I met with a representative from Capital Merchant Services and signed a contract for a card processing machine. I was promised at the time of signing that Capital Merchants would supply our small business with two web-sites that would be up and running within one week (in time for the holiday season), 1000 fliers, 1000 business cards, 25 gift cards and unlimited travel vouchers for both of our companies.

These promotional items would be given to us in two weeks. I was told at the time of signing that we could get out of the contract at any time for $200.00 and that we could cancel within three days. I signed the contract. On the third day I called to cancel because when we left the signing we had not be given a copy of the contract to review. I thought it was just a slip, but looking back I have to wonder.

We were also unsure if the machine would benefit our business enough to cover the $82.13 monthly fee. I was again assured of the items that we would be receiving and the benefit of the web-sites to our small company. I was again told that we could cancel at any time for $200.00.

Two weeks later we had yet to receive the web-sites, the promotional items that we were promised and we were not even contacted in their regard. I went to the offices after we had tried to contact them by phone. We met with Keith Day and expressed our concerns and our desire to be released from our contract. At that time he told me it was impossible to cancel the contract not even for the $200 we had been told. He said we were locked in for 4 years.

I left feeling discouraged but ready to make the most of it as we were again promised the web-sites and promotional items. We were told for the first time that we needed to supply the graphics for the business cards. As it had been presented to us that was all to be done by Capital Merchant Services. It doesn't make sense that we do all the designing and they simply run it through the printer! That is not the service that was promised. However, we had the graphics to them within one hour of our conversation, never to hear from them again-literally!

It is now four months later, we just closed our bank account as the $82.13 ended up being $95.00, and then there were all the other fees that were never discussed but were in the contract that we were not given at the time of signing. There was nearly $600 withdrawn out of our account in a short three months.

We tried to call them and our phone calls were never returned. We filed various reports to which there were never a response. We sent them a certified demand letter to which they never answered.

Our contract with MBF Leasing Company was fraudulently induced and I believe there was never any intention for Capital Merchant Services to supply us with the items they promised.

They need to be stopped! Today we filed a suit against Capital Merchant Services in small claims court. Will they answer now?

Capital Merchant Services/MBF Leasing

I am an investigator looking into the two companies listed in this rip off report. If Tiffani or others having the same problems in Utah with these companies will contact me, I would appreciate it. Some contract areas are not within our jurisdiction, but some of the business practices may be. If a product or service is paid for and then not delivered or provided to a consumer, the company may be held accountable.
