 

The manager’s mother shared with my wife that she has declining health issues.

 

The manager’s mother also shared that was being paid a meager $9.00 per hour under the table for horrifying work with her health conditions, on her hands and knees scrubbing floors and shoveling snow in the apartment complex just to name a few of her tasks.

 

Many the tenants knew she was the hired help. To our knowledge a person doing such duties are to be given a 1099 at the end of the year, but of course that is a question for the IRS which we feel that the IRS should investigate at this point.
