In the process of purchasing a condo last year, Cynthia Crum claimed to require the signatures of both my wife and I to submit an offer.
* Once the offer was accepted, instead of contacting us to execute the contract, she proceeded to copy and paste our signatures into the contract in the appropriate places.
* At no time did she receive authorization from us in either verbal or written form to attach our signatures in any manner.
* In addition, at no time would she disclose her commission or the closing costs or procedure. She didn't bother to attend the closing, give us any information concerning it, or even bother returning our calls in the day proceeding. Due to this, we did not have the information required and were not able to complete the closing on that day.
* Finally, when the contract was sent to us, the lead paint disclosure form was not included.
After attempting to pursue this through both the Better Business Bureau, no resolution was forthcoming and I filed with Northern Virginia Association of Realtors (NVAR).
Once a complaint was filed against her via NVAR, the full contract was delivered to us along with the lead paint disclosure form which claimed we were okay with the lead content and received information to deal with it. To date, she never informed us and we never received this information.
The NVAR complaint is currently in process, but they've already "lost" it once and requested us to resubmit just days before their internal statute of limitations. As of now, it has been 9 months since the closing and almost 7 months since our first filing against her.

After receiving a very damning judgement from the NVAR Ethics Committee early last month, a final hearing date was set for the week of 23 October, 2006. Just moments ago (11 Oct), I have received a call from NVAR that Cynthia Crum is letting her membership lapse and will not be renewing it.
Despite committing fraud, despite failing in her professional capacity, she is getting off the hook. This woman (and her husband) would be considered criminals in most areas... but in this one, she's simply a "member not in good standing". What a joke.
I will make the full documentation available online for anyone to review.

All,
Supposedly she was representing us as the Buyers' Agent.
The initial offer was verbally and we were asked to submit it in writing. I did much of this personally with the Sellers' Agent because Cynthia did not return his calls or emails.

Along with the the Realtor's Association, you should file a complaint with the licensing authority in Virginia. It should be easy to find online and they may even have a means to file online. Things like forged signatures are in the category of laws violation and could result in that person having their license revoked. In addition, the lead paint disclosure is a federal law and applies to any home build before 1978.

Keith,
I have a few questions concerning your situation.
I am a former Realtor(r) and was wondering if Ms. Crum was the agent for the seller's or did she agree to represent you as a buyer's agent or in a dual agent capacity? The reason I am asking is because of the fiduciary responsibility that the agent is required to follow. These vary depending upon who the agent represents.
Concerning the Lead Based Paint disclosure, can you provide the year the property was built? The regulations on the need for this type of disclosure is based upon the age of the property.
Did you originally speak about a verbal offer or was it done in writing? If it was done verbally with the seller's agent, they pass the information on, but it is not accepted completely untill it is in writing.
What type of paperwork did you complete for the offer? When an offer to purchase is submitted to the seller's in writing, it is in contract form. The contract is the offer. The offer is then presented to the sellers. The sellers either accept or reject the offer. If accepted, they sign the same contract that you signed and it is now considered a "ratified contract".
If you could provide a little more clarification, I may be able to give you better guidance on who to report to.
